Barcus was formerly employed by the City of Yakima as a parking checker; and WHEREAS, Robert L. Barcus was suspended from his employ- ment effective April 24, 1990 under the authority of Subsec- tion D of Chapter IX of the City of Yakima Civil Service Rules and Regulations effective April 24, 1990; and WHEREAS, Robert L. Barcus is subject to reinstatement in his position pursuant to the aforementioned civil service rule, ho\ %ever, Mr. Barcus may be resuspended under the author- of the same civil service rule; and WHEREAS, Robert L. Barcus and his spouse wish to settle all claims against the City of Yakima, including wages, and end his employment with the City of Yakima; and 1 the City Council deems it to be in the best interest of the City of Yakima to settle anv and all claims between the City and Robert L. Barcus and his spouse, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and City Clerk are hereby authorized and directed to exEcute the attached and incorporated "Settlement Agreement." with Robert L. Barcus was formerly employed by the City of Yakima as a parking checker; and WHEREAS, Robert L. Barcus on April 24, 1990 was suspended without pay from his position as parking checker under the provi- sion of Subsection D of Chapter IX of the City of Yakima Civil Service Rules and Regulation; and WHEREAS, Robert L. Barcus is subject to reinstatement in his aforementioned position, however, he may be subject to resuspension from the aforementioned position under the authority of the same c service position; and WHEREAS, the City of Yakima and Robert L. Barcus wish to amicably settle anv and all claims between the parties, including wage claims, and end Mr. Barcus employment status with the City now therefore, City of Yakima, Robert L. Barcus and his spouse Robin L. Barcus, the parties, matually agree as follows: 1. In consideration of the sum of Eight Thousand Eight Hundred Nine Dollars and Eighty-Seven Cents ($8,809.87), the receipt of which is hereby acknowledged, Robert L. Barcus and Robin L. Barcus, for themselves individually and their marital community hereby waive and give up any and all claims of whatever nature they may nave against the City of Yakima, its officers, agents, and employ- • ees. Specifically, Robert L. Barcus and Robin L. Barcus waive and give up and anv all claims for additional wages and compensation, reinstatement of employment, and any right, claim, or cause of action arising out of the employment of Robert L. Barcus with the City of Yakima. The sum of Eighteen Thousand Eight Hundred Twenty-One Dollars and Seventy-Two Cents (918,821.72) represents Robert L. Ear gross wages, longevity pay, and cash out of benefits for employment from April 24, 1990 through January 20, 1991 in the position of City of Yakima parking checker, Robert L. Barcus and Robin L Barcus have authorized the City to deduct from wages and compensa- . - Lion owed standard employee deductions as well as accrued unemploy- ment compensation paid to Robert L. Barcus for the period of April 24 through November 20, 1990 leaving a net payment of Eight Thou- sand, Eight Hundred Nine Dollars and Eight-Seven Dents ($8,809.87). The City of Yakima shall reimburse the appropriate source the amount of Six Thousand Two Hundred Thirty-One Dollars and Ninety Cents ($6,231.90) which represents the amount of unemployment compensation received from Robert L. Barcus from April 24 through November 20, 1990. - - (agr/stlmt) 2® Robert L.
