' MARCH 13;' 1972 • . -. . • The City Council convened in special session pursuant to due notice, at t:30 P.M., March 13, 197 in the Conference. Room at "Yakima City Hall. . Councilmen present'at the meeting were Mayor Bert Broad, Wray Brown, Lenore Lambert,. James • Lust., Walter .Robinson, Don Schussler and Bill Whitaker. Also present were City Manager Mc- Micken,• City .Attorney.Ahdrews* and Chief of Police Jack' LaRue.' - . .. • • The Counc'il.reviewed . the.proposed water intertie with Union.Gap and instructed the' City Manager to. further review the matter and negotiate with Union Gap City officials concerning primarily. the fee for -the intertie arrangement. . A11 in attendance,.:examined the Medic -I Coronary Care ambulance parked in.'the Police garage and heard an. explanation and 'saw a demonstration by ambulance drivers and .attendants. The .special meeting adjourned at. 3:00 P.M. • • REGULAR MEETING - •MARCH 13, 197 - 3 00 P.M. . The City Counc.il•_then met in regular session at the.hour of 3 :00 P.M.', Mayor Broad presidin•, Councilmen. Brown,.• Lambert, Lust, Robinson,'Schussler and Whitaker, City Manager: McMicken and City present• on roll call " The•Invocatiori was given by Broad. The minutes: of..the, regular meeting of March 1972, having been duly certified accurate' by ' two Councilmen, and "no'one•present wishing to have said minutes read piblicly, Mayor declared said minutes approved!as.'recorded . r: .;c. . Petition No. 736, Notice of Intention to Commence Annexation' •Proceedings, having been filed with the City Clerk on .March 9,• 1972, by D. F. Skidmore and' Eugene Shields, requesting an--- nexation of property located :in the vicinity of West "J Street, it was MOVED•by Robinson, seconded by that this date' be set as the time for a meeting with the initiating parties who signed the Notice•of Intention to Commence Annexation Proceedings dated March 9, 1972, those initiating parties being D. F. Skidmore and Eugene Shields: carried, Broad, Brown, Lambert, Lust, Robinson and' Schussler voting aye by voice vote. Whitaker not voting, because he is an official of Central Steel and Tank Company, which has an interest in this • , annexation. Mr. Whitaker representing Central Steel and Tank Company and Mr. Eugene Shield -, being present and indicating that they are willing to assume their share of-the City's existing indebtedness, it was duly moved, ,seconded" and passed that the annexation proposed by petition no. 736 (Notice of Intention to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's existing indebtedness, and that a notice of Intention to Annex .be filed with the Yakima County Boundary Review Board. The above MOTION was made by Robinson, seconded by Schussler and carried, Broad, Brown, Lambert,•Lust, Robinson and Schussler voting aye by voice vote. Whitaker not voting. • This being the time fixed for the Hearing on the Confirmation of the Irrigation Maintenance Assessment Roll for the year 1972, Mr.-Frank Stein, Public Utilities Director, reported • that the proposed assessment rates for 1972 are the same as those that were in effect for 1971, and the 1972 Irrigation Budget was based on these rates. •Mr.'Stein further reported that some of the systems show that they have enough reserves in their accounts to have thei rates for 1973 adjusted downward by a small amount, although most of the districts are... . _ holding rather even between cost of operation and income. He stated that a few have had more expenditure than total receipts for the year. Mr. Stein referred to his Memo explai- ning the adjustments. He reported that the City has received written protests from people in the various irrigation districts and a request to delete Lots 13 and 14, Block 314, Ca pital Addition, in the Maclaren System Irrigation District #253, since these lots are used for parking. Mr. Stein recommending that these lots be eliminated from the assessment roll, it was MOVED by Robinson, seconded by Brown that Lots 13 and 14; Block Capital Additio , of Maclaren System IrrigationDistrict- #253, be eliminated from said Districts: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Those present objecting to the charges, and others asking questions regarding the rates, • .in:aintenance, water pressure, and discussing other problems with Mr.•Stein were: Mr.. Earl G. -"Dixon, 905 North 4th Street, North 4th Street District; Mrs, Helen Parks, 1019 South 24th Avenue; and Mrs. George M. Hefner, 603 North 4th Street, General. Mr. Stein stated that he . would answer those letters received from persons not present regarding these matters. All persons having been heard both for and against the confirmation of the Irrigation Main- tenance Assessment Roll for 1972, it was MOVED by Brown, seconded by Whitaker that Ordinanc= No. 1393 confirming the Irrigation Maintenance Assessment Roll for the year 1972, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. il ORDINANCE NO. 1393, AN ORDINANCE confirming the irrigation maintenance assessment roll of the City of Yakima for the calendar year 1972, and levying irrigation maintenance assess - ments to such roll; and declaring an emergency. Petition No. 734, having been filed with the City Clerk on March 7, 1972, by Dr. and Mrs. Ronald R. Reihl, requesting annexation of property located at 710, 712 and 714 North 56th Avenues, it was MOVED by'Lambert, seconded by Lust that the Petition for Annexation filed ' by Dr. and Mrs. Ronald R. Reihl, being Petition No. 734,' be approved as meeting the re- quirements of law; that said Petition be referred to the City Manager and Planning Com- mission for and recommendation; and that April 10, 1972, be set as the date for a • public hearing by the City Council on this Petition: carried, Broad, Brown, Lambert,• Lust, • Robinson, Schussler and.Whitaker voting aye by voice vote. ,. An Ordinance appropriating and transferring $3,000.to provide funds for payment of an Agree, ment for Technical Services with Battelle - Northwest, having been read in its entirety at this meeting, was laid on the table for one week or until March 20, 1972. MARCH 13, 1972 • Micken explained that this appropriation and transfer is necessary in order to pay for tech- nical services to be performed by'Pacific Northwest.Laboratories, a division of Battelle . Memorial Institute, in accordance with an agreement previously authorized by the City Coun- cil between the City and Pacific Northwest Laboratories. He further explained that this is a contingency that was planned as the budget was prepared. . • . \-, •.:, ,.„i • ,..-;-. , ,, •• •• - • . • Larry Pryor, owner-operator of Yakima Ambulance•Service, being present; brought on for dis- cussion two matters. of concern to his company. He stated that in February, 1972, the City . . Police Department instructed•their dispatchers to dispatch calls which might be balls II to Sun Valley Ambulance, who has the new heart moniter unit. • Mr. Pryor-further that previously these calls were rotated .between his company, Sun Valley Ambulance and' Best Am- bulance. Mr. Pryor indicated that he feels this is unfair, and that the City should back up and put the.ambulance companies bn.a fair rotation system. •M.n. Pryor also criticized the issuance...of:O. license toa,cabulance company. He stated that' a cabulance• should be li- censed the same as an ambulance company. After dne.discussion; Council members decided • these matters should be studied by the City staff and attorney and a report be brought back to the Council. .City•Manager stated:that*Mr." Pryor would •e•notified at that time. Mr. Jack D. •Wimer, Best-Ambulance, :being preseht,.concurred with'Mr. Ptyor's ;- A report having been received from the Planning Commission on Rezone Application filed by Mr. 0. E. Arnold, requesting rezone of property located at 48 West Mead_Avenue, it was MOVED by Robinson, seconded by Lust that a time for Hearing on this matter be fixed for March 27, 1972: carried, Broad, Brown,, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by . voice vote. As a matter of information to the .Council, City Manager McMicken teported•on-a'County U.A.B. project, Improvement of._ from 58th to 74th Aventes'.: HeInformed the Coun- cil that while the County is the .primary contractor, will be funding part of the cost, the improvement of 58th to 64th Avenues. •Mr. McMicken explained that the total cost of the project is $543,900 of which the City will pay $6 and the. County will $41,300. He further explained that the City and County shares make up 10 percent of the cost of the..17-. Works' Director Dave Vargas further - reported on the pro-' ject stating that Within, the City limits there would' be' sidewalks with planters every 4 feet and trees every 40 feet.
