A RESOLUTION authorizing execution of a Memorandum of Agree-
ment with the United States Army Reserve.
hHEREAS, currently there is on public display at Elks
Park one United States Marine M60 Tank; and
WHEREAS, the City Council desires that said tank be moved
from Elks Park to Tahoma Cemetery where it is to be place on
public display; and
hHEREAS, the United States Army Reserve, the 737th Trans-
portation Company, has offered to move said tank from Elks
Park to Tahoma Cemetery, and
MEPEAS, the City Council deems it to be in the best
Interest of the public to authorize the execution of a con-
traLt w]th the Inited States Army Reserve to move the afore-
mentioned tank, rwlw, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA.

MEMORANDUM OF AGREEMENT
BETWEEN CITY OF YAKIMA
US Army Reserve, 737th Transportation Company
This agreement made this 6th day of June , 1990_,
between ghe City of Yaklaa . hereinafter referred to as

the "Performer," and 737th Trans Co.
to as the "Sponsor."
1. Sponsor has requested the Performer to move one US Marine

2. Under no circumstances will this proJect conflict with private
enterprise or compete with the civilian labor force.
3. Sponsor agrees to reimburse alt costs not directly attributable
to the normal training function of the Performer.
4. Sponsor agrees, at Sponsor's expense, to obtain all necessary
permits, give all necessary notices, pay all license fees, and to
comply with all municipal, state and national laws, rules, ordinances
and regulations, and any and all regulations promulgated by the
Commander, Sixth U.S. Army, or higher authority.
6. Sponsor agrees to Indemnify, save.harmiess, and defend the United
States (Including the Performer, its agents, representatives,
employees and members) from and against any and all claims, demands,
actions, debts, liabilities, Judgments, or any other costs, arising
out of, claimed on account of, or In any manner predicated upon loss
of or damage to the property of and tnJurles to or death of any and
all persons whatsoever, 'while In, upon or about the premises wherein
the protect is performed, or white going to or departing from the
same, and to indemnify and save harmless the United States (Including
the Performer, Its agents, representatives, employees, and members)
may suffer as the result of any acts In any manner caused by or
contributed to by the Sponsor, its agents, servants, or employees,
in connection with the performance of this agreement.
6. The Performer may, by written notice to the Sponsor, terminate
this agreement at any time.
IN WITNESS WHEREOF, the parties hereto have caused this agreement to
