Schussler. and • Whitaker absent. . . A Damage Claim having been filed with the City'Clerk on July 20; 1972, by, Mrs. Shirley L. McHugh, 624 South: 13th' Avenue, in the amount of-' $29.45 for damages tor•her automobile - caused by a.City- vehicle, it was MOVED by Lambert, seconded by Robinson that said claim for damages be referred to the City Manager and Staff for study and 'recommendation: carried, Broad, Brown, Lambert, Lust and Robinson voting aye by voice. vote. Schussler and Whitaker absent. . . Mr. Bob Horn; local businessman, explained that he is still interested in, the -of the ordinance that requires photographers to be investigated. Councilman Robinson re- minded Mr. Horn that this= matter , has- been referred to =the :.Staff •for study .and. recommen- dation. .. . . . Parks and Recreation Director Bill Hutsinpiller reported on two recommendations by the Parks and Recreation Commission. He explained that the site plans for the new Senior Citizens Center have been revised to fit on. , the one parcel already owned by the City. of Yakima, since they have been unable as of , 'yet to complete thepurchase-of land necessary for the original plan. Mr. Hutsinpiller reported that the Parks and Recreation Commission'. recommendation is that the City Council approve the alteration of the site location from the west side of the proposed park acquisition to the east side of the existing land in Miller Park. City'Manager McMicken explained that the building plan will also be brought back to the Council,, when it is ready for bidding purposes. After due discussion, it was MOVED by Robinson, sec nded by Lambert that the' revised site plan for the new. Senior Citizen's Center be approved as recommended by the Parks and Recreation Commission: car- ried, Broad, Brown, Lambert, Lust and Robinson voting aye by voice vote. Schussler and Whitaker absent. Parks and Recreation Director Hutsinpiller then reported that the State Highway Department is interested in donating a lake located on the north side of Yakima to the Parks and Recreation Department. He further reported that the lake is now being used for regional recreation, and.that it has potential that the City.presently does not provide. Mr. Hutsinpiller explained that the Commission had requested that some figures be acquired as to the cost of maintenance on this facility, and in analysis, it was found that it would cost approximately $370 per month for minimum maintenance, and this main- tenance would be required for 4 months of the year. He further explained that the Com- mission felt that this cost was minina,lenough that without any further improvements, the maintenance could be handled. Mr..Hu.tsinpiller reported that the Parks and Recreation Commission's recommendation is. that the City Council approve acceptance of the lake, which has been offered by the State Highway Department, for future development and public use. He indicated that if the City does not accept, the State Highway Department is planning on selling the property. City Manager McMicken indicated that this matter should be studied further, and a review be made by the Planning Commission, as it relates to the long range comprehensive Park Plan. Discussion brought out that the State has indicated interest of disposal of the property at an early date. Schussler and Whitaker absent. Mr. Hutsinpiller requested that the City Manager write a ( letter to the State Highway Department explaining the City's,position.in the matter. Council members indicated that they would like. the . 'matter of legal liability to be looked into. Persons present and speaking in favor of • the acceptance of the lake were Park's and Recreation Commission member Donald McGuinness and an interested citizen George McElroy. Robert W. Bignold, President of Olson, Richert,' Bignold, Architects= Planners- Engineers, reviewed the analysis of bids for the construction of the:Lions indoor - outdoor pool and the outdoor pool. He stated that the bids were opened on July 19, 1972, and of the three received, the lowest and best bid was submitted by Gilbert Moen Construction Company in the amount of $732,000. He further stated that this bid exceeded the' architect estimate by approximately five percent: He related that ORB recommends the award of the • two pools be made to: Gilbert Moen Construction Company. in the base bid amount of $732,000. Mr. Bignold explained that several items were bid as alternates; however, due to time limitations the Gilbert Moen Construction Company did not submite prices.. He further • explained that prices were negotiated subsequent to the bid opening, and that ORB recom- mends a change order'be issued to delete several items from the contract, which will reduce the amount that'the•base bid exceeds the Architects,estimate by only three. percent. -Parks and Recreation Director Bill Hutsinpiller and Council members discussed deletions and changes in alternates. Mr. Bignold pointed out that if the Council decides to enclose the Eisenhower outdoor pool in the future, ORB recommends that they accept alternate bids on two items. Robert DiPietro, Donald McGuinness and George Shuford.,: members,of the Parks and.Recreation Commission, spoke in favor of having. eht Eisenhower pool covered, • and brought idea that we should give the citizens what they had voted for on the Park bond issue. Mr. Hutsinpiller explained that formal action. on the bids'would be taken at the next meeting of the Council. Councilman•Lust questioned the possibility of pool hours being lengthened, and Mr. Hutsinpiller indicated that he would look into the matter. City Manager McMicken reported that bids were received and considered by a Bid Board on ' July 21, 1972, on•South 32nd Avenue and Nbb Hill Boulevard Intersection Improvement,. as follows: ' Superior Asphalt and Concrete Company $37,142.00 • Triangle Sand and Gravel Company 44,895.00 Yakima Asphalt Paving Company 45,725.00. . The City'Engineer recommending that the contract be awarded to Superior Asphalt and Concrete Company, who submitted the lowest and best bid in the amount of $37,142.00, it was MOVED by Robinson, seconded by Lust that the recommendation_of the City be accepted and that the contract be awarded to Superior Asphalt.and'`Concrete Company, in the amount of $37,142.00, and that the City Manager be authorized to enter into a contract with said contractor upon the filing of the proper bond and insurance: carried, Broad, Brown, Lambert, Lust and Robinson voting aye by voice vote. Schussler and Whitaker absent. City Manager McMicken spoke to this matter in connection with the Yakima Valley Transportation railroad tracks, and Council members informally decided to discuss this during a study session. . • Public Works Director Dave Vargas reported that after a conversation with .the Urban Ar- terial Board, the program for construction of streets and arterial streets in the City of - Yakima, as adopted d -by Resolution No. D -1878, dated June 13, 1972, has been revised. He explained that two projects have been changed from 2 cent gas projects to U.A.B. or Capi- tal Improvement Fund projects.... He further explained that the cost estimates are changed. Mr. Vargas pointed out that as of a result of a meeting with the City Manager, Planning :Director and Traffic•Engineer, three new projects have been added, and another has been increased to cover inflation of next year. After _due discussion, it was MOVED by Brown, seconded by Lambert that•Resolution No. D -1902 revising the Six Year Construction Program by adding additional projects for 1972, be passed as read: carried, Broad, Brown,- Lambert, • Lust and Robinson voting aye on roll call. He further explained that the City desires that this company continue to perform such ser -• vice in accordance with a renewal agreement that would become effective September 1,. 1972. It was then MOVED by .Lust, seconded by Robinson that Resolution No. D -1903 autho- rizing execution of said renewal agreement with the American District Telegraph Company of Washington for burglar alarm service for the Water Treatment Plant, be passed as read: carried, Broad, Brown, Lambert, Lust and Robinson voting aye on roll call. City reported to the Council that he had a request from.Mrs. Bess / Murphy, manager of the local office of Pioneer National Title Insurance Company, that the City execute a Release of Easement and Quit Claim Deed to vacate an easement of • record held,by the City over and across property owned by`First National Theatre, Inc., • in Union Gap, where a shopping mall is being constructed. By Resolution No. D -1751, adopted November 15, 1971, the City had vacated that easement, but for title insurance purposes, to facilitate financing of the construction, the additional legal document was requested. After due discussion, it was MOVED by Robinson, seconded by'Lust, that the City'Attorney prepare such a'document, and that the City Manager and City Clerk be authorized to execute it on behalf of the City,' for delivery -to the title company: car- ried, Broad, Brown, Lambert, Lust and Robinson voting,aye by voice vote.
