A RESOLUTION authorizing the City Manager to execute a month-
to-month lease with Antonio and Florentina
Benitez to certain property located at 802 North
Second Street in the City of Yakima, Washington.
WHEREAS, the City of Yakima owns the premises located at
802 North Second Street in the City of Yakima and it was
initially conveyed to Denise Olson and John Gates on June 24,
1986 pursuant to the Federal Urban Home Rehabilitation Loan
Program; and
WHEREAS, in early 1989 Ms. Olson appears to have aban-
doned the property and Mr. Gates conveyed his interest in the
property back to the City; and
WHEREAS, Antonio and Florentina Benitez desire to assume
the original homestead obligation; and
WHEREAS, the Department of Housing and Urban Development
is currently reviewing the assumption and this process is
411 anticipated to take two or three months, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and the City Clerk are hereby authorized
and directed to execute the attached and incorporated lease to
the property located at 802 North Second Street here in the
City of Yakima, Washington.

LEASE AGREEMENT
This lease dated the 1st day of April, 1991, is made and
entered into between the City of Yakima as Landlord and Antonio
Benitez and Florentina Benitez, husband and wife, as Tenants.
1. In consideration of the covenants and agreements contained in
this document, the Landlord does hereby lease to Tenant those
certain premises situated at 802 North Second Street, Yakima,
Yakima County, Washington, particularly described as follows:
The Lot 1 and the south five feet of
Lot 2, Block 22, Town of North Yaki-
ma, now Yakima, according to the
official plat thereof, recorded on
Volume "A" of Plats, Page 10, and
rerecorded in Volume "E" of Plats,
Page 2, records of Yakima County,
Washington.
For a term of one month commencing on the 1st day of April,
1990 and upon the following terms and conditions.
2. OCCUPANCY. The occupancy created by this agreement shall
consist of 2 adults and 6 children. Tenant shall notify
Landlord in the event the occupancy increases beyond the
numbers written in this section. The premises shall not be
used other than a residence for 8 persons.
3. MONTH-TO-MONTH TENANCY. The tenancy created by this agreement
shall be a month-to-month tenancy.
4. RENT. Rent shall be $267.43 per month which figure includes a
leasehold tax of $30.43. Rent shall be due on or before the
10th day of the month and payable to the City Treasurer, City
Hall, 129 North Second Street, Yakima, Washington. A late
charge equal to ten percent (10%) of the monthly rent shall be
due and payable if the rent is not received by the City Trea-
surer on or before the due date.
5. SECURITY DEPOSIT. Landlord hereby acknowledges receipt of
$100.00 as a security deposit. Landlord shall deposit such
security deposit in a trust account with Security Pacific Bank
of Washington, 202 East Yakima Avenue, Yakima, Washington,
98901.
All or a portion of such deposit may be retained by Landlord
and refund of all or any portion of such deposit is condi-
tioned as follows:

A. Tenant shall remedy or repair any damage to the
premises which occurs during his tenancy;
B. Tenant shall restore the premises in such condition
so that only normal cleaning and not heavy cleaning
is required;
C. Tenant shall surrender to Landlord all keys fur-
nished at the initiation of the tenancy;
D. Tenant shall pay the last month's rent;
E. Tenant shall pay all utility bills assessed against
the premises during the period of tenancy created by
this agreement.
6. ADDITIONAL DUTIES. Tenant shall mow and trim the lawn area
and trim the shrubs and bushes as needed during the growing
season in the area immediately surrounding the building and
outbuildings.
7. ASSIGNMENT. Tenant shall not assign or sublease all or any
portion of the premises without the prior written consent of
the Landlord.
8. UTILITIES. In addition to the rent charged herein, Tenant
shall pay all utilities charged against premises.
9. ALTERATIONS. Tenant shall not paint or make any alterations
to the premises without the prior written consent of the
Landlord.
10. TENANT'S DUTIES. Tenant's duties shall be
RCW 59.18.130 and as hereafter amended.

12. LANDLORD'S AGENT. For the purpose of repair and maintenance
of the premises, Landlord's agent is City of Yakima Office of
Housing and Neighborhood Conservation and may be contacted at
112 South 8th Street, Yakima, Washington, (509)575-6101.
13. PUBLIC REGULATIONS. Tenant shall conform to all applicable
provisions of municipal, county, or state codes, statutes,
ordinances, and regulations pertaining to use, occupation, or
maintenance of the premises.
14. LANDLORD'S RIGHT TO ENTRY. The Landlord shall have the right
of entry to premises as prescribed in RCW 59.18.150 and as
hereafter amended.
15. TENANT'S INSPECTION. Tenant acknowledges that he or she has
thoroughly inspected the premises in detail prior to signing

this agreement and finds the said premises clean, safe, in
good repair, and free of any infestation of rodents, pests, or
insects.
THE CITY URGES ALL TENANTS TO OBTAIN INSURANCE ON PERSONAL
PROPERTY. YOU ARE NOT COVERED BY THE CITY'S INSURANCE FOR ANY
LOSSES OF PERSONAL PROPERTY.
