RESOLUTION NO. D 5 9 4 5
A RESOLUTION certifying the existence of an emergency situa-
tion and authorizing advancement of City funds
for the immediate connection of domestic water
mains to houses within the Fairview -Sumac area.
WHEREAS, the area which is hereinafter described is now
subject to well water contamination:
That area within the
- Fairview -Sumac area
west by Fair Avenue,
on the east, Maple
north, and Pacific
South; and
City of Yakima
bounded on the
Interstate 82
Street on the
Street on the
WHEREAS, Dr. Robert G. Atwood, Health Officer of the
Yakima Health District, found that well water contamination in
the above-described area constitutes a present health emergen-
cy requiring immediate connection to City domestic water
mains, and
WHEREAS, the Council adopts the findings of Dr. Atwood
found in his two letters of March 21, 1991, which are attached
hereto and incorporated herein by reference, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Council hereby declares that an emergency exists
in the above-described area requiring the immediate connection
of domestic water mains to houses in the Fairview -Sumac area
without calling for bids pursuant to the provisions of RCW
35.22.620.
The Council hereby directs the City Manager to cause to
be prepared appropriate plans and specifications for the
immediate connection of said water mains to said houses.
The City Manager is authorized and directed to publish a
description and estimate of the cost of the work to be per-
formed herein within seven (7) days after the commencement of
such work.

The City Manager and City Engineer are authorized and
directed to advane,City funds and enter into Limited Water
Connection Agreements in order to accomplish immediate water
main connection in accordance with Yakima Municipal Code §
7.75.020.
The City Council hereby certifies pursuant to RCW
35.22.620(6), the existence of the above-described emergency
situations.
ADOPTED BY THE CITY COUNCIL this 25th day of June
1991.
