RESOLUTION NO. 0 ` 5 9 47
A RESOLUTION authorizing and directing the City Manager of the City
of Yakima to execute an agreement for tree removal on
City right-of-way.
WHEREAS, the City desires removal of a particular tree in the City
right-of-way on property belonging to Mr. and Mrs. Paul E. Borg, to lessen
the danger of the tree's falling into the adjacent City street; and
WHEREAS, Mr. and Mrs. Paul E. Borg are willing to sign an
agreement by which they agree not to pursue any claim they may have by
reason of the tree's value or the effect of the tree's removal on their
property's value; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
The City Manager and City Clerk of the City of Yakima are hereby
authorized and directed to execute an agreement with Mr. and Mrs. Paul
E. Borg for the purpose described above, a copy of which agreement is
attached hereto and by reference made a part hereof.
ADOPTED BY THE CITY COUNCIL this 25th day of June,1991.

TREE REMOVAL AGREEMENT
This agreement is made on the date below -noted, by the City of
Yakima (City) and Mr. and Mrs. Paul E. Borg (the Borgs):
(1) In consideration of the City's removal of a box elder tree
located on the Borg property at 2810 West Chestnut, Yakima, Wash-
ington, the Borgs promise to forbear from pursuing any claim or
action based on the City's removal of the tree, including but not
limited to the value of the tree and/or the value of the Borg
property after removal of the tree, including stump removal by the
chipping method to the depth permitting growth of grass over the
tree site.
(2) In consideration of the Borg's promised forbearance as de-
scribed in paragraph (1) above, the City promises to remove the box
elder tree.
