The Invocation was given by Councilman Lambert. • The minutes of the regular meeting of February 7,- 19.72, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. • This being the time fixed for a Hearing on Petition No. 726, filed by Franklin P. Kinder, Jr. and Others, requesting annexa.tion'OI property situated at South 32nd and Carol Avenues, Planning Director Jay Otto, explained that this request for annexation is for a 7.51 acre site, 45 per cent of which is presently developed as single family residential. He further explained that the petitioners intend to develop the remaining portion of the subdivision with custom built single - family dwellings. He indicated that except for the orchards lo- cated north and southeast of the subdivision, the entire surrounding area has been developei as single- family residential, and that the General Plan indicates the area in the vicinity of the proposed annexation. low density residential. This being the time fixed for a Hearing on Petition No. 727, filed by. Douglas and Cecelia Gordner, requesting annexation of property situated at 1805 Grant Street, Planning Director Jay Otto reported this applicant has submitted an application for annexation of a single - family residential lot that is a portion of an unincorporated island located within the citl limits of Yakima. He explained that Mr. Gordner has requested an outside utility agreement due to septic tank failure and the City Council approved the connection on- January 3, 1972. Mr. Otto, Planning Director, reporting that the Planning Commission and Staff recommend the annexation of property at 1805 Grant Street with zoning of R -2, Two Family Zone to conform with adjacent zoning, it was MOVED by Brown, seconded by Lust that Ordinance No. 1384 an- nexing said property, be passed as read: carried, Broad, Brown, Lambert and Lust voting aye on roll call. ORDINANCE NO. 1384, AN ORDINANCE annexing property to the City of Yakima, and zoning said • property. • Petition No. 733, having been filed with the City Clerk on February 11, 1972, by Birdie Sliger and Others, requesting installation of a street light on "A" Street, midway between - Naches Avenue and 6th Street, it was MOVED by Lambert, seconded by Brown that said petition be referred to the City Manager and Staff for study and recommendation: carried, Broad, Brown, Lambert and Lust voting aye by voice vote. Robinson, Schussler and Whitaker absent. An Ordinance appropriating $1,900,000 to various accounts in the Park and Recreation Capital Fund and appropriating $1,100,000 to various accounts in the Fire Capital Fund, having been read in its entirety on February 7, 1972, and being read by Title only at this meeting, it was MOVED by Lust, seconded by Brown that Ordinance No. 1385 appropriating $1,900,000 to various accounts in the Park and Recreation Capital Fund and appropriating $1,100,000 to various accounts in the Fire Capital Fund, be passed as read: carried, Broad, Brown, Lambert and Lust voting aye on roll call. ORDINANCE NO. 1385, AN ORDINANCE appropriating $1,,900,000 to various accounts within 331- ' Park and Recreation Capital Fund, and appropriating $1,100,000 to various accounts within 332 -Fire Capital Fund, to ..authorize expenditures of proceeds from the sale by the City of "Various Purpose General Obligation Bonds, 1972 ". City Manager McMicken reported that the Planning Commission has met and discussed the pro- posed improvement of "B" and Lincoln Avenues between First Street and Third Avenue. He 319 • • FEBRUARY 14,1972 • further reported that after a.. great deal Of discussion considering encroachments, cross sec tions, street trees, curbs, sidewalks'and off street parking,. the Planning Commission has recommended approval of, the project with one consideration, that the abutting property owners be considered and that the engineers work with them at some.length to satisfy their needs as to. ingress and egress.. .He stated that there has been a great deal of concern ex- pressed by property owners indicating that the curbs and gutters would seriously hamper the loading and unloading of semi - trucks and straddle trucks at the .fruit warehouses and other businesses. Council members indicating that they would like to have a public hearing on this matter, it. -was MOVED by Lust, seconded by Lambert that the time for a Hearing on the Lincoln and "B" Street at -grade crossings be set for February 22 ;'1972 at 8:00 R.M.: car- , ried, Broad, Brown, Lambert and Lust voting aye by voice vote. City Manager.McMicken.referred :.the matter of authorization to execute a.Cancellation Agree- ment with the Federal.Aviation Administration, cancelling a lease of space in the City .Cen- tral Building at. Yakima Municipal Airport, to City - Attorney Andrews, who explained that the original lease agreement dated'February 19, 1964, has been superseded by a lease agreement which became effective October 15, 1971; so that the earlier lease agreement should be can- , celled. D- 1809., A RESOLUTION_ authorizing the City Manager and City Clerk of the City of Yakima to execute a Cancellation Agreement with the Department of Transportation, Federa Aviation Administration, United States of America, to cancel the lease of space in the City Central Building at Yakima Municipal Airport. • City McMicken referred the matter of authorization to execute a Supplemental Lease Agreement with the Federal Aviation Administration, covering office space in the Weather Bureau Building at the Yakima Municipal Airport, to City Attorney' Andrews, who explained that the original lease covering space utilized • by the Airway Facilities Sector office, calls for an annual rental payment of $2,400'<'to be .p'aid at the end of the Government Fiscal Year. He further explained that when that license was granted, there was a stipulation license fee, and leg.islation_ has been passed which requires airports of the kind we have to provide space free of charge for these navigational purposes. City Manager McMicken reported that in accordance with action.taken.at.. the previous meeting of February 7, 1972, necessary legislation has been prepared to execute an Agreement for Technical Services with Pacific Northwest Laboratories, a division of Battelle Memorial Institute. D -1813, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an Agreement For Technical Services with Pacific Northwest Laboratories, a division of Battelle Memorial Institute. • W4� • FEBRUARY 14, 1972 City Manager McMicken explaining• that a Contract with Book Publishing Company for printing and codifying .City Ordinances, is, up. for renewal and that the City deems .it in the best in- terests that said .contract be renewed and extended, it was MOVED by Lambert,. seconded by Brown that 'Resolution No,. D- .1814. authorizing the City °Manager to execute said contract with Book Publishing Company, be passed as read: carried, Broad, Brown, Lambert and.Lust voting aye on roll call. Robinson, Schussler and Whitaker absent. .'Discussion indicated that this contract is for. three ye,ar.s.. RESOLUTION NO. D -1814, A,RESOLUTION authorizing the City Manager and City Clerk to execute a contract with Book Publishing Company. City Manager McMicken reporting that the proposed irrigation maintenance assessment roll for 1972 has been filed with the City Clerk, it was MOVED by Lust, seconded by Brown that Reso- lution No. D -1815 fixing March 13, 1972,' as the date of Hearing to confirm said assessment roll, be passed as read: carried, Broad, Brown, Lambert and Lust voting aye on roll call. Robinson, Schussler and Whitaker absent. Mr. McMicken explained that the proposed assess- ments are the same as last year. . RESOLUTION NO. D -1815, A RESOLUTION setting a date for hearing on the confirmation of the irrigation maintenance assessment roll the year 1972. City Manager McMicken explaining that parts were purchased for the repair of graders for emergency snow removal purposes and recommending that authorization be given to ratify said purchase without.'calling.for bids, it was .MOVED by Brown, seconded by -Lust that Resolution No. D -1816. ratifying the' purchase of said parts, without calling for bids, be passed as • read: carried, Broad, Brown,. Lambert and' Lust voting aye on roll call. Robinson, Schussler and Whitaker absent. RESOLUTION. NO. D -1816, A RESOLUTION ratifying the purchase of parts, without calling for bids, for the repair of graders fo'r.snow removal purposes. • City Manager McMicken reported that a citizen has protested the manner in which public no- tice its given for hearings on the vacating of property. He explained that.City Attorney Andrews has reported that. notices given to date have been as prescribed by state law and that is by posting on the property to be vacated. He further explained that it may be harm - ful_ito work against the. statute and set up our own procedural steps. .However, he did sug- gest that we could go one,. step. farther.and mail post cards to everyone within 300 feet of the property to be vacated. Council members indicated that the. added step was agreeable. City Manager McMicken reported on new hirings under the Public Employment Program. He- stated that our full allotment currently is 19 positions, and we are currently recruiting for a Laborer I (mechanic) ,-for the city Garage,' the person holding that P.E.P. position on ginally, having been terminated. He further stated that the County P.E.P. administrators have informed him that our request for five additional positions,will likely be approved, those positions including three Laborers to work on Fruitvale Canal maintenance and two more Police Cadets. .He explained that the three.Laborers will be project oriented and will work until federal funding expires, and the Police Cadets, part of a program to bring more minorities into the department,' will be required to go through usual channels for entrance into the department following their cadet experience. He further explained that our record for -Viet Nam veterans, the handicapped, the underprivileged, and minorities is ex- . trembly good, and we have'also complied'fully with standards as set forth by federal and • local authorities. . City Manager McMicken reported that. he has written to Randall B. Kester, General Solicitor of.,-the Union Pacific Railroad ny and sent him a copy of his report #141 Yakima Valley ' Transportation Company Franchise Renewal and has advised him of the Council's desire to have the railroad participate :financially and cooperate in this matter. • City Manager McMicken reported that a letter has been received from Carl Julius, Gray & Osborne, Consulting Engineers, regarding the Town of Union Gap and the City of Yakima's Sewage Treatment Plant.. -.Mr. Julius reports.that they are in the process of updating the Engineering Sewage.Treatment for the Town of Union Gap, and to be eli- gible for Federal Construction Grants, one of the requirements of- E. -P.A. is "an Engineering determination.of the most cost - effective method of disposing of the sewage for each entity" to be included in the.Engineering Report. Mr. Julius further reports that to comply with this requirement, they propose to evaluate the cost comparison between Union Gap expanding its sewage treatment' plant or pumping raw sewage to Yakima's plant for treatment. • Mr. Mc- Micken explained that Gray &.Osborne wish to be .advised if the City of Yakima will'accept Union Gap's raw sewage for treatment at Yakima's plant, and if so, what would be the charge • and conditions. to Union Gap for treatment and' what portion of the cost of future treatment plant expansions in. Yakima -would Union Gap bear. He further explained that we have also re- ceived similar requests from Terrace Heights and Lower Naches, concerning our Sewage Treat- ment Plant. Mr'. McMicken.suggested.a hearing be held on this matter. Council members in- dicated they would like to have some. time discuss the subject thoroughly before a hearing takes place. No formal was taken. Mayor Broad reporting,that Thomas F. Hargis,.Jr.'s term on the Yakima Housing Authority ex- pired February 1, 1972 and.. that' Mr. Hargis is willing to serve another term of five years, it was MOVED by'Lust, seconded by Lambert that he be reappointed for a term of five years on the Yakima Housing Authority: carried, Broad, Brown, Lambert and Lust voting aye by voice vote. - Robinson; Schussler and Whitaker absent. • Mayor Broad reported that at the Parks and Recreation Commission meeting of February 8, 1972, the following recommendations were made concerning terms of office for new officers: ' 1 year term 1/1/72 - 1/1/73 Ruby J. Dobbs 2 year terms 1/1/72 - 1/1/74 George P. Shuford and J. S. Applegate 3 year terms 1/1/72 - 1/1/75 • -.Mary Williams and Bob Di Pietro 4 year terms. 1/1/72 - 1/1/76 Richard Parker and Mer P.
