WHEREAS, the Parks and Recreation Division of the Depart- ment of Public Works operates and facilitates a program of organized baseball in City parks; and WHEREAS, such program requires the services of umpires to officiate at such games; and WHEREAS, the Yakima Valley Umpire Association has offered to provide umpire services to the City of Yakima in return for monetary compensation; and WHEREAS, the City Council deems it to be in the best interest of the City of Yakima to contract with the Yakima Valley Umpire Association for umpire services, now, there- fore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and the City Clerk are hereby authorized and directed to execute the attached and incorporated "1990 Agreement Between the City of Yakima and the Yakima Valley Umpires Association" for the period from January 1, 1990 to December 31, 1990. ADOPTED BY THE CITY COUNCIL this 1990. day of Payecr- , Mayor ATTEST: City Clerk (res\yvua.jv) 1990 AGREEMENT BETWEEN THE CITY OF YAKIMA AND THE YAKIMA VALLEY UMPIRES ASSOCIATION This Agreement is entered into by and between the City of Yakima, hereinafter called the "City" and the Yakima Valley Umpires Associ- ation, hereinafter called the "Association." The parties mutually agree as follows: 1. The purpose of this Agreement is to foster and facilitate league and tournament officiating for scheduled Parks and Recreation programs. 2. The City Parks and Recreation Division shall: a. Provide league schedules in writing to the Association's Assigning Secretary no later than one (1) week prior to the beginning of the season. b. Give a minimum of forty-eight (48) hours notice of sche- dule changes for which officials have been assigned or a rescheduling fee will be charged. This notice does not apply to rainouts or other acts of God; such games will be rescheduled at no added charge. c. Provide the Association Assigning Secretary a tentative schedule on Friday, one (1) week prior to the scheduled tournament. This schedule may only include fields, locations, and time slots. d. Provide a final tournament schedule in writing the Tues- day prior to the scheduled tournament. e. Pay the Association for services rendered within thirty (30) days of receiving the bill. 3. The Association shall: a. Provide qualified and properly trained umpires to work all games requested by the City. b. Pay all umpires for games worked that are assigned by the Association. c. Notify the City's Athletic Coordinator of all "No -Show" umpires. Al]. expenses for lights, maintenance, and re- (agr/yvua) scheduling shall be paid by the Association when a "No - Show" occurs. d. Pick up written tournament schedules at the Parks and Recreation Office between 9:00 a.m. and 4:00 p.m. Final tournament schedules will be available on Tuesdays, no earlier than 4:00 p.m. e. Provide the City, at no charge, a schedule of umpires assigned to officiate tournament games. This schedule will be delivered to the Parks and Recreation Office no later than 2:00 p.m. on Fridays. f. Provide an itemized monthly bill to the Athletic Coordi- nator for services rendered. 4. Employment: Umpires referred to in this Agreement are em- ployees of the Association and not the City. The Association is solely responsible for compensating umpires and complying with all applicable laws related to such employment. 5. Hold Harmless: The Association shall defend, indemnify, and hold harmless the City, its agents, officers, and employees from any and all liability resulting out of the performance of this Agreement. 6. Consideration: As consideration for the services specified in this Agreement, the City shall compensate the Association according to the following schedule: League Games One Man Two Man Three Man *$15.12 **$18.24 Tournament Games Round Robin *$16.12 Double Elimination *$17.12 **$19.24 **$20.24 Rescheduling Fee $ 1.25 per game Association Fee **$30.36 $ .50 per game per umpire (for games following the completion of the Summer 1990 Slowpitch activity) * * Total Game Fee If umpires are available The Association shall bill in writing the City's Parks and Recreation Superintendent within thirty (30) days of providing - 2 - (agr/yvua) the above -referenced services. The terms of this Agreement shall be from January 1, 1990 to December 31, 1990.
