MINUTES OF SPECIAL MEETING . • YAKIMA CITY COUNCIL c = • : APRIL 24, 1972 i • . • • The City Council met in special session - pursuant to' due notice,' at 1 :.30 P•.M., April`24, 1972, in the Conference Room at Yakima City Hall :7 • Councilmen present at the meeting' were Mayor Bert Broad, Wray Brown,: Lenore Lambert,. James Lust, Walter Robinson, Don Schussler. and Bill Whitaker. .Also present were City Manager Craig McMicken, City Attorney Fred Andrew's, Police Chief-Jack and Lieutenant Bernard Kline. . Police Department personnel reported to the Council regarding'•thelaw) enforcement consoli= dation study recently completed by SUA.. Included. in the discussion were jail consoli= dation, regional crime information centers, records, and facilities planning. Financial problems now confronting the Southeast Community Center were also a matter of discussion. Council members considered solutions to the problems of final capital funding, operation funding, and funding for a recreation program. , = The Council discussed.selection of an architect' to' prepare preliminary Shop Warehouse plans. The special, meeting. adjourned at 3:00'P.M. • • REGULAR MEETING - APRIL 24, 1972 - '3•:00 O'CLOCK P.M. . • The City Council then met in regular session at the hour of 1:00 P.M., Mayor Broad pre- . siding, Councilmen Brown, Lambert, Lust, Robinson, Schussler and Whitaker, City Manager McMicken and City Attorney Andrews present on roll call. The. Invocation was given by Mayor_Broad The minutes of the regular meeting of April • 17, 1972, having been duly certified accurate by two Councilmen, and no one present wishing to have said' minutes read publicly, Mayor Broad declared said minutes approved as read. . Mayor Broad brought: on .an off -the- Agenda item, ..that Of No. 741, a Notice of In- , tention to Commence Annexation Proceedings, which was filed'w.ith the':City.Clerk on April 24, 19724:byAllan A; and'Bea:trice Hart, and requested the annexation :of property to cated south of Meadi,Avenue in the .vicinity :of Ledwich_and KingTStreet.. It was MOVED by Robinson, seconded by Lambert that this date be set as the time for a meeting with the • initiating parties who signed the Notice of Intention to Commence. Annexation Proceedings dated 24, 1972, those initiating parties being'Allan A. and.Beatrice I. Hart: car- ried,,Broad, -Brown, Lambert, Lust, Robinson, Schussler'and :Whitakervoting`.•aye by. voice vote. •Mr. Allan' A. Hart, being present and• indicating that_theyare to assume their share of the City's existing indebtedness, it was duly moved, seconded and passed that the annexation proposed by petition no. 741, (Notice of Intention to Commence•Annexa- tion-Proceedings); be accepted by. Cityrof:Yakima and the area sought to'be.annexed be required.to assume the City's existing indebtedness, and :that a :notice of Intention to Annex be filed with the Yakima County Boundary Review Board. Robinson,excused at'4 :OOP.M, . • This being the time fixed for a Hearing on the Appeal from the Planning Commission's de- cision to deny'the Rezone Application filed by Willi.am Dr. C. S. Pinard and Others, requesting rezone of property located on North Naches and North Sixth.Street be- tween Yakima Avenue and Lincoln Avenue, Director of Planning and Community Development Jay Otto referring•to :the Staff Report dated March:27; 1972, gave a brief report on the his - tory of this rezone- application.. Assistant.Planner_Ray. Sturtz.presented'slides of.the' property in question and pointed out the surrounding land uses. 'Planning Director Jay Otto explained that in 1968 and 1972 the - Planning Commission and'City•Council denied a request by Mr, Whitehead and others to:rezone:two lots within the proposed rezone from.R -3 Multi - Family to ]3 -1 Modified Business. He indicated that the denial was based on theGeneral • Plan indication for the area and the :desir,ability'of:.preserving .the integrity'iof the po tential multi- family residential area located east of Naches Avenue. He further explained that the decision to-deny-the previous•requests'were also based on the importance of pro- tecting. the City from sprawl'of intermixed commercial: development' into the peripheral areas :?of the Central-Business District: Mr. :Ott•o stated that .the previous decision and the previous staff-reportS indicated that. the 'area was.we,ll suited for. :multi- family inIthat it was effectively buffered- from Adjacent commercial activity:_by the�:.Naches :Avenue Parkway, • and that immediately adjacent to this .area was ai wide' '.varie:ty :of • shopping i facilities, places of employment and facilities essential' to the _support- :of..a high `density•'residential area.. , Mr. Otto pointed out thatethe'.General Plan- preparedcfor.:the Central Dis- trict in 1967 indicates the. area in question as Fraternal, and Social. Organizations, and Multi - Family..., :Mr . Otto.: further . pointed out that the Planning Commission' and Planning Staff II unanimously recommend the rezone request be denied for three reasons (1) it tent with the General Plan for the City of Yakima, (2) it is in direct opposition to the concept•of 'the Central..Business District Plan, which the uneconomical sprawl of , commercial• ' deve.lopment.•into the peripheral areas of:rthe "Central ' Business District, and 4 (3) ° it would 'nul-lify , the positive effect of, the _parkway_ on NNaches Avenue,' which _creates a natural .buffer. between the -commercial and nonc.ommerc.ial .uses located in this portion '.c f the City. Attorney Perry , Robinson;<'representing.s'ome of the`pet'itioners, contended•that the area west of 6th.Street•as really in Central Business and should be zoned that way. He further argued 'that 100 percent of the property owners want this rezoned, and to deny the rezone application would - be discrimination. Property owners in the vicinity • of the proposed rezone, being present and speaking in favor of the rezone were O. F. Gil- - bert,.15 South- 6th-Street, Mary Kirby; 30 North .Naches Jane Miller; 6 South 6th Street, Robert Suver,,who owns property at North.6th Street, an apartment owner at 114 North 6th Street, • Paul 'Lachance, owner of .property at 104 North 6th Street, and William Filter, -201 North•Naches Avenue.-Also present and speaking in favor of the proposed rezone was Attorney Howard Hettinger, representing Paul'LaChance. Councilman Brown indicated he • 356 APRIL 24, 1972 felt that a13 Modified Zone in this area would be an excellent backup to the downtown core area. Councilman Lambert pointed out that there needs to be some downtown multi - family residential area. Mayor Broad expressed his concern of the obvious deteri- oration of some of the property in this area. Councilman Whitaker spoke in favor of the rezone, but indicated that he would want the trees and lawn preserved. Councilman Schus- sler spoke against the rezone. Councilman'Lambert pointed out that crossing:.the. Naches Avenue parkway would set a zoning precedent, and that she'felt the Staff should spend more time considering this rezone. Several Council members concurred that this matter should be studied further. A formal Motion requesting a rehearing by_'.the Planni said rezone application filed by William M. Greenwood, et a1., having-been prepared by, the City Attorney, was read. After due discussion,.it was MOVED by Whitaker, seconded by Brown that said MOTION be passed as read: carried, Broad, Brown, Lust and Whitaker voting aye on roll call. Lambert and Schussler voting nay on roll call. Robinson absent. Coun- cilman Lust explained that his reason for voting yes was that the Ce'ntral''Business Dis- trict'boundaryy issue needs clarification. MOTION, A MOTrON'r.equesting • a rehearing by..the Planning Commission.of.a rezone application filed by William M.'Gree wood, et al. . This being the time fixed for a Hearing on a Rezone Application filed by Mr. Wilbert J. Mottet, requesting rezone of property located at 4511 Tieton Drive, Director of.Planning and Community Development Jay. Otto explained'that the request is for a rezone from R -1 Single - Family Residential to R -2 Two- Family Residential. He further explained that the petitioner proposed to divide two lots into three duplex lots, each of a legal size. Mr. Otto pointed out that General indicates this area as' being low density residential,: Mr. Otto reported that the Planning Commission and Planning Staff recommend approval of this rezone application for the following reasons (1) the single family residence on this property is presently located between two duplexes, (2) the addition would generate no additional traffic, (3), the rezone will make the existing duplex of conforming use, and • (4) the increased densi-tyof one unit would not have detrimental effect on the surrounding single family residences. After due discussion, it was MOVED by Brown, seconded by Whi- taker that Ordinance No. 1405 accepting the recommendation of the Planning Commission and rezoning said property from 1, Family Zone,' to R 2,'Two Family ,Zone, be passed as read: carried., Broad, Brawny Lambert,.. Lust, Schussler.and Whitaker votingaye On-roll call. Robinson absent. ORDINANCE NO. 1405, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 4511 Tieton Drive in the City of Yakima, Wash- ington, from R -1, Single Family Zone, to R -2, Two'Family Zone:' :° Barbara Long, being present, brought to the Council's attention the fact that John Mar- shall, Doug Wilson and Charles Flower are planning to put a tavern outside of the City limits in ah orchard off.of Tieton Drive and 48th Avenue. She stated there is to be a hearing on this matter in the Yakima County'Courthouse April 28', 1972_, and requested that the City help stop this from being put in. It was agreed that Director of. Planning and Community Development Jay Otto'and Mayor Bert Broad should be the: :hearing. Mr. Jean R: Allard, being present, brought on' the matter of Petition No. 740, which he had filed,w.ith the City Clerk on 24, 1972, requesting -theiCity Council'to- terminate Yakima Valley Transportation Company's use of City' arterial'streets "by Jantary 1975. Mr. Allard pointed out the reason for this'request is that he feels there is a safety hazard existing with the railroad tracks on Nob Hill Boulevard. After due discussion, it was MOVED by Lambert, seconded by Whitaker that this.'matter.be referred to the City Mana- ger and Staff for study and recommendation: carried'; Broad, Lambert, Lust, Schussler and Whitaker voting aye by. voice .vote. .Brown temporarily absent. Robinson absent. Mr. George Martin, representing Yakima Valley Museum and Historical Association, presented to the Council plans for the construction of the Frontier Museum at Franklin Park. Mr. Martin reported that in 1956 the Metropolitan Park District deeded to the Yakima Valley Museum and Historical Association a tract of land to.build the Yakima Valley Museum. He explained that about four years ago Dr. Gannon of Mabton met with people of Yakima and as a result a nonprofit corporation was set up in Yakima to establish Yakima Frontier Museum, which was located on ,North First Street.' Mr. Martin further explained that in the Spring of 1971 the'City- County, Health Department took over the area for a health center and the museum lost its home. Mr.. Martin stated that the Gannon collection was placed in storage, and his association has been trying for a'year to figure ways and means to preserve the Frontier Museum Collection for the citizens of Yakima Valley. He stated that after -many talks they have arrived with the idea toenlargesthe'present facility in Franklin Park. He further stated that-with this in mind they had some preliminary designs made within the possible financing that could be afforded. Mr. Martin explained that as a result, the Board of Directors of the - Wagori Museum got together with the'Board of and agreed that Wagon'Museum would give.up the wagons ,if. housing could be-provided:: Mr. Martin reported that his. association is raising funds tocover the costs of construc- tion, and requested that another portion of Franklin'Park be transferred to the Association on which to'build the expanded museum facility. He'suggested that a clause'be included with the deed transfer wherein all property and improvements will revert back to the City of Yakima for park purposes if the proposed use is changed or the facility is abandoned . City Parks and Recreation Director'Bill Hutsinpiller reported that the Parks and Recreation Commission'recommends this transfer of property providing the final. construction plans are approved. After due discussion, it was MOVED by Lambert,.seconded by Brown that the mu- seum proposal as presented by Parks and-Recreation Committee be approved, and that necessary action be taken by the City Manager and Staff to implement :it'at..the proper time: carried, Broad, Brown, Lambert,'Lust, Schussler and Whitaker voting aye by'voic'e vote: Robinson absent. Parks and - Recreation, Director Bill Hutsinpiller reported that the preliminary plans for the indoor - outdoor pool at Lions Park and the outdoor pool at Eisenhower High School have been approved as presented to the Parks and Recreation Commission. Mr. Bob Bignold presented the original plans for the pools to the Council. He briefly reviewed the background of the projects and pointed out that some changes have been made from. the preliminary report, (1) it now includes a movable bulk head, wherein different distances can be obtained for swim meets, (2) the outdoor. pool's bathhouse will have insulation in the roof, so heaters can be 'put in in the future and a roof can be put on the pool, and '(3) it now provides inserts along steps going .around the pool so that benches could be set in those inserts at a later time:to accommodate, the .public. Mr. Leroy Scharf presented to the Council the proposed-plans which he• indicated were basically identical, the Lions Indoor - Outdoor Pool being covered and the Eisenhower Pool being planned for possible future covering. Several Council members brought up' questions on traffic and parking situations and it was agreed to continue this matter for one week or until May 1,.1972. 357 APRIL 24, 1972 There being no further business to come before the Council, it was MOVED by Schuss ler, seconded by Lust that we do now adjourn at the hour of 6:05 P.M.: carried, Broad, Brown, Lambert, Lust, Schuss ler and Whitaker voting aye by voice vote.
