A RESOLUTION
RESOLUTION NO. D 5 8 9 3
authorizing the execution of an agreement with the
State of Washington, Planning and Community
Affairs Agency, for fire protection services to State
facilities
WHEREAS, the City of Yakima furnishes fire protection services to
property and facilities owned by the State of Washington, within the City
of Yakima corporate limits, for which services the State will reimburse the
City ad provided by the attached agreement documents, and
WHEREAS, the City Council of the City of Yakima deems it to be in
the best interests of the City that the attached agreement document be
executed by the City in order that such reimbursement may be made, now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
The City Manager and City Clerk of the City of Yakima are hereby
authorized and directed tc execute an agreement with the State of
Washington, Planning and Community Affairs Agency, for the purpose
mentioned above, a copy of which agreement, entitled "Fire Protection
Contract for State-owned Facilities in City Boundaries" (Contract No 1-89-
26393), is attached hereto and by reference made a part hereof.

FIRE PROTECTION CONTRACT PROGRAM
FISCAL YEAR 1991 ANNUAL AMENDMENT
This Fiscal Year 1991 Annual Amendment to Contract No. 1-89-26393
entered into by and between City of Yakima (hereinafter referred to as
the CONTRACTOR) and the Washington State Department of Community Development
(hereinafter referred to as the DEPARTMENT), WITNESSES THAT:
Pursuant to RCW 35.21.775, the Washington State Legislature has appropriated to the
DEPARTMENT the sum of $436,693 to implement the Fire Protection Contract
Program for Fiscal Year 1991. The DEPARTMENT has completed an annual survey
of state-owned facilities located in incorporated cities and towns. The Fiscal Year
1991 funding under this CONTRACT has been allocated in accordance with the
requirements of RCW 35.21.775 and 365-80 WAC.
The purpose of this Annual Amendment is to provide the CONTRACTOR with its
proportional share of the appropriated funds for Fiscal Year 1991.
The following sections are amended to read as follows:
1. The DEPARTMENT agrees to pay the apportioned amount of $4,6? - to the
CONTRACTOR within thirty (30) days after receipt of request for payment for
services from July 1, 1990 to June 30, 1991. Thereafter, amounts to be paid shall be
calculated pursuant to this CONTRACT, and RCW 35.21.775 (and regulations
adopted pursuant thereto). The CONTRACTOR agrees to accept this amount, and the
amounts so calculated, as payment for fire protection services; provided supplemental
agreements as authorized in RCW 35.21.777 may be negotiated.
6. The DEPARTMENT has been appropriated the sum of $436,693 as the total
appropriation available under RCW 35.21.775 to fund fire protection contracts with
eligible cities and towns during this contract period. Pursuant to WAC 365-80, the
DEPARTMENT shall disburse to the CONTRACTOR a portion of the $436,693
equal to the CONTRACTOR'S percentage share of all state-owned building square
footages within all cities statewide as identified in Schedule A - FY 1991 which, by
this reference, is made a part of this CONTRACT and is agreed to accurately state
the square footage figures, including estimated levels of construction, from which
payments are to be calculated. These figures shall be determined annually by the
DEPARTMENT pursuant to the provisions of WAC 365-80. No corrections for
additional state facilities will be made in the schedule of payments shown on Schedule
A during the current fiscal year.
16. Execution of this CONTRACT constitutes CONTRACTOR'S acceptance of the funds
authorized herein as full compensation under RCW 35.21.775 for all fire protection
services provided by the CONTRACTOR pursuant to this CONTRACT.
17. - In the event of a lawsuit involving this CONTRACT, venue shall be proper only in
the superior court of Thurston County, Washington.
This Fiscal Year 1991 Annual Amendment supercedes the Fiscal Year 1990 Annual
Amendment. This amendment shall be read in conjunction with the text of the original
CONTRACT and amendments thereto. Each and every provision of the original
CONTRACT shall remain in full force and effect except as amended herein, or by prior
amendments hereto.
IN WITNESS WHEREOF, the DEPARTMENT and the CONTRACTOR have executed this
Annual Amendment as of the date and year written below.

FISCAL YEAR 1990 ANNUAL AMENDMENT
Fiscal Year 1990 Annual Amendment to Basic Fire Protection
Contract for State -Owned Facilities within City Boundaries.
This Fiscal Year 1990 Annual Amendment to Contract No.1-89-26393
entered into by and between City of Yakima (hereinafter referred
to as the CONTRACTOR) and the Washington State Department of
Community Development (hereinafter referred to as the
DEPARTMENT), WITNESSES THAT:
The Washington State Legislature has appropriated $437,000
to the DEPARTMENT to implement the Basic Fire Protection
Contract Program for Fiscal Year 1990. The DEPARTMENT has
completed an annual survey of state-owned facilities located
in incorporated cities and towns. The Fiscal Year 1990
funding under this CONTRACT has been allocated in accordance
with the requirements of RCW 35.21.775 and 365-80 WAC.
The purpose of this Annual Amendment is to provide the
CONTRACTOR with its proportional share of the appropriated
funds for Fiscal Year 1990.
The following sections are amended to read as follows:
1. The DEPARTMENT agrees to pay the apportioned amount of
$4,244 to the CONTRACTOR within thirty (30) days after
receipt of request for payment for services from July 1,
1989 to June 30, 1990. Thereafter, amounts to be paid shall
be calculated pursuant to this CONTRACT, and RCW 35.21.775
(and regulations adopted pursuant thereto). The CONTRACTOR
agrees to accept this amount, and the amounts so calculated,
as payment for basic fire protection services; provided
supplemental agreements as authorized in RCW 35.21.777 may
be negotiated.
6. The DEPARTMENT has identified the sum of $437,000 as the
total appropriation available to fund basic fire protection
contracts with cities during this CONTRACT period. Pursuant
to WAC 365-80, the DEPARTMENT shall disburse to the
CONTRACTOR a portion of the $437,000 equal to the
CONTRACTOR'S percentage share of all state-owned building
square footage within all cities statewide as identified in
Schedule A - FY 1990 which, by this reference, is made a
part of this CONTRACT and is agreed to accurately state the
square footage figures, including estimated levels of
construction, from which payments are to be calculated.
These figures shall be determined annually by the DEPARTMENT
pursuant to the provisions of WAC 365-80. No corrections
for additional state facilities will be made in the schedule
of payments shown on Schedule A during the current fiscal
year.
15. REDUCTION IN FUNDS
The DEPARTMENT may unilaterally terminate all or part of
this CONTRACT, or may reduce its scope of work and budget,
if there is a reduction in funds by the source of those
funds, and if such funds are the basis for this CONTRACT.
This Fiscal Year 1990 Annual Amendment supersedes the Fiscal Year
1989 Annual Amendment. This amendment shall be read in
conjunction with the text of the original CONTRACT and amendments
thereto. Each and every provision of the original CONTRACT shall
remain in full force and effect except as amended herein, or by
prior amendments hereto.

This Fiscal Year 1989 Annual Amendment to Contract No. 1-89-263-93
entered into by and between ' City of Yakima
(hereinafter referred to as the "CONTRACTOR"), and the Washington
State Department of Community Development, formerly the Planning
and Community Affairs Agency (hereinafter referred to as the
"DEPARTMENT") WITNESSES THAT:
The DEPARTMENT has been appropriated $437,000 for Fiscal Year 1989
from the Washington State Legislature. The DEPARTMENT has
completed an annual survey of State Facilities located in
incorporated cities and towns. The Fiscal Year 1989 funding under
this contract has been allocated in accordance with the
requirements of RCW 35.21.775 and 365-80 WAC.
The purpose of this annual contract amendment is to provide the
CONTRACTOR with its proportional share of the appropriated funds,
for Fiscal Year 1989.
The Following Sections are Amended to Read as Fo ows:

$ 4 , 437.00 to the city within 30 days after receipt of
payment request for services from July 1, 1988 to June 30,
1989. Thereafter, amounts to be paid shall be calculated
pursuant to this contract, and RCW 35.21.775 (and
regulations adopted pursuant thereto). The city agrees to
accept this amount, and the amounts so calculated, as
payment for basic fire protection services; provided
supplemental agreements as authorized in RCW 35.21.777 may
be negotiated.
6. The DEPARTMENT has identified the sum of $437,000 as the
total appropriation available to fund fire protection
contracts with cities during this contract period. Pursuant
to WAC 365-80, the DEPARTMENT shall disburse to the city a
portion of the $437,000 equal to the city's percentage share
of all state-owned building square footage: within all
cities statewide as identified in Schedule A FY 1989 which
by this reference is made a part of the agreement and is
agreed to accurately state the square footage figures,
including estimated levels of construction, from which
contract payments are to be calculated. These figures
shall be determined annually by the DEPARTMENT pursuant tc
the provisions of WAC 365-80. No corrections for
additional state facilities will be made iri the schedule of
payments shown on Schedule A during the current fiscal year.
14. It is understood and agreed that this CONTRACT is
solely for the benefit of the parties to the CONTRACT
and gives no right to any other party. No joint
venture or partnership is formed as a result of this
CONTRACT. Each party hereto agrees to be responsible
and assume liability for its own wrongful and/or
negligent acts or omissions, or those of its officers,
agents, or employees to the fullest extent required by
law, and agrees to save, indemnify, defend, and hold
the other party harmless from any such liability. In
the case of negligence of more than one party, any
damages allowed shall be levied in proportion to the
percentage of negligence attributable to each party,
and each party shall have the right to seek
contribution from the other party in proportion to the
percentage of negligence attributable to the other
party.
This Fiscal Year 1989 Annual Amendment supersedes the Fiscal Year
1988 Annual Amendment. This amendment shall be read in conjunc-
tion with the text of the original contract and amendments
thereto. Each and every provision of the original contract shall
remain in full force and effect except as amended herein, or by
prior amendments thereto.

executed this annual amendment as of the date and year written

RESOLUTION authorizing the execution of an agreement with the

Agency, for fire protection services to State
facilities.
WHEREAS, the City of Yakima furnishes fire protection
services to property and facilities owned by the State of
Washington, within the City of Yakima corporate limits, for
which services the State will reimburse the City as provided
by the attached agreement document, and
WHEREAS, the City Council of the City of Yakima deems it
to be in the best interests of the City that the attached
agreement document be executed by the City in order that such
reimbursement may be made, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and City Clerk of the City of Yakima are
hereby authorized and directed to execute an agreement with the
State of Washington, Planning and Community Affairs Agency, for
the purpose mentioned above, a copy of which agreement, entitled
"Fire Protection Contract for State -Owned Facilities in City
Boundaries" (Contract No. 1-89-263-93), is attached hereto and
by reference made a part hereof.

State Owned Facilities in City Boundaries
This Fiscal Year 1988 Annual Amendment to Contract No. FP 8483
entered into by and between City of Yakima
(hereinafter referred to as the "CONTRACTOR"), and the Washington
State Department of Community Development, formerly the Planning
and Community Affairs Agency (hereinafter referred to as the
"DEPARTMENT") WITNESSES THAT:
The DEPARTMENT has been appropriated $437,000 for Fiscal Year
1988 from the Washington State Legislature. The DEPARTMENT has
completed an annual survey of State Facilities located in
incorporated cities and towns. The Fiscal Year 1988 funding
under this contract has been allocated in accordance with the
requirements of RCW 35.21.775 and 365-80 WAC.
The purpose of this annual contract amendment is to provide the
CONTRACTOR with its proportional share of the appropriated funds,
for Fiscal Year 1988.
The Following Sections are Amended to Read as Follows:
1. The DEPARTMENT agrees to pay the apportioned amount
of $ 4,589 to the city within 30 days after
receipt of payment request for services from July 1,
1987 to June 30, 1988. Thereafter, amounts to be
paid shall be calculated pursuant to this contract,
and RCW 35.21.775 (and regulations adopted pursuant
thereto). The city agrees to accept this amount,
and the amounts so calculated, as payment for basic
fire protection services; provided supplemental
agreements as authorized in RCW 35.21.777 may be
negotiated.
6. The DEPARTMENT has identified the sum of $437,000 as
the total appropriation available to fund fire
protection contracts with cities during this
contract period. Pursuant to WAC 365-80, the
DEPARTMENT shall disburse to the city a portion of
the $437,000 equal to the city's percentage share of
all state-owned building square footages within all
cities statewide as identified in Schedule A FY 1988
which by this reference is made a part of the
agreement and is agreed to accurately state the
square footage figures, including estimated levels
of construction, from which contract payments are to
be calculated. These figures shall be determined
annually by the DEPARTMENT pursuant to the
provisions of WAC 365-80. No corrections for
additional state facilities will be made in the
schedule of payments shown on Schedule A during the
current fiscal year.

14. It is understood and agreed that this CONTRACT is
solely for the benefit of the parties to the
CONTRACT and gives no right to any other party. No
joint venture or partnership is formed as a result
of this CONTRACT. Each party hereto agrees to be
responsible and assume liability for its own
wrongful and/or negligent acts or omissions, or
those of its officers, agents, or employees to the
fullest extent required by law, and agrees to save,
indemnify, defend, and hold the other party harmless
from any such liability. In the case of negligence
of more than one party, any damages allowed shall be
levied in proportion to the percentage of negligence
attributable to each party, and each party shall
have the right to seek contribution from the other
party in proportion to the percentage of negligence
attributable to the other party.
This Fiscal Year 1988 Annual Amendment supersedes the Fiscal Year
1987 Annual Amendment. This amendment shall be read in conjunc-
tion with the text of the original contract and amendments
thereto. Each and every provision of the original contract
shall remain in full force and effect except as amended herein,
or by prior amendments thereto.

so calculated, as payment for basic fire protection services;
provided supplemental agreements as authorized in RCW 35.21.777
may be negotiated.

employees, and assigns, against any and all damages or claims from
damages resulting or allegedly resulting from the OONrRACTOR's
performance or activities hereunder.
This Fiscal Year 1986 Annual Amendment supersedes the Fiscal Year 1985
Annual Amendment.
This annual amendment shall be read in conjunction with the text of the
original contract. Each and every provision of the original contract
shall remain in full force and effect except as amended herein.

RESOLUTION authorizing the execution of an agreement with the State of
Washington, Planning and Community Affairs Agency, for fire
protection services to State facilities.
WI JW S, the City of Yakima furnishes fire protection services to
property and facilities owned by the State of Washington, within the
City of Yakima corporate limits, for which services the State will reim-
burse the City as provided by the attached agreement document, and
WHEREAS, the City Council of the City of Yakima deems it to be in
the best interests of the City that the attached agreement document be
executed by the City in order that such reimbrusement may be made, now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and City Clerk of the City of Yakima are hereby
authorized and directed to execute an agreement with the State of
Washington, Planning and Community Affairs Agency, for the purpose
mentioned above, a copy of which agreement, entitled "Fire Protection
Contract For State -Owned Facilities In City Boundaires" (Contract NO.
FP -8483), is attached hereto and by reference made a part hereof.

Fiscal Year 1985 Annual Amendment to Fire Protection Contract for State Owned
Facilities in City Boundaries.
This Fiscal Year 1985 annual amendment to Contract No. FP -8483
entered into by and between City of Yakima (hereinafter referred
to as the "CONTRACTOR"), and the Washington State Department of Community
Development, formerly the Planning and Community Affairs Agency (hereinafter
referred to as the "DEPARTMENT") witnesses that:
The DEPARTMENT has been appropriated $437,100 for Fiscal Year 1985 from the
Washington State Legislature. The DEPARTMENT has completed an annual survey of
State Facilities located in incorporated cities and towns. The Fiscal Year
1985 funding under this contract has been allocated in accordance with the
requirements of RCW 35.21.775 and 365.80 WAC.
The purpose of this annual contract amendment is to provide the CONTRACTOR with
its proportional share of the appropriated funds, for Fiscal year 1985, and to
provide for a change in the Agency's name to the Department of Community
Development.
The Following Sections are Amended to Read as Follows:
1. The Department agrees to pay the apportioned amount of $ 4198.00
to the city within thirty days after receipt of payment request
for services from July 1, 1984 to June 30, 1985. Thereafter,
amounts to be paid shall be calculated pursuant to this contract,
and RCW 35.21.775 (and regulations adopted pursuant thereto).
The City agrees to accept this amount, and the amounts so
calculated, as payment for basic fire protection services;
provided supplemental agreements ss authorized in RCW 35.21.777
may be negotiated.
6. The Department has identified the sum of $437,100 as the total
appropriation available to fund fire protection contracts with
cities during this contract period. Pursuant to WAC 365-80 the
Agency shall disburse to the City a portion of the $437,100 equal
to the City's percentage share of all State-owned building square
footages within all cities statewide as identified in Schedule A
FY 1985 which by this reference is made a part of the Agreement
and is agreed to accurately state the square footage figures,
including estimated levels of construction, from which contract
payments are to be calculated. These figures shall be determined
annually by the Department pursuant to the provisions of WAC 365-
80. No corrections for additional state facilities will be made
in the schedule of payments shown on Schedule A during the
current fiscal year.
This annual amendment shall be read in conjunction with the text of
the original contract. Each and every provision of the original
contract shall remain in full force and effect except as amended
herein.

FIRE PROTECTION CONTRACT FOR STATE-OWNED FACILITIES IN CITY BOUNDARIES
This contract entered into by the Planning and Community Affairs Agency
(hereinafter referred to as the Agency) and the City of Yakima
a municipal corporation organized and operated under laws of the State
of Washington, which has State-owned buildings except those leased to
non -tax exempt entities within its corporate territorial limits
(hereinafter referred to as the "City") witnesses that:
WHEREAS, the City has historically provided fire protection services to
all areas within its corporate limits; and
WHEREAS, the State owned facilities within the City are exempted frau
property tax levies which are the sources of funding the City's costs of
fire protection services;
WHEREAS, contractual agreements between public agencies are permitted by
the Interlocal Corporation Act, Chapter 39.34 RCW; and
WHEREAS, the State desires the benefit of fire protection services as
necessary for the safety and protection of state personnel and property
located within the City's boundaries, pursuant to RCW 35.21.775; and
WHEREAS, RCW 35.21.775 provides that the Agency on behalf of the State
shall contract with cities and towns for fire protection services for
State facilities located in cities and towns; and
WHEREAS, the Agency has adopted WAC 365-80 which provides the criteria
for such contracts; and
WHEREAS, the Agency has been appropriated $419,000 for the 1984 fiscal
year to be expended and distributed to eligible cities as payment for
_fire protection services to State-owned facilities located within the
territorial limits of such cities and towns.
NOW, THEREFORE, the Agency and the City agrcc as follows:
1. The Agency agrees to pay the apportioned amount of $4436.00
to the city within thirty days after receipt of payment request
for services from July 1, 1983 to June 30, 1984. Thereafter,
amounts to be paid shall be calculated pursuant to this contract,
and RCW 35.21.775 (and regulations adopted pursuant thereto). The
City agrees to accept this amount, and the amounts so calculated,
as payment for basic fire protection services; provided
supplemental agreements as authorized in RCW 35.21.777 may be
negotiated.

2. The City agrees to provide continuous fire protection services to
State personnel and properties that are located within the City's
corporate territorial boundaries to the extent that manpower and
equipment are available, as determined by the Fire Chief.
3. State personnel will cooperate with the City to assure the
effectiveness of the City's fire protection services, as described
hereinabove, and to facilitate increasingly high quality service.
4. This contract shall be effective when executed and shall continue
in effect until. terminated by one of the parties or by the State
Legislature's determination not to fund its continuation.
5. Either party may terminate this Agreement by providing written
notice to the other party ninety (90) days prior to the effective
date of termination.' A termination date may be declared effective
thirty (30) days after notice in the event the City fails to serve
as agreed herein, or the Agency fails to pay in accordance with
this Agreement. In the event this Agreement is terminated prior to
its full term, the City shall not claim additional consideration
for services after the effective termination date except and unless
another contract is agreed upon. In the event of termination, the
Agency may request and the City shall make a refund of the portion
of the funds paid proportional to the portion of the contract
period remaining after the effective termination date.
6. The Agency has identified the sum of $419,000 as the total
appropriation available to fund fire protection contracts with
cities during this contract period. Pursuant to WAC 365-80 the
Agency shall disburse to the City a portion of the $419,000 equal
to the City's percentage share of all State-owned building square
footages within all cities statewide as identified in schedule A
which by this reference is made a part of the Agreement and is
agreed to accurately state the square footage figures, including
estimated levels of construction, from which contract payments are
to he calculated. These figures shall be determined annually by
the Agency pursuant to the provisions of WAC 365-80. No
corrections for additional state facilities will be made in the
schedule'of payrents shown on schedule A during the current fiscal
year.
7. Payments made to the City under this contract shall be basic fire
protection payments. In those cases where separate contracts for
additional fire protection funding are negotiated between the City
and another. State agency or agencies, it shall be the
responsibility of the City to notify such other State agencies of
payments received under this contract, and to provide the
appropriate credit or offset to such State agency in order that no
duplication or over payment shall occur.

8. Assignment of duties to provide fire protection services to the
State by the City in performance of this Agreement is permissible.
9. The City shall comply with all regulations and laws governing
discrimination, and shall not discriminate on any basis of race,
sex, age, religion, national origin, or physical disability.
10. Delay or failure of the City or the Agency to exercise any right
hereunder, including any partial or single exercise of any right,
shall not be deemed a waiver of such right or any right hereunder.
11. The parties expressly reserve for themselves the right to amend
this agreement.
12. In the event any term or condition of the Agreement or application
thereof to any person,or circumstance is held invalid, such
invalidity shall not affect other terms, conditions or applications
of this Agreement which can be given effect without the invalid
term, condition or application. To this end the terms and
conditions of this Agreement are declared severable.
13. This Agreerent shall be construed and enforced in accordance with,
and the validity and performance hereof shall be governed by, the
laws of the State of Washington.
IN WITNESS WHEREOF, this agreement has been executed by and on behalf of
the parties hereto, in full force and effect for the term established by
Section 4 hereinabove.

A RESOLUTION authorizing the execution of an agreement with the
State of Washington, Planning and Community Affairs
Agency, for fire protection services to State
facilities.
WHEREAS, the City of Yakima furnishes fire protection services
to property and facilities owned by the State of Washington, within
the City of Yakima corporate limits, for which services the State
will reimburse the City as provided by the attached agreement docu-
ment, and
WHEREAS, the City Council of the City of Yakima deems it to be
in the best interests of the City that the attached agreement docu-
ment be executed by the City in order that such reimbursement may
be made, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and City Clerk of the City of Yakima are
hereby authorized and directed to execute an agreement with the
State of Washington, Planning and Community Affairs Agency, for
the purpose mentioned above, a copy of which agreement, entitled
"Fire Protection Contract For State -Owned Facilities In City
Boundaries' (Contract No. FP -8483), is attached hereto and by
reference made a part hereof.
