'his Special meeting and Tour adjourned at 3:00 P.M. MINUTES SPECIAL MEETING'- YAKIMA CITY COUNCIL FEBRUARY 22, 1972 - 6:30 P.M. 'he City Council convened in special session pursuant to due notice at 6:30 P.M., February '2, 1972 in the Conference Room at Yakima City Hall. ouncilmen present at the meeting were Mayor Bert Broad, Wray Brown, Lenore Lambert, James d ust, Walter Robinson, Don Schussler and Bill Whitaker. Also in attendance were City Mana- ser McMicken, City Attorney Andrews, Director of Finance,,Leonard Crose and Administrative 'Assistant Jim Williams. 'finance Director Leonard Crose explained the City's monthly and annual :budgeting and re- , orting system to the City Council. . discussion followed regarding the history of City attempts to purchase freeway properties belonging to Cook -Lewis for sanitary landfill purposes. City Manager McMicken presented an istorical analysis and discussion ensued relative to the possible acquisition of the land. he special meeting adjourned at 8:00 P.M. REGULAR MEETING - FEBRUARY 22, 1972 - 8:00 O'CLOCK P.M. E'he City Council then met in regular session at the hour of 8:00 P .'.' M., Mayor Broad presiding Councilmen Brown,. Lambert, Lust, Robinson and Whitaker, City Manager McMicken and City At- torney Andrews present on roll call. Councilman Schussler absent on roll call. It was MOVED by Lust, seconded by Whitaker that Councilman Schussler be excused from this meeting: arried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye by voice vote. 'he minutes of the regular meeting o.f February 14, 1972, having been duly certified accurate .y two Councilmen, and no one present wishing to have said minutes read publicly, Mayor :road declared said minutes approved as recorded. 'his being the time fixed for the Hearing on Rezone Application filed by Standard Oil Com- .any, requesting rezone of property located at 308 North 5th Avenue, Jay Otto, Planning Di- lector, reviewed this matter referring to the Staff Report and the Planning Commission mi- utes. He stated that this is an application for a rezone from R -3, Multiple Family o B -3, General Business Zone and is requested to rebuild the existing - Standard Oil service tation. He reported that the Staff recommended approval of this request due to the fact hat the area is already developed in commercial uses and reconstruction of the existing - tation would not adversely affect surrounding land uses and the site plan will provide an .mproved means of ingress and egress from this facility. Mr. Otto further reported that the ilanning Commission unanimously recommended approval of the rezone subject to consideration i•eing given to adequately protecting the abutting residential property to the north insofar =s reflected lights in the parking area adjacent to the structure are concerned. After due ' .iscussion and there being no one present to speak for or against the rezone, it was MOVED i•y Brown, seconded by Whitaker that Ordinance No. 1386 accepting the recommendation of the ''fanning Commission and rezoning said property, be passed as read: carried, Broad, Brown, lambert, Lust, Robinson and Whitaker voting aye on roll call. Schussler absent. •RDINANCE NO. 1386, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 308 North 5th Avenue in the City of Yakima, Washington from R -3, Multiple Family Zone, to B -3, General Business'Zone. his being the time fixed for the Hearing on the Rezone Application filed by Mrs. Stella arvo and Others requesting rezone of property in the vicinity of 109 West Oak Street, Plan- ing Director Jay Otto reviewed this matter, explaining that Mrs. Carvo submitted an appli- ation requesting a rezoning of two vacant lots northeast of the intersection of Oak and forth Front Street from R -3, Multiple Family Zone to B -3, General Business`Zone to permit he storage of antique and "collectible" automobiles. He further explained that due to the - xisting land use pattern and the General Plan designation, the property north of the site as included in the advertisement and that the Staff and Planning Commission recommended ap- I•roval of the rezone of the area as advertised in that it conforms with the General Plan and ith general land use trends of the surrounding area. There being no one present to speak for or against the proposed rezone, and after due discussion, it was MOVED by Lambert, se- onded by Brown that Ordinance No. 1387 accepting the recommendation of the Planning Commis- sion and rezoning said property, be passed -as read: carried, Broad, Brown, Lambert, Lust, ''obinson and Whitaker voting aye on roll call. Schussler absent. •RDINANCE NO. 1387, AN ORDINANCE accepting the recommendation of the Planning Commission and ezoning certain property situated at 109 West Oak Street in the City of Yakima, Washington, from R -3, Multiple Family.Zone, to B -3, General Business Zone. • • • 323 FEBRUARY 22, 'An item -not on the Agenda, re Brule and Marshall Outside Utility Hookup and Planned Unit De- elopment, was brought to the attention of the City Council at this .time by•Jay Otto, Plan- ing Director. Mr. Otto referred to the fact that last October the City Council approved an outside Utility Agreement and Exhibit B requesting a :Planned Unit Development for Brule and arshall, and in December, •the City Council annexed this area. He explained that the legal advertising did not include the roadway and to rectify this the_ Boundary Review Board has •een - asked to amend their legal description to include the roadway. Mr. Otto asked that at this time the - Council authorize an amendment to Attachment B to Outside Utility Agree ent stating that the plan does conform to the General Plan -and the development would be compatible and that the Staff. and Planning Commission recommends this Multiple Planned Unit • evelopment. After 'due discussion, it was MOVED by Robinson; seconded by•Lambert that auth- orization be given to amend Exhibit B to the Brule - Marshall Outside Utility'Agreemeht in or- der to include the development of the remaining 14 acres as Multiple Family Planned •Develop - ent, the amendment and description to include the East 30 feet of.roadway:- carried, Broad, Brown, Lambert, Robinson and Whitaker voting aye by voice vote. Lust not voting. Schussler absent. • This'being the time fixed for the Hearing on the'Proposed Improvements of "B" Street and incoln Avenue, City Manager McMicken explained that he would speak to the matter first, then members of the Staff will discuss aspects that pertain to their particular department; e will speak again, and persons present will'have a chance 'to vbice their opinions. • r. McMicken reviewed the matter stating that about four years ago when the City adopted a revised Business District-Plan as a part of the General Plan; it included the "B" and Lin coln overpasses. He stated that the proposed improvement now covers the improvement of the railroad crossings, street improvement and proposed street cross sections including side - alks, travel' lanes, off- street parking and street -tree planting. Mi..McMicken explained that this project is. funded through U.A.B. and the City and the abutting property 'owners will not share any of the cost. He stated that this does not mean, however, that the local abut - ting property owners will not be.considered, that although this is' not a legal re- quired by the Council, it is the policy of - the City to give notice of a major street pro- ject, listen to the public and take the wisest course of action. Mr. McMicken reported that notices were sent to the'abutting property owners for the Commission Hearing and for this Council - Hearing. Stets Trees Jay •tto, :Planning Director, briefly.gave the•pianning background on project and dowed some slides taken on - "B•" ='Street and Lincoln.Avenue.. =. -Hestated that the Planning Commission una- nimously .recommended : that•.the -City Council• approve the m 13' Street :"and JLindoln Avenue`im- •rovemehts' as designed! and , fur.ther r'ecbmmended that the engineering staff be directed' to • accommodate, where possible and where internal building design - restrictions require, abut- ting property owners without compromising the street improvement. Dave Vargas, Public'Works 'Director showed charts'and•pictures and' gave a brief explanation of the proposed improve - ents, showing where the three traffic lanes on'.each street will be, the parking lanes, the sidewalks .and planters for the trees. He also stated that there will be traffic signals, odern drop .gates and• gongs. and' train-- >s-igi a1's`:'. Margas - explained - that .90 percent. ofr the cost of the project will be funded by U.A.B. the City will fiend 10:'percent and the roads will put'up $76,000 to• remove rails, - etc.- and'the total cost Will runabout $90,000. Al Ray, Traffic Engineer spoke about thevolumes of on the couplet system and on: alnut and Yakima Avenue, stating that the increase in one year on the couplet system was 31/2%-and 'remained about' the same - .on Walnut and Yakima AvenueJ. He• further stated that we now t ave/ inadequate railroad `signaIls and .traffic •signals and explainedtow the proposed: improved system will work. .. Dave' Vargas, Director of Works.., explained some : about"curbs . sidewalks',: that• the curbs are there as .a= safety factors, control- drainage; and -the -dge 'of the roadway Fritz Jaeger, City Engineer; reported• that• has approached .a 'number .f the - property-: owners . in . Sergeant Beaushaw stated that he had attended the AA 3 24 FEBRUARY. 22,: 1972 February 7, meeting of the Yakima Crime Prevention Council-and they endorse the proposed Ordinance. W. C. Schussler • absent. • ORDINANCE NO. 1388,: AN,ORD.INANC.E relating--to• building requirements; requiring and specify-- ing security .devices 'in• certain: buildings; providing for-enforcement and prescribing 'pen- alties for violatiOnsfjandiadding •Chapter 11.56, "Building Security "; as a new chapter of- the City of Yakima Municipal Code. • - -• - - . It was MOVED by Lust, seconded by Robinson that Ordinance No. 1389 relating to policy and • pay steps for City employees, be passed as•read: carried, Broad, Lambert, Lust, Robinson and Whitaker voting aye. on rol-1 call. Brown temporarily absent. Schussler- absent.' City Manager McMicken explained briefly the necessity for this Ordinance,- stating that in 1969: there was a program of pay for. Police officers-and Fire fighters which dropped off Step 1 and hired men-at Step 2, with. the raise to Step 3, after one year.• He explained further • that in 1970;•.'there was a comprehensive pay plan program -in which the salaries were in- creased, the beginning. Step •was put back to Step 1, -and,the first step increase 'to Step 2 was changed back to six months, which.change -was not put back-into the Code. Mr. McMicken stated' that 'this -oversight. had been discovered and brought to the-attention of Personnel' Director Martin Friedline, who had been working on correcting the - matter at the time of his death. Since-that time'-Mr. has discussed the matter with the Fire Fighters Union• and the Police' Patrolmens_Associ and the.'City'Attorney has prepared this Ordinance. Mr. McMicken reported that ±his. - will• mean retroactive .'pay in the amount of $990.00 for' five Police officers.and one who were hired in.'1971 and not 'raised to Step 2 after six months which should - have been done. . ORDINANCE-NO. 1389, -AN ORDINANCE relating to personnel-; establishing a policy for pay steps within salary ranges; and amending Section 2.2Q.'040' of the.'City of Yakima Municipal Code. City Manager .McMicken referred: to a matter -not on the Agenda•, ,'that -of awarding the annual bid for City Advertising. He reported that' in accordance with Resolution No. D =1803 pre- scribing a:form of. Agreements with the Federal Government.for Navigational facilities at the Yakima Municipal Airport, to City Attorney Andrews who explained :United States America, Department of Transportation, Federal Aviat-ion installed various navigational facilities at the Yakima Municipal Airport in accordance with-two agreements which.exp'ire June 30, 1972 and it -is necessary to-renew these lease agreements -which are identified as-Lease No. DOT -FA- 72WE -1804, Localize•r and Lease No. DOT= FA72WE -1805, Glide Slope. States of America, Department of- Transportation•, Federal-Aviation Administration, for navigational facilities at Yakima Municipal Airport•. • • City Manager McMicken referred the-matter of' authorization to hire professional legal ser- vices for pending condemnation actions to City Attorney-Andrews, .who explained that in con - nection- with .th'e C•ity''s contemplated 'public improvement projects consisting of the widening and improving of a portion: of Nob -Hill Boulevard and the-widening and improving of a por- tion of Mead - Avenue, and the passage of Ordinances No. 1379 and 1380 by the City Council on January 24, 1972, authorizing.condemnation actions to acquire right of way for said pro- jects, part of the property outside the.City limits and it is" desirable for-the City to engage Independent professional legal services for this purpose. He further explained that Lyon, Beaulaurier, Aaron. &• Weigand, Attorneys.- at Law; have offered - perform-these legal services' in. accordance with the provisions of-a letter' of proposal, and.recommended that the Council•authorizer,thel, hiring of said professional legal services. D- 1818,-A RESOLUTION engaging-professional legal services of Lyon, Beau - laurier, Aaron-& Weigand, Attorneys at Law, for condemnation•of property for widening and improving Nob Hill-Boulevard and Mead Avenue. • • City Manager McMicken explained that the matter of retroactive pay to 21 City employees whose wages, were limited, and 10 employees whose longevity pay was limited by the Wage Pric:,• Freeze., does' not require Council action, but is .presented as a matter bf information. He' stated that authorization <h'as now been given pay certain persons that were affected by :325 FEBRUARY 22, 1972 the Price Freeze, which were those whose 'increases had been agreed to in an Employment Contract that was established prior to August 15, 1971, and this will affect 3.1 City emplo- yees in the amount of $1186.00. After due discussion, it was MOVED by Robinson, seconded by Lust that said payment to these City employees be approved: carried, Broad, Brown, Lam- bert, Lust, Robinson and Whitaker voting aye by voice vote. - Schussler absent. City Manager McMicken referring to the City Engineer's Report on the completion of• L.I.D. No. 981, McCargar's Westside Tracts & Others Paving District, it was MOVED by Robinson, seconded' by Lambert that March 20, 1972, be fixed as the time for the Hearing on the Assess- ment Roll for said District: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker S voting aye by =voice vote.'
