RESOLUTION NO. 19 8
A RESOLUTION authorizing the Mayor of the City of Yakima to execute
an interlocal agreement with Yakima Valley Conference of
Governments for creating an Expanded Regional
Transportation Planning Organization.
WHEREAS, SHB 2929, Part III, Section 54 authorizes the creation of
Regional Transportation Planning Organizations within the state; and
WHEREAS, each Regional Transportation Planning Organization shall
form through the voluntary association of local governments within a
county or within geographically contiguous counties; and,
WHEREAS, in urbanized areas, the Regional Transportation Planning
Organization is the same as the Metropolitan Planning Organization
designated for federal transportation planning purposes; and,
WHEREAS, the Yakima Valley Conference of Governments was
designated as the Metropolitan Planning Organization for the Yakima
Urban Area as established by the Governor, effective May 1, 1974, in
accordance with 23 CFR 456.106(A), Section 8 of the Urban Mass
Transportation Act of 1964, as amended, and USC 23, Section 134, as
amended, now, therefore,
BE IT HEREBY RESOLVED by the City of Yakima that the Yakima Valley
Conference of Governments is designated as lead agency for the expanded
Regional Transportation Planning Organization within Yakima County in
accordance with SHB 2929, Part III, Section 54 -57, comprising of the
undersigned City.

IHTERLOCAL AGREEMENT
For the purpose of creating an Expanded Regional Transportation Planning
Organization within Yakima County to facilitate coordination and
cooperation among state and local jurisdictions in planning for regional
transportation systems.
WHEREAS, SHB 2929, Part IJI, Sec 54 authorizes the creation of Regional
Transportation Planning Organizations within the state, and
WHEREAS, each Regional Transportation Planning Organization shall form
through the voluntary association of local governments within a county or
within geographically contiguous counties, and
WHEREAS, each Regional Transportation Planning Organization must
encompass at least one complete county, have a population of at least one
hundred thousand or contain a minimum of three counties, and
WHEREAS, Regional Transportation Planning Organizations must have as
members all counties within the region and at least sixty percent of the
cities /towns within the region representing a minimum of seventy -five
percent of the cities /towns population, and
!EREAS, in urbanized areas, the Regional Transportation Planning
- rganization is the same as the Metropolitan Planning Organization
designated for federal transportation planning purposes, and
WHEREAS, the Yakima Val]ey Conference of Governments was designated as
the Metropolitan Planning Organization for the Yakima Urban Area as
established by the Governor, effective May 1, 1974, in accordance with 23
CFR 456.106(A), Section 8 of the Urban Mass Transportation Act of 1964,
as amended, and USC 23, Section 134, as amended;
NOW, THEREFORE, the undersigned parties, having entered into this
agreement by their signature, mutually agree as follows:
Section I
That the Yakima Valley Conference of Governments is designated as the
expanded Regional Transportation Planning Organization within Yakima
County in accordance with SHB 2929, Part III Section 54 -57, comprised of
the undersigned county, cities and towns. The expanded Regional
Transportation Planning Organization shall meet at least once each
biennium.
Section II
That the expanded Regional Transportation Planning Organization shall
reate a Regional Transportation Policy Board to provide policy advice on
.regional Transportation Planning. The Regional Transportation Policy
Board shall allow representatives of major employers, the Department of
Transportation, transit districts, port districts, and member cities,
towns and county within the region to participate in transportation
policy- making.
Section III
That the Regional Transportation Policy Board shall meet at least twice
each biennium for the purposes of recommending that the Regional
Transportation Planning Organization:
a. Certify that the transportation elements of comprehensive
plans adopted by the county, cities, and towns within the
region conform with the requirements of Section 7 of SHB
2929 Growth Strategies Act, where app]icable.
_ b. Certify that the transportation elements of comprehensive
plans adopted by the county, cities and towns within the
region are consistent with the Regional Transportation Plan
adopted by the Regional Transportation Planning
Organization.
c. Develop, adopt and review the Regional Transportation Plan
for Yakima County.
d. Submit the adopted Regional Transportation P3 an for Yakima
County along with the required documentation of the biennial
review of the plan's currency to the State Department of
Transportation.
Section IV
That the Regional Transportation Planning Organization within Yakima
County, and its transportation policy board, will whenever possible
utilize the existing county, cities and towns' comprehensive plans, and
the state's transportation plans, as the basis for developing the
Regional Transportation Plan.
Section V
That the Regional Transportation Plan for Yakima County shall address
existing and planned transportation facilities and services that exhibit
one or more of the following characteristics:
a. Physically crosses member municipalities lines;
b. Is or will be used by a significant number of people who
live or work outside the county in which the facility,
service, or project is located;
c. Significant impacts are expected to be felt in more than one
county;
d. Potentially adverse impacts of the facility, service, or
project can be better avoided or mitigated through adherence
to regional policies;
e. Transportation needs addressed by a project have been
identified by the regional transportation planning process
and the remedy is deemed to have regional significance;
Section VI
That the Yakima Valley Conference of Governments, as a Metropolitan
Planning Organization for transportation, is designated the lead planning
agency to coordinate the preparation of the Regional Transportation Plan,
to provide staff support for the Regional Transportation Planning

organization, and to the Policy Board, and is to serve as the fiscal
agent for the expanded Regional Transportation Planning Organization
within Yakima County.
Section VII
That the Regional Transportation Planning Organization shall adopt and
update, as necessary, a work program which sets forth the activities for
the coordinated regional transportation planning process prior to July
1st of each biennium. The specific activities with budget estimates will
be developed by the Yakima Valley Conference of Governments staff in
conjunction with the individual policy subcommittee, and then submitted
to the Policy Board for its review and recommendation by May 1st of each
biennium.
Section VIII
That the biennial appropriation from the Washington State Department of
Transportation to carry out the regional transportation planning program
shall be distributed to the Regional Transportation Planning
Organization's lead planning agency.
Section IX

..,ctivities undertaken will not exceed the amount of state funding
assistance provided. Ire addition, s transportation planning
activities that may be identified and recommended by the Policy Board
will, whenever possible, be proportional in cost with the contribution
from the Department of Transportation on behalf of the county comprising
the region.
Section X
That this interlocal agreement shall be binding upon the parties,
effective July 1, 1990, for a period of three (3) years, unless otherwise
terminated as provided herein.
Section XI
That all parties to this interlocal agreement shall have the right to
terminate this agreement, with or without cause, by giving written notice
of its intention to cancel at the expiration of ninety (90) days
following such notice.
If any parties to this agreement should exercise their right of
termination, Yakima Valley Conference of Governments, as the designated
lead agency, shall submit an amendment to the agreement within thirty
(30) days to the remaining parties and to the Department of
ransportation for concurrence and recertification, respectively.
Section XII
That this interlocal agreement neither requires nor prejudices any
further agreement between the parties. The invalidity, in whole or in
part, of any provision of this interlocal agreement shall not affect the
validity of any other provisions.
In witness whereof, the undersigned parties have executed this agreement
as of this day of , 1990.

Dear Mayor:
Enclosed you will find a copy of an "interlocal agreement ". This
document is used in the implementation of ESHB 2929. Under Part
III Section 54 of the Bill, the legislature authorizes creation
of a regional transportation planning organization that must have
as members at least sixty percent of the cities and towns within
the region representing a minimum of seventy -five percent of the
cities' and towns' population." The mechanism established for
verification of those figures is the interlocal agreement.
Signing the interlocal signals agreement by a jurisdiction to
enter into the regional transportation planning process, in this
case with the YVCOG as lead agency. The enclosed copy is for
examination and discussion by your city council and you.
If it is decided to include your community in the regional
transportation planning organization, please send a copy of the
resolution authorizing your signature to the Conference of
Governments.

for your signature later this month.
