A RESOLUTION denying the Class 2 Use Permit for additional
parking at 2401 West Nob Hill Blvd.
WHEREAS, Pacific Centers, Inc. filed a request for a
Class 2 Use Permit for property located at 2401 West Nob Hill
Blvd. on February 13, 1990, and
WHEREAS, Pacific Centers desired to increase parking at
its premises at 2401 West Nob Hill Blvd. by four additional
parking stalls to be built on right-of-way immediately west of
its property at 2401 West Nob Hill Blvd., the use of which
right-of-way which had been granted to Pacific Centers by the
City Council on Januar i 23, 1990 through a right-of-way use
permit granted under the provisions of Chapter
City of Yakima Municipal Code; and
WHEREAS, the Hearing Examiner after due and proper notice
held a hearing on May 16, 1990 to review the granting of a
Class 2 Use Permit by the City's administrative official to
Pacific Centers; and
WHEREAS, the decision of the Hearing Examiner was ap-
pealed to the City Council and the City Council after due and
proper notice held a public meeting on August 7, 1990 for the
purpose of considering such appeal; and
WHEREAS, the City Council at such public hearing heard
public comment, asked questions of the staff of the Department
of Community and Economic Development, and conferred with the
City Attorney, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The Class 2 Use Permit granted by the Hearing Examiner to
Pacific Centers Inc. on May 1, 1990 pursuant to City # UAZO
Appeal #4-90, Examiner # 190-1-21 is hereby denied for the
reason that the aforementioned right-of-way use permit upon
which the Class 2 use was to be constructed has been revoked
and Pacific Centers does not possess current authority to use
8.20 of
the

said right-of-way for its proposed Class 2 use of a parking
lot.
ADOPTED BY THE CITY COUNCIL this 14th day of August,
1990.
