RESOLUTION NOD 5 8 8 1
A RESOLUTION authorizing the execution of a contract for
public works with Humphrey Construction, Inc. for
the 1990 Wastewater Facilities Project upon
certain conditions.
WHEREAS, the City of Yakima desires to improve its Waste-
water treatment facility by expanding its laboratory facili-
ties and making other plant modifications for the purpose of
improving hydraulic capacity and meeting National Pollutant
Discharge Elimination System Waste Discharge Permit condi-
tions, and
WHEREAS, the City of Yakima has advertised for bids for
the performance of such public works which bids were opened on
Januar\ 17, 1991; and
WHEREAS, Humphrey Construction, Inc., a Washington corpo-
ration, was the apparent low bidder in the aforementioned bid
proress with a total bid, including tax, of ten million, seven
hundred thirteen thousand, one hundred sixty-four dollars and
no cents (510,713,164.00); and
WHEREAS, the aforementioned bid by Humphrey Construction,
Inc. has been the subject of a bid protest which protest may
require review by the Federal Environmental Protection Agency
and the State Department of Ecology as a condition of granting
monies to partially fund the aforementioned project, now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and City Clerk are hereby authorized and
directed to execute a contract with Humphrey Construction,
Inc. for the 1990 Wastewater Facilities Project according to
the terms and conditions of the aforementioned bid process and
in the amount of ten million, seven hundred thirteen thousand,
one hundred sixty-four dollars and no cents ($10,713,164.00)
total price, including tax. Execution of such contract shall

be subject to the concurrence of the Federal Environmental
Protection Agency and the State Department of Ecology and the
completion of any legal or administrative appeals.
