A RESOLUTION authorizing submission of an application to
the State of Washington for a Development Loan
Fund (DLF) Project on behalf of La Cocina
fexicana. Inc.
WHEREAS, DLF funds are available to support economic
development projects which are ready to implement and for which
jobs created or retained will be made available to lower- income
persons; and
WHEREAS, the ja Cocina Mex �RaL,.. Inc DLF Project
represents a substantial commitment of private resources towards
enhancing the vitality of the area and expanding the gy of
Yakima tax base and employment opportunities; and
WHEREAS, it is necessary that certain conditions be met as
part of the application requirements; and
WHEREAS, the Qity of Yakima will provide citizens with
reasonable notice of, and an opportunity to comment on, any
substantive change proposed from one eligible activity to another;
and
WHEREAS, the of Yakima shall agree to comply with all
applicable federal and state regulations in the event that this
application is selected for funding, including federal and state
regulations in regard to the environmental impact of the project;
and
WHEREAS, the ; *y L Yakima will provide opportunities for
citizen participation comparable to the state's requirements, and
has complied with all applicable public meeting requirements; and
WHEREAS, the ty of Yakima will conduct and administer its
programs in conformance with Title VI and Title VIII of the Civil
Rights Act of 1964, and affirmatively further fair housing; and
WHEREAS, the City ...0 Yakima DLF Protect will not result in
the displacement of persons, or use of Community Development Block
Grant funds for public improvements; and

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF YAKIMA:
That Patricia A. Berndt. Mayor is hereby authorized to

DISCLOSURE AND CONFIDENTiAUTY POUCY
Business records submitted as part of a DLF application are generally exempt from disclosure under RCW
42.17.310. However, certain information in the Department's possession may be made available for public
inspection after an application for financial assistance is recelvi 1. This hforrnatlon includes the names of
applicants, including principals; the amounts, types, and general terms of financial assistance; descriptkens •
projects and the number of jobs projected in connection with a project; and the names of financial institutions
participating in the project.
Most records are designated confidentiai and not available to the pudic for inspection. This includes the disclosure
of records which would constitute an invasion of an individual's privacy, such as personal tax returns or financial
statements, assessments of credit worthiness or financial condition, records obtained in connection with any
monitoring or servicing of an existing project, and, If confidentiality Is specif'ical'ly requested, any records or
Information the release of which the Department has determined could cause competitive detriment to the person
or business to whom the information belongs or pertains. Any record obtained or developed by the Department
prior to receipt of an application is confidential until an appfication is filed, at which time such record will remain
confidential only if it meets one of the requirements described above.
If any party to an application desires information to be kept confidential, the applicant should dearly identify what
information or documents It wishes to be kept confidential. The applicant must also explain in writing the basis
for its request that the material be kept confidential. Where the applicant asserts that the basis for the
confidentiality is that release of the information could cause a business or competitive disadvantage or loss of a
competitive advantage, the applicant must provide the Department with sufficient information to enable the
Department to independently determine the likelihood of such detriment. Applicants may wish to consult with their
own attorney as to the scope of RCW 42.17.
