HomeMy WebLinkAbout05/08/1972 Special Meeting / Regular Meeting �� 2 MAY 8, 1972 MINUTES OF SPECIAL MEETING YAKIMA CITY COUNCIL MAY 8, 1972 The City Council met in special session pursuant to due notice, at 1:30 P.M., May 8, 1972, in the Conference Room at Yakima City Hall. . Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, James Lust, Walter Robinson, Don Schussler and Bill Whitaker. Also present were City Manager Craig McMicken, City Attorney Fred Andrews, Director of Planning and'Community Development Jay Otto and Administrative .Assistant Jim Williams. • The Council discussed a Chamber of Commerce request for assistance in transporting the Yakima float to various cities for parades during the year. The City will assist in transporting the float. City Manager McMicken and Director of Planning and Community Development Jay Otto led a discussion relative to long range Civic Center planning. The special meeting adjourned at 3:00 P.M. REGULAR MEETING - MAY 8, 1972 - 3:00 O'CLOCK P.M. The City Council then met in regular session at the hour of 3:00 P.M., Mayor Broad presi- ding, Councilmen Brown, Lust, Robinson, Schussler and Whitaker, City Manager McMicken and City Attorney Andrews present on roll call. It was MOVED by Robinson, seconded by Brown that Councilman Lambert be excused from this meeting:. carried, Broad, Brown, Lust, Robin- son, Schussler and Whitaker voting aye by voice vote. The Invocation was given by Councilman Brown. The minutes of the regular meeting of May 1, 1972, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as read. This being the time fixed for a Hearing on Resolution of Intention No. D -1848, to improve property by the construction of a sewer in the vicinity of South 1st Street and Mead Ave- nue, it was MOVED by Brown, seconded by Robinson that an Ordinance creating an L.I.D., South 1st Street and Mead Avenue Sanitary Sewer District, be passed as read. Mrs. Harriet Mugaas, a property owner on the north side of Russell Lane and adjacent to Forney Fruit and Produce Co., protested this improvement because her property is a long, narrow strip with no buildings on it. She explained that it is not saleable and the engineer's indi- cated that her estimated cost would be $619. Mrs. Mugaas together with Mr. Cornelius, who lives on the same side of the street, protested the fact that they were included in the district and those people across the street or on the south side of Russell Lane were being excluded from the district under this improvement. Public Works Director Dave Var- gas explained that those people on *the south side of the street would have to pay at the same rate as those included in the dstrict: should they in the future wish to hook up to this sewer.` He further explained that Mrs. Mugaas' and Mr. Cornelius' property are being assessed for only half of the area Mr. Gerald Weimer speaking for both himself and his father protested being included in this district, expressing the same feeling that if the people on the south side could be excluded, the Weimer property should be excluded. Dis- cussion indicated that this sewer line is mainly for the benefit of Burlington Northern Railroad, Stores, Inc., Hansen Fruit and Cold Storage Co., Forney Fruit and Pro- duce Co. and other businesses in the area. Discussion also indicated that the total cost . of the project is approximately $38,000; of this amount some $28,500 would be paid by the property owners and the additional would be picked up by the City. Public Works Director Dave Vargas indicated that there may be some money coming from "Jobs Now ", which will be used in financing the project. It was also indicated that the only other property that would be excluded would be some railroad property which would have to be crossed to serve the area. Council members suggested the possibility of either the Utilities Fund picking up the additional assessments of small property owners until such time as those people hook up to the sewer line, or that the businesses desiring the sewer paying for it and being reimbursed at such time as the property owners hook up to it. City,Manager McMicken indicated that the City has previously carried out projects on an individual basis whereby the individual paid for an L.I.D, and was reimbursed at a later date, but that it had not been done on a group basis before. After due discussion, it was MOVED by Robinson, se- conded by Brown that this matter be continued for one week or until May 15, 1972, in order for the staff to analyze the policy of the City and what can be anticipated in the future in the utilities situation: carried, Broad, Brown, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Lambert absent. City Manager McMicken reported to the Council as a matter of information that a petition signed by 312 persons, requesting abandonment of any proposed widening of Englewood Avenue and proposed widening or extension of North 40th Avenue, was filed with the Planning Com- mission,on May 2, 1972. He further reported that said petition, being Petition No. 742, had been filed by the Planning Commission with the City Clerk on May 3, 1972. Mr. Mc- Micken stated that a hearing is being held on this matter at the regular City Council meeting of May 15, 1972. No formal action was taken. A Damage Claim having been filed with the City Clerk on May 4, 1972, by Jay Dee Akers in the amount of $28 for damages to his automobile caused by a loose manhole cover, it was MOVED by Schussler, seconded by Whitaker that said damage claim be referred to the City Manager and Staff for study and recommendation: carried, Broad, Brown, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Lambert absent. Mayor Broad explaining that Patrick Nagle, Chairman of the Housing and Renewal Advisory Committee was unable to attend this meeting and has asked that his presentation of a re- commendation for initiation of a Housing Code Compliance Program be continued for two weeks, it was MOVED by Schussler, seconded by Whitaker that this report be continued until May 22, 1972: carried, Broad, Brown, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Lambert absent. - Miss Mary Carroll, Chairman of the Youth Advisory Commission gave a report regarding the results of a recent youth survey conducted. Miss Carroll reported that the Commission has a new slate of officers and hope to come up with some new programs. • . 36 1 MAY 8, 1972 . • City Manager McMicken reported as a'matter of Council information that the City has re- ceived as of April 10, 1972 from the Department of Social and Health Services a letter which reports that each municipality is 'required to state its intentions to conduct an alcoholic rehabilitation program. He further reported that Senate Bill '298 provides for partial funding of these programs and requires that 2% of tax'dispersement be put into that program, Mr: McMicken explained that the City is 'already doing this on a voluntary basis through the Sundown "M" Ranch alcoholism treatment center for men. He stated that our response to the Department of Social- and'Health Services would be in compliance with the new law relating to a County -wide alcoholism program. No formal action was taken. City Manager McMicken referred to his report #149 Additional Bus Service, which.concerns Sunday and evening bus service and an exact fare program.' Transit Manager 'Bob Knight ex- plained the exact fare program, stating that when passengers board a bus without the cor- rect change, they are given.a. ticket that has two parts. He further stated that they are . asked to put their name on one -half which is inserted into a slot on the fare box by the • driver, and they keep the.other half which tells them to "please return this portion the ticket with an extra fare the next time they ride..' Mr. Knight explained that the new fare boxes will be the locked type, which all transit companies are now using. Mr. Knight reported that in response to the Council's requests, additional study has been made on the possibility of Sunday and evening bus service. He further that Sunday and night • - service would only prove to be a financial burden on the majority of our population, and that Sunday and evening operation is in effect in Everett and operating at 'a loss. After due discussion, it was MOVED by Schussler, seconded by Robinson that the exact fare pro - gram be approved and that Sunday and evening service not be extended:'carried, Broad, Brown, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Lambert absent. City Manager McMicken. referred the matter of preliminary .design for Lions outdoor swim pool and Eisenhower swim pool to Parks and Recreation Director Bill Hutsinpiller. Mr. Hutsinpiller stated that the plans had been reviewed in detail at the City Council meeting of April.24, 1972, but. that the cost estimates had not been. reviewed. Mr. Don Grugel re- presenting ORB architectural firm, reviewed the two site areas and the reasons for them. Mr. Hutsinpiller referred back to the.-question brought up earlier on parking at Lions Park and'indicated that after meeting with school representatives and Robert Bignold of ORB, they decided to leave -the parking as proposed. Bill Hutsinpiller, referring to the cost breakdown for the indoor- outdoor and outdoor pools, reported_that the original progra construction cost had been revised'because oftprogram.increases and the total esti- mated project cost is'$'856,531, which is $59,031 or 7.4 percent over the actual 'program budget total of $797,500. Mr. Hutsinpiller explained that -in order to cut down.co'sts -the Parks and Recreation Staff have placed a large number of items as additive alternates, which could be bid separately and'added on later on if money -was available. -'Cduncil:mem- bers indicated that these alternates were actually necessities and could not be cut out of the project. ' Parks Director Bill Hutsinpiller pointed out that there is enough money in the bond issue to cover the swimming pools, but that other projects would have to be.sa- crificed if.these funds were used. City Manager McMicken indicated that the revisions to the original plans were desirable. He explained that the Parks and Recreation Department is applying for federal monies to help finance'other Park projects,- Washington -and Randall Parks in particular, which may result in recovery of some costs that otherwise would' have been spent by the City. It was suggested that the indoor- outdoor capability - and decking ' at Eisenhower pool and the increased bathhouse at Lions pool.could be.bid as alternates. Parks Director" Hutsinpiller reported that by approximately May 23, 1972, the Depart - ment would know whether or not.the Washington Park project would be funded, which would have a major role to play in the decision of the pools. After due discussion, it was•MOVE$ by Whitaker, seconded by Schussler that the preliminary design for Lions outdoor- indoor swim pool and Eisenhower swim pool and the preliminary cost estimate be approved, -and that bidding be done including alternates: carried, Broad, Brown, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Lambert absent. City Manager McMicken reported that the City is considering the_ purchase of approximately 30 acres of property at the east end of town owned by Freeway Properties (property east of North lath.- ,Street and south of "D" Street extended), to facilitate :a park and ,athletic field and possibly a- refuse disposal site. He further reported that Charles Lyon, Attorne ,- • has advised the City that the owners of Freeway. Properties will stand by for a period of 90 to 120 days to give the City enough time to make a site development plan including .feasibility studies of said property as a park, and if the site plan indicates that it is • advisable for the City to proceed acquire the property for a park, that they will dis- cuss with the City a plan for purchasing. Mr. McMicken indicated that the Yakima Lions Club is interested in participating in the development of such area for anpark, their understanding being that the entire portion would ultimately be developed into a'park even though some portion of it might be delayed in order to allow - for some.i. filling. City Mana- ger McMicken and Director of Parks and Recreation Bill Hutsinpiller recommended that the firm pf ORB, Architects to be hired to prepare a site development plan for the proposed Freeway.Pa.rk and athletic field. They indicated ,that the fee would be- $3,000 based -on $100 per acre. Mr. Hutsinpiller indicated that the project would come under the $1;900,008 park bond issue in property acquisition, but may be partially funded by a federal grant. After due discussion, it was MOVED by Robinson, seconded by Whitaker that the City Council authorize' the hiring of the firm of ORB to prepare a development plan for the:pro- posed_Freeway property: carried, Broad, Brown, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. • Lambert absent. • City Manager McMicken explained that the City owns:Larson Park -which includes softball fields and food and drink concession facilities which have been used'by the Yakima Association in its program, and the City and the Yakima Softball'Association desire to enter into a contract to provide for the continued use of such facilities. He further:ex- plained that the contract would provide that the Softball Association pay the City 4 percent of.the gross proceeds derived from its operation of food and drink concessions only at Larson Park. After due discussion, it was MOVED by Lust, seconded by Schussler • that Resolution No. D -1856 authorizing the execution of a, concession contract with the Yakima Softball Association, be passed as read: carried, Broad, Brown, Lust, Robinson, Schussler and Whitaker' voting aye on roll call. Lambert absent. RESOLUTION NO. D -1856, A RESOLUTION authorizing and directing the City and City Clerk of the City of Yakima to execute a concession contract with -the Yakima Softball As- sociation. MAY 8, 1972 - City Manager McMicken explained that the City desires to perform a preliminary and develop- ment study of a park site on West Lincoln.Avenue, known as the Powerhouse Site, and that Donn Rothe,•A.I.A., Architect, has offered'to'perform such services.. He further-explained that the property has not been purchased, and this would be a feasibility study.- Mr. Mc-. Micken indicated that'the purchase of 'this property would be covered by the $1,•900,000 park bond issue, but the City'has not - set.aside funds for the'development. - After due discussion it was MOVED by Robinson,'seconded by Brown that Resolution No.'D- 1857 the execution of an 'agreement with Donn Rothe, A.I:A., for a preliminary park study; be passed as read: carried ;'Broad, Brown, Lust, Robinson, Schussler and Whitaker voting aye on roll'• call. Lambert absent. City Manager McMicken reported on a referral by the Regional Clearinghouse. Board re City of Naches Sewage Treatment Plant. He stated that he would submit a letter to the Regional Clearinghouse Board supporting Naches. Sewage Treatment Plant and making favorable comments. City Manager McMicken.reported that Mr. Keith Gibson has paid to the City of Yakima for refuse collection at 612 South llth Avenue an amount $78 in excess of that due for service actually performed. He further reported that a credit of $24 has been extended to Mr. • Gibson's account, and that the City should refund the balance of $54 to him on account of such overpayment for the,period from January 3, 1968, to January 3, 1971.
