HomeMy WebLinkAbout04/10/1972 Special Meeting / Regular Meeting APRIL• 10, 1972 • MINUTES' OF SPECIAL MEETING • YAKIMA CITY COUNCIL • • APRIL 10, 1972 The City Council met in special session pursuant to due notice, at 1 :30P.M .,, April 10, 1972, in the Conference Room at Yakima City Hall. . Councilmen present at the meeting were Mayor Bert Broad, Wray ,Brown, Lenore Lambert, Waite Robinson and Bill Whitaker.. Also present were City Manager McMicken; Personnel Director Bob Hilsmann, Administrative Assistant Jim Williams, Public Works Director Dave Vargas, Public Utilities Director.Frank Stein, City Garage, Superintendent George Davis, Municipal 'Refuse Service Superintendent Dale Samuelson, City Street Department Superintendent Al Richards and City Transit Manager Bob Knight. The Council discussed made arrangements for reservations for the upcoming convention of the Association of- Washington Cities. The convention will be held•June 13 through 16 at Seattle's Olympic Hotel. City Manager McMicken explained proposed supplemental guidelines for out of City travel. No firm•decisions Were made. A discussion followed working conditions at the City's shop warehouse. Several City department and division heads described the many problems involved in working in the old and inadequate facility. Also discussed were possible alternative methods for capital financing of a new facility.. The special meeting adjourned at 5:00 P.M. . REGULAR MEETING - APRIL 10, 1972 - 3 :00 O'CLOCK P.M. The City Council then met in regular session at the hour of 3:00 P.M., Mayor Broad presi- ding, Councilmen Brown, Lambert, Robinson and Whitaker present on roll call. Councilmen • Lust and Schussler absent on roll call. It was MOVED by Robinson, seconded by Brown that Councilmen'Lust and Schussler be excused from this meeting: carried,, Broad, Brown, Lambert Robinson and Whitaker voting aye by voice vote. Councilman' Lust present after 3:10 P.M. City Manager McMicken and City :Attorney Andr•ew.s present on.roll call. The Invocation was • given by City Manager McMicken. The minutes of the regular meeting' of April 3, 1972, having been duly certified accurate by two Councilmen, and -no one present wishing-to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. This being the time fixed for a Hearing on Petition No. 734, filed by Dr and Mrs.- Ronald Reihl, requesting annexation of property located at 710, 712 and 714 North 56th Avenue, it was MOVED by Robinson, seconded by Lambert that Ordinance•No.. 1401 annexing and zoning said property to the City of Yakima;.be passed as read: carried, Broad, Brown, Lambert, Robinson and Whitaker voting aye on roll call. Lust'and Schussler absent. ORDINANCE NO. 1401, AN ORDINANCE annexing property to the City of Yakima and zoning said property. - Councilman Lust present after 3:10 P.M. Petition No. 739, having been filed with the City Clerk on 3, 1972, by J. N. Chisum and Others, relating to the widening and extension of 40th Avenue, requesting the City to eliminate the - left -turn holding lane immediately north of the intersection of 40th Avenue with Richey Road, City Manager McMicken explained that this petition relates to the dis- puted 40th. Avenue widening project. Mr. McMicken recommended that the City Council hold a public hearing on this matter. Director of Planning and Community Development Jay Otto indicated that the Planning Commission and Staff would have a recommendation to the Coun- cil after it's meeting of May 2, 1972. After due discussion, it was MOVED by Robinson, seconded by Whitaker that the matter of Petition No. 739,.relating to the widening and ex- tension of 40th Avenue, be continued to a'public hearing held by the City Council on May 15, 1972: carried, Broad; Brown,•• Lambert,' Lust, Robinson and Whitaker voting aye by voice vote. Schussler absent. -., Damage Claims having filed with the City Clerk'on•Apr.il•3, 1972, by Frank Brugnone,, Selah, Washington, in the amount of $62 - for' damages to his' automobile caused by ' a loose man -hole cover, and filed on April 5, 1972,. by Ola G. Sheets, Yakima, Washington, in the amount of $164.90•for damages to her;automobile--caused by a loose man -hole cover, it was MOVED by Brown, seconded by Robinson that said damage claims be referred to the City Manager and Staff for study and recommendation: carried,• Broad, Brown, - Lambert,. Lust,' Ro- binson and Whitaker voting aye by voice vote. Schussler absent. • ( City Manager McMicken reported that out of the City's association with the Public Personne Administration in Chicagd,, we have found ''that'the 'majority of •the •states require less than a year of service from employees be•fore•vacation leave can be taken. He further reported that as of now, City of Yakima employees must wait until a year of service is completed before they'can take vacation leave with pay:: - Mr. McMicken explained 'that department heads • and union representatives -'for the Cit -y• have concurred that vacation leave accumulate. at the end of six months of service could be taken in the seventh month and each month • therafter as accumulated; 'andc'that the department -head °would reserve the right• •to; grant ' such leave. It was then MOVED by Robinson, seconded by Lambert that Ordinance No: 1402 specifying permissible use of vacation accruals with pay; and ' amending Subsection 2.40.020 C. of the City of Yakima Municipal Code,/be passed as read: carried, Broad, Brown, Lambert, ** Lust,- Robinson and Whitaker voting aye on roll call. Schussler absent. City Public Works Director Dave Vargas reported that in accordance with-Council action at the previous meeting of April 3, 1972, he and City Attorney Fred Andrews have gotten to- gether and determined which lof- the projects- in L.I•:D. •'No." 985, I972-Street and Alley Paving District, can.be approved on the basis of protests. He explained that they- have South 22nd Avenue and • West Logan Avenue improvement to include only the portion inside the City', that the County portion was protested out... Mr. Vargas further explained that after study, the City. Attorney has 'found that the City could hot improve-any part of South 7th ** See Ordinance No. 1402 on page 351. - X 348 APRIL 10, 1972 Avenue. After due discussion, it was MOVED by Brown, seconded - by Robinson that Ordinance No. 1403 amending L.I.D. No. 985, 1972 Street and Alley- Paving District, by deleting cer- tain streets and alleys therefrom, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye on roll call. Schussler absent. ORDINANCE NO. 1403,•AN•ORDINANCE providing for the improvement of certain streets and alleys; and amending Section 1 of Ordinance No. 1390, passed February 29, 1972, entitled: "AN ORDINANCE providing for the improvement of certain streets and alleys by grading, ballasting, surfacing with asphaltic concrete and constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local Improvement District,,pro- viding for the method of payment thereof, and creating a special fund "; and declaring an emergency. ,- Mr. Cecil Beauchamp gave a presentation of a proposal to enlarge the Flight Deck Restau- rant at Yakima Municipal Airport. He explained that since September 1, 1971, at which time he and his wife purchased the airport restaurant, it has proved to be very popular and . they are having to -turn people away because of too little room. Mr. Beauchamp.requosted the City Council's permission to construct a 25 foot by 60 foot glass enclosed foom to seat 96 persons out on the deck from the lounge and to have a dance floor and nightly en- tertainment; His proposal -also included banquet facilities for 135 people, and a covered patio with outdoor furniture and a barbeque pit with seating for 75 people. Mr. Beauchamp explained that Mr. John Villesvik, a local architect, did a $300 cost analysis for them sevemlmonths ago, and Mr. estimate of construction costs was $32,000 to $36,000, which was $12.,000.to $16,000 more than they had anticipated. He further explained that he had estimated the.City;s cost to be $20,000 to $22,000 plus architectural fees, and he would add $12,000 for interior furnishings, Mr. Beauchamp stated that he would in- crease his rent to the City to 6 percent as soon as the facility is completed, and that with this increase and the anticipated increase in business, the. City's costs could be paid off in three years. Councilman Robinson asked if the airport advisory committee had had some input on this matter, and Mr. Beauchamp replied that he has worked very closely with the aviation committee. City Manager McMicken reported that Jim Eakin,- Airport Manager, and he have talked about the importance of capital financing of airport needs including _parking lot improvements, acquisitions of property, air conditioning of the terminal building, overlay of the runway, fencing and a new Federal Aviation Administration control tower, which will cost the City money which will not be paid back. Mx. McMicken asked the Council if the restaurant expansion should be a separate issue from other airport needs. He further reported that he would be meeting with the aviation committee on these matters and would bring a.report -back to the Council. Councilmen Brown, Lumber -t,FLust and Robinson agreed that this matter should be a separate issue and should be decided on as soon as possible. Councilman Brown pointed'out that matters•.of costs and also Mr. Beauchamp's sublease on the facilities should be cleared up before any Council action is taken. Coun- cilman Robinson indicated he would like to have some assurance that this project would pay for itself. After due, discussion, it was MOVED by Lambert, seconded by Brown that this matter of a proposal by Mr. Beauchamp to enlarge the Flight Deck Restaurant at the Yakima Municipal Airport be referred to the City Manager and Staff for study and recommendation: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye by voice vote. Schus- sler absent. A report having been received from the Planning Commission on Rezone Application filed by Mr. Wilbert J. Mottet, requesting rezone of property located at 4511 Tieton Drive, and an appeal having been received from the Planning Commission's decision to deny the Rezone Application, filed by Dr. C. S. Pinard and Others, requesting rezone of property located on North Naches and North Sixth Street between Yakima Avenue and Lincoln Avenue, it was MOVED by Robinson, seconded by Lust that April 24, 1972, be fixed for the time for Hearing on these matters: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye by voice vote. Schussler absent. City Manager McMicken reported that the following bids were received and considered by a Bid Board on April 6, 1972, for the construction of Washington Avenue and Mead Avenue Rail- road Crossing Improvement Project:c: ' Yakima Asphalt Paving Co. $65,847 Superior Asphalt & Concrete Co. • $69,525• • The City Engineer recommending that contract be awarded to Yakima Asphalt Paving Co., in the amount_:of $65,847, who submitted the•lowest and best bid, it was MOVED by Robinson, seconded by Lust that the-recommendation of. the City Engineer be_ accepted and that the contract be awarded to Yakima Asphalt Paving Co., in the amount of $65,847, and that the City Manager be authorized to enter into a contract with said contractor upon the filing of the proper bond and insurance: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye by voice vote. Schussler absent. City Public Works Director Dave Vargas explained that although the low bid was 25 percent• over the City Engineer's es- timate for this project, it.would not be beneficial to call for bids again. City Manager McMicken reported that - increased costs for these projects must come from the City's General Fund, since Urban Arterial Board project money has long ago been exceeded. - City Manager McMicken referred to the •matter of authorization to execute an Agreement with the Washington State•Highway-Commission. City Public Works Director Dave Vargas explained that - the .State Highway Department has improved some of our City streets in the vicinity of Yakima Avenue; namely, I- 82'Interchange. He•further explained that the City has made a joint inspection with representatives of the State and has found the construction to be completed satisfactorily. Mr. Vargas recommended that the City immediately accept the maintenance responsibilities for those inspected sections of State constructed roadway. It was then MOVED by Lust, seconded by Brown that Resolution No. D -1839 authorizing the Mayor and City Clerk to execute an agreement with the Washington State Highway Commission, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye on roll•call. Schussler absent. • RESOLUTION NO. D -1839, A RESOLUTION authorizing and directing the Mayor and City Clerk of the City of-Yakima to execute an agreement with the Washington State Highway Commission. City Manager McMicken referred the matter of an Agreement with Loyd Record for installation of a domestic•water main to-City Public Works Director Dave Vargas. Mr. Vargas explained that the City desires to obtain an easement over and across real property owned by Loyd Record and others for the purpose of installing a domestic water main for Hopcon Extracting Company. Mr. Vargas indicated that Mr. Record has offered to grant such an easement to the City subject to (1) his right to use the surface of the ground within said easement, • 349 APRIL 10 (2) fire hydrant service to be furnished for a period of ten years without charge, .(3) = ' after a ten year period he will pay for fire hydrant services, and (4). the City will- resurface-the area affected by the construction. D -1840, A RESOLUTION authorizing and directing the.:City'Manager and.C'ity Clerk of the City,of Yakima to execute an easement agreement with Loyd Record and .Others for the installation. of a domestic water. main. . City Manager McMicken referred to his report #148 Street Tree Planting Program. re- ported that the City is trying to establish policies and gu:ide,the•.development of planting of new.tree's. Mr.. McMicken indicated that there are four methods available for planting new street trees (1) property owners may plant trees in the street right of way, under City specifications, at his own expense, (2) trees may be planted as a para.,of.,.an : Arterial Street Improvement Project, (3) a tree•L.I:.D, may be`formed,'or (4) developers may plant trees in newly subdivided areas or as a part of a planned development approved by the City. He stated that there has been interest on the part of some property owners to plant street trees on Second Street from Walnut to Lincoln, in::connection with 'an L.I.D., and in order to demonstrate the'benefits of street trees in this area,'he recommends authorization to proceed with a planting.of trees adjacent to City Hall. City Manager McMicken reported on an off - the - Agenda item that of Petition No. 733,• having been filed with the City Clerk on February 11, 1972, by Birdie Sliger and Others, requestin; installation of'a street light on "A" Street, midway between Naches Avenue and 6th Street. Mr. McMicken stated that there has been very: :Tittle increase of traffic volume in .this block since the completion of the Mall. He further stated that it has been.learned that the Y.W.C.A. will replace the fixture on:their.building with a multi - vapor. light when the present fixture burns out, and that the church property across: :the street from the Y.W.C.A. is requesting the Power Company to install a mercury -vapor light-on, the existing. post in the alley between Naches.Avenue and 6th Street. . . . IL 35_I APRIL 10, 1972. • Mr. McMicken reported that because some of the light, posts. are being knocked down on the divider in Washington Avenue between 16th. and 24th Avenues, it is determined advisable to thin out the street lights by doubling the original spacing. City Manager McMicken recommending that the City Council authorize out -of -State travel for Director of Planning and Community Development Jay Otto to travel to Detroit, Michigan to attend the American Society of Planning Officers from April 15 through 20, it was MOVED by Lambert, seconded by Brown that the requested out -of -State travel be allowed with expenses paid: carried, Broad., Brown, Lambert,' Lust, Robinson and Whitaker voting aye by voice vote.
