WHEREAS, the Parks and Recreation Division of the Public Works Department lacks sufficient personnel to conduct supervised playground activities in City parks during the summer of 1990; and WHEREAS, the City Council deems such activities to be healthy and beneficial for the youth of the City WHEREAS, the Young Men's Chnstian Association of Yakima, a Washington non-profit corporation, currently employs staff skilled in conducting organized youth activities, now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized to execute an agreement between the City of Yakima and the Young Men's Christian Association of Yakima for Youth Activities, a true copy of which is attached hereto and whole a part of this resolution. ADOPTED BY T1 E CITY COUNCIL this e -D-day of May, 1990 (c) \eYeA,-,c-e," MAYOR A'iTEST: i<eti , G✓► -ti c - CITY CLERK LegaUbd Resolutions RES YMCA AGREEMENT BETWEEN THE CITY OF YAKIMA AND THE YOUNG MENS' CHRISTIAN ASSOCIATION OF YAKIMA FOR YOUTH ACTIVITIES This agreement is entered into by and between the City of Yakima, hereinafter called "the City" and the Young Mens' Christian Association of Yakima, a Washington non-profit Corporation, hereinafter called "YMCA". The parties mutually agree as follows: 1. The YMCA is skilled in providing recreation programs for youth. The City wishes to contract with the YMCA to provide a summer time youth recreation program, hereinafter called "program", in City parks. 2 The program shall start June 18, 1990, and end on August 17, 1990. The Program will not operate the week of July 4, 1990. The program shall consist of daytime youth activities conducted by the YMCA in City parks, including but not limited to: sports, arts, and crafts, dramatics, music and organized games. The purpose of the program is to provide wholesome leisure activities for City youth. 3. The program shall operate Monday through Friday during the mentioned program dates. There shall be two program sites at which the YMCA shall perform its services at the following times each day: from 9:00 am to Noon; the other two program sites: from 1:00 to 4:00 pm. 4. The program sites shall be: Gardner Park, Martin Luther King Park, Garfield School, Miller Park and Franklin Park. The YMCA shall schedule the program at each site in accordance with paragraph 3. 5. The City shall provide to the YMCA keys to the storage areas at the selected parks. 6. The YMCA shall be responsible for the total planning and implementation of the program, including staff, equipment, supplies and promotion. However, the YMCA shall provide a minimum of two staff persons at each site during program hours. 7. The YMCA shall promote the program and include in all promotional material and information the statement "Funds for this program are provided by the City of Yakima Parks and Recreation Division." 8. The YMCA shall return all equipment purchased with City funds under this agreement to the City at the conclusion of the program. All such equipment is and shall remain City property. 9. By June 30, 1990, the YMCA shall bill the City Parks and Recreation Manager, for supplies and equipment purchased for the program in an amount not to exceed one thousand one hundred seventy five dollars ($1,175). 10. At the conclusion of the program, but not later than September 30, 1990, the YMCA shall bill the City Parks and Recreation Manager for its expenses in providing the program which amount shall not exceed, COUNCIL/PARK.8 seven thousand .ninety. four dollars ($7,094). The amount billed according to this section shall be the entire compensation due the YMCA. 11. The City shall pay the YMCA within 30 days of receiving the aforementioned bills. All bills shall be sent to the City Parks and Recreation Manager, 2301 Fruitvale Blvd., Yakima, WA. 98902. 12. The YMCA shall provide a minimum of one million dollars of general liability insurance covering the program by the beginning of this agreement and naming the City, its agents, officers, and employees as insured. Such insurance will remain in full force and effect during the entire term of this agreement. The insurer shall notify, in writing, the City of any termination of such insurance at least twenty (20) days in advance. 13. At the conclusion of the program, but no later than September 30, 1990, the YMCA shall provide a written program report and evaluation to the City which shall, at a minimum, contain attendance figures per site per day, an analysis of program activities and an overall program evaluation including recommendation for future programs. 14. The term of this agreement shall be from June 1, 1990 to October 1, 1990. 15. The YMCA shall defend, indemnify and hold harmless the City, its officers, agents, and employees from any all liability arising out of the performance of this agreement. 16. All staff provided by the YMCA are employees solely of the YMCA. The YMCA is solely responsible for the wages and benefits of such employees.
