HomeMy WebLinkAboutR-1990-D5783 B & D Development / Class 2RESOLUTION NO. 1) 578-3 A RESOLUTION remanding the Hearing Examiner's decision, Exami- ner No. 190-1-26 concerning a Class 2 application by B & D Development in the vicinity of 2309 West Nob Hill Blvd. WHEREAS, on April 18, 1990, tbe Hearing Examiner held a hearing concerning an application made by B & D Development for a proposed retail and fast food development to be located in the vicinity of 2309 West Nob Hill Blvd., Yakima, Washing- ton; and WHEREAS, the Hearing Examiner issued his Examiner's Decision, City No. UAZO CL(3) *4-90, Examiner No. 190-1-26 on May 8, 1990; and WHEREAS, the notification of Hearing Examiner decision was mailed on May 10, 1990; and WHEREAS, the Nob Hill Neighborhood Coalition filed a timely appeal of the Hearing Examiner's decision and paid the appeal fee on May 24, 1990; and WHEREAS, the City Council at a public meeting on July 17, 1990 reviewed the record from the Hearing Examiner's hearing, the appeal of the Nob Hill Neighborhood Coalition and listened to argument for and against such appeal; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: This application is remanded to the Hearing Examiner and the Hearing Examiner is directed to specifically consider and discuss in a supplemental decision each of the first 21 con- cerns addressed by the Nob Hill Neighborhood Coalition in their appeal filed on May 23, 1990 a copy of which list is attached and incorporated. In addition, the Hearing Examiner is to consider and report in his supplemental decision his (res/remand) recommendations concerning fencing of the proposed construc- tion site during the construction phase of the project. ti ADOPTED BY THE CITY COUNCIL this Zi,Lday of 1990.
