City Council met in special session pursuant to due notice, at ]2:00: 'Noon, June 26, 1972, in-the Conference Room at Yakima' City Hall. Councilmen.pre.sent at the meeting were Mayor Bert Broad, Wray Brown,. Lenore Lambert, James Lust, Walter Robinson and Bill Whitaker. Also present were.City Attorney Andrews, Public Works•Director Dave Vargas and City Clerk Marie Donelson. ' City Attorney Fred' Andrews reported on impact.of'a recent opinion of the U.S. Supreme Court regarding a requirement for legal counsel to be appointed for indigent defendants.- Dave Vargas, Director o.f Public Works, and Marie•Donelson; City Clete, each reviewed a•pro- posed work program for 1973. ° The special meeting adjourned at 3 :00 P.M. Mr. Otto further explained that this rezone request results from the developer disregard for those conditions upon which final planned development approval was granted. F / 392 JUNE 26, 1972 This being the time fixed for a Hearing on a Rezone Application filed by Glascam Builders., Inc. and Robert W. and Mary D. Strausz, for the rezone of property at 56th and Summitview Avenues, Planning Director Jay Otto explained that this request is for rezoning of appro- ximately 8 acres for a 45 unit condominium Planned Development. He reviewed in detail the Staff Report and.Planning.Commission minutes'on this request. Mr. Otto indicated that the General Plan designates this area as being low density residential, and the density of 6.1 dwelling units per net residential acre represented by this development is not inconsistant with the intent of the General Plan.. Mr. Otto reported that the Planning Staff and Plan- ning Commission recommended final approval for this planned development certain con -' ditions which have been agreed'upon. .Mr. Eldon Broetje, an'adjacent property owner, ques- tioned the height of a chain link fence on the east side'of the property, and it was es- tablished the fence would'be 6 feet high. After due discussion; it was MOVED by Ro- binson, seconded by Brown - that - Ordinance No. 1417 accepting:the recommendation of the Planning Commission and rezoning said property, be-:passed as read: carried, Broad, Brown, Lambert, Lust, Robinson.and Whitaker voting aye on roll call. ORDINANCE NO. 1417, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 56th Avenue and Summitview Avenue in the City of Yakima, Washington, from R -1, Single Family'Zone, and R -2, Two- Family Zone, to Planned Development Zone. . . Mr. N. A. Medley, being present, the matter of a change zoning classification for his property situated Avenue and Nob Hill Boulevard brought back on for discussion It was MOVED by Robinson, seconded by Lust that an Ordinance accepting the recommendation of the Planning Commission and rezoning said property owned by N. A. Medley, be passed as read. Mr. Medley spoke to the matter and stated that he had reported to the Planning Commission that according to the laws, the county must pay for the quit claim deed; otherwise the acquisition of the right of way property would be illegal. Councilman Ro- binson indicated that the conveyance of right of way property' to the - County without any charge was proper and valid. He further indicated that if Mr. Medley was willing to re- imburse the County, this matter could be reconsidered by the City Council and referred back to the Planning Commission. Mr. Medley requested this Hearing be held over for three weeks while he considered the matter. After due discussion, and it having been ascertained that this continuance would not hold up the County on its project, it was MOVED by Lust, seconded by Robinson that this Hearing on a change of zoning classification for N. A. Medley property situated at South 48th:Avenue and Nob Hill'Boulevard be continued for three weeks or until July 17,1972 carried, Broad, Brown,.Lambert, Lust, Robinson and - Whitaker voting aye by"voice vote. Schussler absent. Mr. Medley indicated that he would transmit his answer in.writing.V • This being the'time fixed for a Hearing on a Rezone Application filed by Floyd Hampson, for rezone of property situated at 3802 Tieton Drive, Planning Director Jay Otto reviewed the' staff report of. request for a one -story dental clinic planned development. Mr. Otto explained that in light of past history, planned development for this area is a practical and desirable alternative'to. other types of zoning. Mr. Otto further explained that the Planning"Commission looked on this proposal favorably for five reasons: (1) the proposed location of the building, courtyard, and parking area are suitable for best uti- lization of the site, (2) minimum - traffic problems are 'foreseen since access can only be obtained via South 38th'Avenue, (3) the possibilities of strip zoning will be reduced along the south side of Tieton Drive, (4) the professional office will serve to reinforce the established residential neighborhoods by providing a residentially oriented service, and (5) this proposal as a planned:development would serve as a buffer zone between existing residential and business zones.•'Mr. Otto reported that the -staff recommends this petition for rezone and'final planned development program be approved,subject to the following re- quirements: (1) five foot sidewalks be constructed along.South 38th Avenue and Tieton Drive, and (2) a three. five foot planting strip along South 38th Avenue and Tieton Drive be established betWe.en the sidewalk and curbs and planted with - trees of a variety recommended by the City Street Tree Mr. Floyd F. Hampson, Jr., being present, questioned the safety of trees around the planted area and also of the sidewalk. Planning Director Jay Otto reported thatthe trees would require vision clearance, and as far as the side- walk went, the Planning Staff has determined that they would continue to require sidewalks as part of a Planned•Development. After further discussion, it was decided that•low shrubs could replace the requirement of trees. It was then MOVED by Brown, seconded by Lust that Ordinance No. 1418 accepting the recommendation of the Planning Commission and re- zoning said property, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye on roll call. ORDINANCE NO. 1418, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 3802 Tieton Drive in the City of Yakima, Washing- ton, from R -1, Single Family Zone, to Planned Development Zone. An 'Ordinance appropriating.$41,800 to various funds and accounts to pay for prior service charges to the Public Employees.Retirement System, having been read in its entirety at this meeting, was laid on the table for one week or until July 3, 1972. City Finance Director Leonard Crose explained that this $41,800 must be appropriated within various fundsto • various accounts in order to pay the amount due for the current year to the Public Employees Retirement System for prior service charges for both retired and active members of that system. It was MOVED by Brown,'seconded , by Robinson that Ordinance No. 1419 amending the City Code to prohibit parking on 16th Avenue from "I" Street to Fru•itvale Boulevard, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye on roll call. ORDINANCE NO. 1419, AN ORDINANCE relating to traffic control; prohibiting parking on cer- tain streets in the City-of Yakima; and amending subsection 9.75.040 (g) of the City of Yakima Municipal Code. • - • • Acting City Manager Fred Andrews referred the matter of a request for Outside Utility Ser- vice at 201- Fair Avenue to Planning Director Jay Otto. Mr. Otto explained that Mr. and Mrs. Ervin Hansen have submitted an outside utility agreement and application requesting domestic water service for .an existing single- family•residence located at this address. He further explained that an . 8--inch domestic water line is located along Fair Avenue and parallel to the western boundary of the site; therefore, the property could be served with - out extension of City services. Mr. Otto reported that the City Engineer has indicated •393 . JUNE` 2'6, '1972 the-connection•charge would be $412.50 based on the outside utility rate. •Mr...Otto stated that the Planning Staff recommends approval of this request in that; (1) 'the property conforms :bathe General.' Plan' s •designation of low - density •residential ; (2) . the property can be .served without extension of City services, (3) annexation is not practical.at this time, and (4) the applicant has signed'an outside utility agreement., After. due-; discussion, it was MOVED by Robinson, seconded: by Lust that approval be given for'outside water :service. - to 201 Fair .Avenue: carried, Broad, Brown, Lambert, Lust', Robi nson and Whitaker•voting aye by voice vote. Acting City Manager Fred' Andrews referred the matter :of':authorization. to 'execute _a: Pro- ject Agreement with• ,State of Washington Interagency Committee 'for:- Outdoor:_Recreation for redevelopment of Washington Park to Director of Parks;;an.d Recreation Bill Hutsin- piller. Mr., Hutsinpiller explained that this grant commits' the state'•to`..provide' 25% matching funds for Washington Park.. He reported that 50% has been recommended _to. Housing and Urban Development, .for which another application has been:':.developed and!sent.in. Mr. Hutsinpiller indicated that a grant approval is expected by the first partrof Sep- tember.
