A RESOLUTION authorizing the Mayor to execute four Quit Claim
Deeds for certain property located in the vicini-
ty of Rainier Place in Union Gap, Washington.
WHEREAS, in 1912, the City of North Yakima entered into
an agreement with the New Schanno Ditch Company wherein the
City agreed to procure necessary rights of way for the New
Schanno Ditch in return for the right to empty surface waters
from the West Side Drain into said ditch; and
WHEREAS, in 1912, P.A. Bounds and Ella Bounds, Husband
and Wife, conveyed to the City of North Yakima a certain 10
foot wide strip of land adjoining Rainier Place for drainage
and irrigation purposes; and
WHEREAS, the owners of land adjoining the City's 10 foot
right-of-way have requested that the City sell and convey this
right-of-way to them, retaining an easement for drainage and
irrigation purposes; and
WHEREAS, fee title to this strip of land is not needed by
the City of Yakima so long as the City retains an easement
therein and is therefor surplus to the City needs; and
WHEREAS, the City of Yakima and adjoining land owners
have reached an agreement whereby the City will convey its
interest to adjoining land owners in return for the values set
forth below, retaining an easement in said property for
drainage and irrigation purposes, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The Mayor and City Clerk are hereby authorized to execute
the attached and incorporated Quit Claim Deeds and it is
further resolved that the City Attorney deliver the Quit Claim

Deeds to the respective land owners upon receipt of the
amounts set forth below:
Amikay Development Company $7,158.60
Jack H. Barker and Shirley L.
Barker, Husband and Wife $2,650.10
Yakima Bowling Center, Inc. $ 250.00
First Interstate Bank $1,500.00
This resolution shall expire one year after its adoption.

THE GRANTOR, CITY OF YAKIMA, a Washington corporation, for and
in consideration of ONE THOUSAND FIVE HUNDRED DOLLARS ($1,500.00),
the receipt of which is hereby acknowledged, conveys and quit
claims to FIRST INTERSTATE BANK, as Trustee for W. H. LINDBERG and
ISABEL P. LINDBERG, GRANTEE, all right, title and interest in the
following described real estate, situated in the County of Yakima,
State of Washington, together with all after-acquired title of the
GRANTOR therein:
Commencing at the Southwest Corner of the
Northwest Quarter of the Southeast Quarter of
Section 32, Township 13 North, Range 19,
E.W.M., thence East along the South line of the
Northwest Quarter of the Southeast Quarter of
said section a distance of 150 feet; thence
North a distance of 10 feet; thence West paral-
lel with the South line of the Northwest Quar-
ter of the Southeast Quarter of said section a
distance of 150 feet; thence South a distance
of 10 feet to the point of beginning.
RESERVING unto the GRANTOR a perpetual, non-
exclusive easement over, across and under the
entire area of the above-described strip of
land for drainage and irrigation purposes,
including the construction, operation, and
maintenance of the canals, ditches, and pipe-
lines now known as the New Schanno Ditch,
together with the right of ingress and egress
for said purposes.
