A RESOLUTION authorizing. the City Manager and the City Clerk
of, the City of Yakima to execute a Memorandum of
Understanding regarding insurance coverages
between the City of Yakima and Yakima Valley
Visitors and Convention Bureau.
WHEREAS, the Yakima Valley Visitors and Convention Bureau
can purchase reasonably priced general liability insurance
coverage which names the City of Yakima as an additional
insured, and
WHEREAS, the amount of funding required for this general
11abilitl insurance is $4,034.00, and
WHEREAS, it is in the best interests of the City of
'akima to have such insurance coverage in effect, and
WHEREAS, the City of Yakima and Yakima Valley Visitors
and Con\ention Bureau desires to outline various insurance
coN,erages relating to the Yakima Convention Center and clarify
the responsibility for those coverages b‘ entering into the
attarhed ''lemorandum of Understanding, now, therefore,

MEMORANDUM OF UNDERSTANDING REGARDING
INSURANCE COVERAGES BETWEEN THE CITY
OF YAKIMA AND YAKIMA VALLEY VISITORS
AND CONVENTION BUREAU
The purpose of this memorandum is to outline the various insurance
coverages relating to the Yakima Convention Center and clarify the
responsibility for those coverages between the City of Yakima and
Yakima Valley Visitors and Convention Bureau(YVVCB).
Property Coverage
1. The City insures the Convention Center building, city -owned
contents and contents owned by the YVVCB as part of its property
insurance program subject to a $100,000 deductible. Any covered
claim to YVVCB property under the $100,000 deductible would be
paid from the City's self-insurance fund.
2. The YVVCB will require $100,000 of property damage/legal
liability coverage for individuals or organizations utilizing
the facility. This requirement is written in the current
license agreement for use of the facility.
Directors & Officers Liability Coverage
1. It is the responsibility of the YVVCB to obtain their own
directors & officers coverage. The City has no directors &
officers coverage for the YVVCB under it's self-insurance
program.
2. The City provides directors & officers coverage for the
Center advisory board under it's self-insurance program.

Commercial Liability Coverage
1. A commercial liability policy covering bodily injury and property
damage claims resulting from the premises or operations of the
Center at a limit of $1,000,000 will be purchased by the YVVCB.
The City will allow budget authorization in the Tourist Budget
Fund #170 to provide funding for the liability coverage. The
City, it's officers, agents, volunteers, and employees, will be
listed as a additional insured under this policy. The policy
will include non -owned automobile liability coverage.
2. Any claims or law suits in excess of $1,000,000 will be paid by
the City's self-insurance program. Coverage is provided for the
YVVCB as well as the City.
Fidelity Coverage
The City Fidelity Bond does not cover YVVCB employees. The
YVVCB is responsible for purchasing their own coverage in this
area.
Any modifications to this Memorandum of Understanding will be in
writing and agreed to by both the City of Yakima and the Yakima
Valley Visitors and Convention Bureau.

ORDINANCE NO.
AN ORDINANCE amending the 1990 budget for the City of Yakima; making an
appropriation of $4,034 to the Tourist Promotion Fund for
expenditure during 1990 for General Liability Insurance.
WHEREAS, the amount of $4,034 must be appropriated within the
Tourist Promotion Fund in order to provide funding for General Liabili-
ty Insurance; and
WHEREAS, at the time of the adoption of the 1990 budget it could
not reasonably have been foreseen that the appropriation provided for
by this ordinance would be required; and
WHEREAS, this General Liability Insurance will provide the City of
Yakima liability insurance in the amount of $1,000,000; and
WHEREAS, delaying coverage will be to the severe detriment of the
Cit.\ of Yakima if a liability claim occurs prior to coverage; and
WHEREAS, the City Council finds an emergency exists and that it is
in the best interest of the City to make the appropriation herein
provided, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The amount of $4,034 is hereby appropriated from the
Unappropriated Fund Balance in the Tourist Promotion Fund to account
number 170.170.325.0000-571.10-460 as a 1990 appropriation.
Section 2. This ordinance is one making an appropriation, an
emergency e\ists, and this ordinance shall take effect immediately upon
its passage, approval, and publication as provided by law and by the
City Charter.
