Councilmen present at the meeting were'Mayor Bert Broad, Lenore.Lambert,_James'Lust,. Wal- 1 •ter Robinson, Don Schussler and. Bill' Whitaker. Also present were City Manager.Craig.Mc- Micken, City "Attorney Fred Andrews Director of Planning and -Community Development Jay Otto, Public Works Director•Dave Vargas and Administrative Assistant Jim Williams. The Council reviewed and discussed West Chestnut.Annexation election results. Director of - Planning and Community.Development Jay Otto presented a breakdown ,of precinct trends and other itemized results. - . Attorney :Fared Velikanje made an appearance to discuss prepared plans for landscaping the Englewood :Reservoir site. A discussion ensued regarding the wishes of his client, Mrs. Plath. Public Works Director Dave Vargas explained the.engineering restrictions which limit what can be done at the*site. A future meeting was agreed to. REGULAR MEETING - - MAY 22, 1972. - " 3:00 O'.CLOCK P.M.. The City Council then met in regular session at the hour 'of 3:00 P.M., Mayor Broad presiding, Councilmen Lambert, Lust, Robinson,'Schussler and Whitaker, City Manager McMicken and City Attorney`Andrews present on roll call. Councilman.Brown absent on roll call been excused at .a previous meeting. , The Invocation was given by City Manager McMicken. . The minutes of the regular meeting'of May 15, 1972, having been duly certified accurate by two Councilmen and no one present wishing to have said minutes.read publ Broad declared said minutes approved as recorded. . This being the time fixed for.the continuation of a Hearing Improvement and Widening of . North 40th Avenue between Lincoln and :Englewood Avenues,'. Public Works Dave Vargas. reported that 'in response requests by the Council at the previous meeting of May 1972, his staff has, revised the plans by .tightening the curves and narrowing the .street in order to save more trees,on the west side of 40th Avenue. Mr. Vargas stated'that the. re vised'plans.include maximum separation from the .nursing home, keeping sidewalks se- parated4from moving traffic, and also a in reversing curve, similar to one on South 24th Avenue. He further stated that with a 3Q M.P.H. speed limit on this portion -of 40th 'Avenue, these could be satisfactory.. Mr..Vargas pointed out,.that in regards to Mrs. Plath's property, they have jogged the sidewalk at the south end Of the tennis courts to . get behind•the •trees and narrowed the roadway from Richey Road to about the middle of the tennis Courts to 48 feet instead of the 56 feet which had been eliminating the . center turn lane 'He indicated,that.this lane could be dispensed with .in this particular section, because though there are some private driveways on the .west side of the street, it is not a commercial area. Mr. Vargas explained that there have been additional requests from Mrs. Wesley Haas and Mrs. Nedra Callard to eliminate the widening south of Lincoln in order to save their front yards, but that because of engineering 'restrictions, there is no • . alternative to doing this. He further indicated that in the revised plans they have swung away. from the outside of Mr, Chisum's residence to keep away from the hedge. - Mr. Vargas reported that the city needs'`.more than 70 feet, of right of way, and they could accomplish that through easements for the sidewalk or additional right of way purchase. Discussion indicated that when a tree is taken out on private property, the city's policy is to re- 111 imburse the property owner for the tree. He indicated .that the plans include a five foot... planter between the ,sidewalk and the street, except by the rock retaining wall on Mrs. Plath's property.. Mr.' Herb Advocaat, property owner in the vicinity of the proposed. im- provement, suggested that since so much of the property is going. to be taken for the pro - ject,.that the City should buy the complete. property. He indicated that he is in favor of the new plan. 11±1% Advocaat requested that the City Council join with the citizens in pro- posing jointly to'the city and county that no new roads or. driveways be allowed access to 40th Avenue. He stated that he thinks this would be helpful in maintaining the residential • quality of the area,.and could be prohibitive to shopping centers and other businesses. City Manager McMicken stated that the Council could state a desire in that regard, but it is a:legal question and most of city properties are acquired without restriction. He further stated that th'e City would have to pay for.'these restrictions. . Mr. McMi.cken sug- gested that by planning; the City could have an interior road design system,. whereby the . access would rear the street instead of,facing. it. .•Mr. Advocaat stated that the primary concern is the development of the area north. of Englewood. Councilman Lust suggested that all the Council can do is reaffirm the policy of the Council. in the past. Discussion indicated that the Council should back the citizens of the area in pressing the County to put some teeth in their zoning and 'help in the development .of 40th Avenue. Mr. Floyd Lewis, indicated his favor of the revised plan., but requested that there be some consider- ation for a fire plug across the street from the nursing home on 40th Avenue. City Manager McMicken re_ported.that the Utilities Fund would finance a fire plug and that he is inten- ding to talk to the Fire.Chief about this. matter. Councilman Lust questioned the sug- . .gestion that the sidewalk'could go the. trees. Mr. Vargas explained that where a tree is close to sidewalk, the sidewalk can be narrowed. and go around the tree on • both sides. Councilman Lambert asked how close to Mrs. Callard's house the edge of the ' sidewalk would be. Dave Vargas. explained that the original. proposal was to buy 20 feet .of her property, but that`we.could buy 17 or 18 feet (12 feet. for roadway, 5 feet for sidewalk and 1 foot for curb). He indicated 'that this would save most of her trees. Mayor Broad asked what the financial implications would be on the purchase of the whole property as compared to the damages the City would pay otherwise. . Mr. explained that the City . would have to sell. the. property not used and that this was not favorable, that we prefer • to let the property owner make the sale. Councilman Lambert indicated that the Council could approve the revised plan for improvements. and widening and look into the cost of purchasing the complete parcel. Councilman Robinson asked how much of Mr. Chisum's pro- perty would be acquired, and'Mr..Vargas reported that approximately 5 feet would be- needed. He further reported that the traffic engineer actually proposes that the City acquire enough property so in the future we would have the required right of way width put :370 MAY 22, 1972 in a fifth lane. Councilman Robinson indicated that.he is apprehensive about acquiring more property than the present project requires. Mr. Herb Chisum asked about the street • lighting, and Mr. Vargas explained that lighting is part of the over all budget and would be worked in the final stages of development. Delores Plath asked if there is some pro- vision for irrigation on the south side of 40th Avenue, and Mr. Vargas explained that ir- rigation is planned as part of the project. After due discus,sion, it was MOVED by Robin- son, seconded by Lambert that the plan for improving and widening 40th Avenue between Lin- coln and Englewood Avenues be approved_ as presented, including for sidewalks around trees: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Brown absent. Public Works Director.Dave Vargas explained that he would d•be getting some actual dollar figures for Mrs. Callard's property. • Petition No. 743, having•been filed with the City Clerk on May 18, 1972, by.Max Vincent and Others requesting improvement of property by the paving of an alley, . "C" Street to "D" Street, between 1st and 2nd Streets, it was MOVED by Schussler, seconded by Whitaker that said petition be referred to the City Manager and Staff for study and recommendation: car- ried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye.by voice vote. Brown absent. A Damage Claim having been filed with the City Clerk on May 16, 1972, by Gene A. Brown, 609 South 20th Avenue, in the amount of $32.58 for unnecessary towing charges, it was MOVED by Lust, seconded by Whitaker that said damage claim be referred to the.City Manager and Staff for study and recommendation: carried, Broad, Lambert, Lust, Robinson, Schussler, and Whitaker voting aye by voice vote. Brown absent. Mayor Broad then called for audience participation. Mr. Steve. Hill, representing the Yakima Referral Center, brought to the Council's attention -that May 24, 1972, ayouth telephone line called "Open•Line" would be set up at the Open Door, 16 North 7th Street, in order to offer immediate assistance to adolescents seeking help. He stated that the service will operate from 6 P.M. to 12 Midnight Sunday through Thursday and from 6 P.M. to 2 A.M. Friday and Saturday. Mr. Hill explained that the line, while operating on a confidential level, will accept all calls from youth as well as non-youth, Thelp the. caller identify his problem and explore the various options for help, and if unable to solve the situation refer the caller to an agency which can help. He indicated that the line will consist of.three phones with two incoming lines, also, that the staff would include 45 trained volunteers and 10 professionsals for advisors. Mayor Broad questioned the traning of staff,. and Mr.. Hill pointed out .that in addition to the introductory sessions for new staff, regular trai- ning meetings will be held once a month for all workers. Councilman Whitaker asked how people who need this assistance get it, and Mr. Hill reported that publicity has started on the radio,° and business cards will be distributed to the youth. Councilman Lust reported that this concept has .been studied and brought before the Yakima County Mental Retardation /. Mental Health Administrative .Board, who have approved the concept and authorized Mr. Hill to go ahead with his plans. He further reported that the County..Commissioners have also approved of this concept, and although this program is in the beginning stages they -are pretty optimistic _ about it. • Mr. Patrick Nagle, representing the Housing and Renewal Advisory Committee, presented a recommendation for initiation of a Housing Code Compliance Program. Referring to the summary of a study of housing conditions by the Planning Department, Mr. Nagle reported that there, are a total of approximately 790 seriously substandard structures in East Yakima, and these structures contain some 3,020 persons. He stated that problems that.develop when areas are allowed to deteriorate are 45% of the major crimes, 55% of the juvenile delinquency, 50% of the arrests, 60% of the TB victims, 50% of other diseases. and 35% of the fires. Mr. Nagle pointed out that blighted areas in our cities. account for 45% of total city service costs and they return only 6% of the real estate tax revenues. He indicated that this si- - tuation must be improved as,rapidly as possible both for the benefit of the people involved, and the community as a whole, and that this program could be the community's response to • the housing needs of all of its citizens. Mr. Nagle stated that the goal of a housing program would be the achievement'of maximum impact on substandard housing with minimum hardship to_tenants and owners. He explained that the benefits. of a housing program would be (1) a step towards providing greater community health and well being, (.2) result in community having higher property values, and (3) unless we do get involved, the City is not going to be.eligible for the bulk of the federal programs that are needed for.better housing. Mr.. Nagle reported that the Housing and Renewal. Advisory Committee recommends (1). that the City Council approve transfer of $25,000 from the contingency fund to the Department of Planning and Community Development, Inspections 'Division, for the purposes. of employing • two Housing Services Officers and initiating a• Housing Code Compliance Program, (2). that the City Council approve the employment of two Housing Services Officers, and the purchase of an automobile and other supplies and equipment as required for execution of Housing Code Compliance activities, (3) that the Mayor appoint a Housing.Advisory and Appeals Board as required by the City's Housing Code; and to include one.low- income person and one member knowledgeable in public health matters, and (4) that the job requirements and•specifica- tions for Housing Services. Officers be very carefully considered and drawn. Councilman Schussler related to a letter he received earlier in this day that indicated that the federal government now has an interest in low income housing built outside the areas such as southeast Yakima, which is contrary to this proposed program. Mr. Nagle replied that the Committee is hopeful that the Housing. and Urban Development people can be convinced. that perhaps Yakima is an unique situation. •Associate Planner Chief Housing and Renewal,• Homer Matson commented on the letter, explaining that the City of Yakima has. two considera- tions with HUD in Southeast Yakima (1) they will limit. the amount of housing in Southeast • Yakima, because of the racial situation, and (2) as of the moment, they are not permitting any construction in Southeast Yakima. . Mr. Matson further explained that the proposed housing program is just an outline of alternatives and possibilities, and that the Housing and Renewal Committee are reviewing it and will.refine•and bring• it back to the Council at a later date. He indicated that the Committee and Staff are planning on starting with vacant housing. After further discussion, it was MOVED by Lambert, seconded by Whitaker that the recommendations of the Housing and Renewal Advisory Committee be accepted inclu- ding all four points, and that necessary legislation be prepared to initiate a Housing Code Compliance Program: carried, Broad, Lambert, Lust, Robinson, Schussler. and Whitaker voting aye by voice vote. Brown absent. • Miss Pat. Carrol representing Yakima Youth Advisory•Commission, gave a report re Summer Youth Employment Program and requested the City Council to endoml.e the program and to give individual assistance and cooperation. After due discussion, it was MOVED by Whitaker, seconded.by Schussler that the Council go on record as approving the Summer Youth Employ- ment Program and pledging their support: carried, Broad, Lambert, -Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Brown absent. • 371 MAY 22, 1972 .. . Mr. Donn Rothe, 'standing in for Mrs. Stuart Semon,.President of the Allied Arts Council of the-Yakima Valley, proposed to the City Council a plan'wiereby public buildings now under construction and those to.be built,inthe.future could have an allocation of funds for purchase and display of art in them. He indicated that this is - not a new idea, that several major cities in the United States have adopted this plan, and that these cities specify tha a certain part of the budgeted funds for public .buildings be set aside for this purpose. He further indicated that a percentage of the total budget is taken from the budget in some cases, and in others is considered an additional part of the budget and added to it. Mr.. Rothe reported that the executive the Council at its. meeting on May 8, voted to ask the City for the adoption of an ordinance providing that two percent of the budget for any public building be earmarked for the purchase and display of art. Council - man Lambert indicated that. it is not a very good idea to earmark two percent of the budget to pay for this, although she does endorse this project. Council members concurred with he. Mr. Phil Kooser, being present, stated that he is personally opposed to the legislative part of the proposal. D- 1862,'A RESOLUTION authorizing the grant of an easement to the Old Union Irrigation Canal Company. . • City Manager McMicken explained that the City of Yakima'has a claim for damages against Slurry of Southwest'Washington for breach of contract for resurfacing various streets within the City, and that the law firm of Felthous; Brachtenbach, Peters & Schmalz have commenced a similar action against this company on behalf of the Town of Selah, and have . offered to represent the City of Yakima in its claim. After due discussion, it was MOVED by Robinson, seconded by Schussler.that Resolution No. D -1863 engaging'Felthous, Brachten- bach, Peters & Schmalz for legal services in with a claim by the City of Yakima against Slurry Seal of'Southwest Washington, be passed as read: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. Brown absent. • RESOLUTION NO. D- 1863, A RESOLUTION engaging Felthous, Brachtenbach, Peters & Schmalz, ' attorneys at law, for legal services in connection with a claim by the City of Yakima against Slurry Seal of Wouthwest Washington. • City Manager McMicken reported that the City of Yakima.previously vacated a portion of Walnut Street between Chisholm Trail and Bel Air Drive, and in connection with such street vacation the City retained a public utility easement over and across the vacated street. He further reported.that the owner of property abutting said public utility easement has requested the vacation of a_portion of said easement to accommodate the construction of a.dwelling on his property. The City Council indicating that•it would not be detrimental to the City to grant such request, it was MOVED.by Robinson, seconded by'Lambert that Re- solution No. D -1864 vacating a portion of apublic utility easement within vacated Walnut Street near Bel Air Drive, be passed as read: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. RESOLUTION.NO: D -1864, A RESOLUTION vacating a portion of a public utility easement within • vacated Walnut Street near Bel Air Drive in the City of Yakima. • City Manager McMicken referred the matter of airport agreements to City Attorney Andrews who explained that for the past 20 years the Federal Government has had a direct landlord- tenant relationship with John W. and Thelma L. Fenstermacher and John F. Chesterley for airport traffic control and navigational facilities, and that the.existing agreements are about to expire. Attorney further explained that the Federal Government now wants the City of Yakima to be involved in such agreements, and that under these conditions the City will be leasing the property from these people and then will subsequently sublease the property to the Federal Government. After due discussion, it was MOVED by Robinson, seconded by Lust that Resolution No. D -1865 authorizing the execution of lease agreements with John W. and Thelma L. Fenstermacher and John F. Chesterley for airport purposes, be passed as read: carried, Broad, Lambert,•Lust,. Robinson, Schussler and Whitaker voting aye on roll call. Brown absent. RESOLUTION NO. D -1865, A RESOLUTION authorizing and directing the City•Manager and City Clerk of the City of Yakima to execute lease agreements with John W.. Fenstermacher and Thelma L. Fenstermacher, husband and wife, and with John F. Chesterley for airport purposes. City Manager McMicken explaining that another Resolution has been 'prepared to authorize subleasing property the Federal. Government, was MOVED by Robinson, seconded by Lam- bert that Resolution No. D -1866 authorizing the execution 'of lease agreements with the United States of America for Airport traffic control and navigational facilities, be passed as read: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. RESOLUTION NO.-D-1866, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute lease agreements with the United States of America for airport purposes. • City Manager McMicken explained that it is necessary for the Fire Department to purchase protective clothing consisting of turnout' coats, bunker trousers, helmets and liners. He further explained that because of the time factor involved it is necessary to purchase said clothing without calling for bids. After due discussion, it was MOVED by Lambert, seconded by Robinson that Resolution No. D -1867 authorizing the purchase of fire clothing without calling for bids, be passed as read: carried, Broad,Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. D -1867, A RESOLUTION authorizing the purchase of protective clothing for the Fire Department without calling for bids. • Garage City Manager McMicken requesting approval of out -of -State travel for „George Davis, /Superin- tendent and Dale Samuelson, Garbage Superintendent, to travel to'Portland,' Oregon, May 16, 1972,. to check on truck chassis for refuse packers, and for Wayne Dean, Park Shop, to travel to Hayden Lake, Idaho, to attend a meeting of the Inland Empire Golf Course Superin- tendent Association on June 12,' 1972, it was MOVED by'Lambert, seconded by Schussler that said' out -of- State travel be approved including expenses: carried, Broad, Lambert, Lust, Robinson,' Schussler and Whitaker'voting aye by voice vote. Brown absent. City Manager McMicken reported on funding of the Southeast Yakima. Community Center's Rec- reation Program and explained that while the.City has considered the program, they have•not •clarified formally their recommendation for funding of the program this year. Councilman Whitaker questioned whether or not this matter should be discussed further. Councilman Lambert indicated that the Council should give the same consideration for this program as they do any carried out with parks next to schools.. She further indicated that the Council should consider this at budget time next year. After further discussion, it wass MOVED-by Robinson, seconded by Lust that the Mayor submit a letter to the Southeast Yakima Community Center explaining that the City has a sympathetic interest in the Recrea- tion Program, but .do not see how .they can fund it at this time and will pursue the matter further: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Brown absent. 373 MAY '22, 1972 City Manager .McMicken. reported on request by the Visitor's and Convention Bureau for funding of promotional programs, and suggested that the City have a contractual relation- ship with the Visitor's and. Convention Bureau, whereby the City will reimburse them for expenses providing that they do not exceed a certain amount.- After due discussion, it was MOVED by Schussler, seconded by Robinson that an appropriate form of an agreement be drafted by the City.
