HomeMy WebLinkAboutR-1990-D5795 2401 W. Nob HillRESOLUTION NO. D5795 A RESOLUTION revoking a Right -Of -Way Use Permit in the vicini- ty of 2401 West Nob Hill Blvd., Yakima, Washing- ton. WHEREAS, on January 23, 1990, the City Council granted to Pacific Centers, Inc. a Right -Of -Way Use Permit for additional parking to an existing retail center upon unused City right- of-way adjacent to Pacific Centers' property at 2401 West Nob Hill Blvd.; and WHEREAS, pursuant to Section 8.20.080 of the City of Yakima Municipal Code, Morris Stotsenberg, a property owner adjacent to the aforementioned right-of-way, petitioned the City Council on May 25, 1990 requesting the revocation of the Right -Of -Way Use Permit granted to Pacific Centers; and WHEREAS, on August 7, 1990, after due and proper notice to Pacific Centers and Morris Stotsenberg, the City Council held a public hearing to consider the revocation of the aforementioned Right -Of -Way Use Permit; and WHEREAS, the Council heard testimony by staff from the Department of Community and Economic Development, Craig Smith, an attorney representing Morris Stotsenberg and the Council deliberated upon such testimony, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The Right -Of -Way Use Permit granted to Pacific Centers, Inc. on January 23, 1990 by the City Council, a true copy of which is attached hereto and incorporated herein, is hereby revoked. Scale drawings of Right -of -Way to be occupied by applicant. 2. Description of Right -of -Way to be occupied by applicant 3. Plans and specifications of structure or facility. 4. Evidence of ownership of real property adjacent to Right -of -Way. 5. Evidence of required liability insurance. NOTICE TO APPLICANT 1. Application fee does not authorize use of Right -of -Way until use permit has been issued by City Council. 2. Right.of-Way use permit is valid for one year only and must be re- newed to permit the continued use of Right -of -Way. 3. Application fee is not refundable. 4. Permit may be revoked by action of the City Council following notke to permittee. 5.
