The - City Council convened in special session pursuant to due notice, at 1:30 P.M., February 7, 1972, in the Conference Room at Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Lenore Lambert, James Lust, Walter Robinson, Don Schussler and Bill Whitaker. Also in attendance were City Mana- ger McMicken, City Attorney Andrews and Director of Planning and Community Development, Jay Otto, along with Jim Bowers, reporter for the Yakima Herald Republic. . The Council discussed a letter recently received from Yakima County Commissioners concernin• the City's policy for extending City utilities outside City limits. After some discussion, the concensus of the Council was that the existing policy should not be modified at this time. . City Manager McMicken advised of the retirement of John S. Villesvik as a member of the Building Code Board of Appeals and recommended Architect Richard Doudna to be appointed for that position. The Council concurred with the recommendation, with such appointment to be made at the regular meeting to be held on this date. The special meeting adjourned at 3:00 P.M. REGULAR MEETING - FEBRUARY 7, 1972 - 3:00 O'CLOCK P.M. The City Council then met in regular session at the hour of 3:00 P.M., Mayor Broad presi- ding, Councilmen Brown, Lambert, Lust, Robinson, Schussler and Whitaker, City Manager Mc- Micken and City Attorney Andrews present on roll call. The Invocation was given by Mayor Broad. The minutes of the regular meeting of January 31, 1972, having been duly certified accurate . by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. Petition No. 729, having been filed with the City.Clerk on February 1, 1972, by Pay 'N Pak. Stores, Inc., requesting annexation of property situated East of South First Street and North of Lindy Lane, it was MOVED by Robinson, seconded by Lust that the Petition for An- nexation filed by Pay 'N Pak Inc., being Petition No. 729, be approved as meeting the - requirements of law; that said Petition be referred to the City Manager and Planning Commission for study and recommendation; and that March 20, 1972 be set as the date for a public hearing by the City Council on this Petition: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Petition No. 731, filed by Arthur R. McManigal and Others, requesting improvement of pro- perty by the construction of curbs, gutters and surfacing of streets in vicinity of Carol Avenue and Petition No. 732, filed by Arthur R. McManigal and Others, requesting improve- ment of property by the construction of a sewer in Franklund's Pear•Blossom•Additionsaid petitions having been filed with the City Clerk on February 1, 1972, it was MOVED by Schus- ' sler, seconded by Brown that Petition Nos. 731 and 732, for the creation of Local'Improve- ment Districts, be referred to the City Manager and Staff for study and recommendation: car ried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vot =. Damage Claims having been filed with the City Clerk on January 31, 1972, by William F. Melang, Jr., 1017 South 9th Avenue, in the amount of $32.03 for damages to his automobile caused by a City street sander and on February 3, ;1972, by John Marco, 202 Ahtanum, in the amount of $500,000 for an unlawful arrest, it was MOVED by Lambert, seconded by Robinson that said Damage Claims be referred to the City Manager and Staff for study and recommenda- tion: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. ; ' _ _ : .• ... .} L . • . • _ . An Ordinance appropriating $17,100 from the unappropriated funds of the General Fund to the Police Department, having been read in its entirety on January 31, 1972, and being read by Title only at this meeting, it was MOVED by Brown, seconded by Schussler that Ordinance No. 1382 appropriating $17,100 from the. unappropriatedifunds of.the•_General.Fund to the-Police Department, be passed -as :read: carried, Broad,.Brown, Lambert, Lust, Robinson.,.Schussler and Whitaker voting aye on roll call. ORDINANCE NO! 1382, :AN.ORDINANCE appropriating the amount of..$17,100 unappropriated money of the General Fund to Account 527.10.31 of the 1972 appropriation for 031 - Police De- partment. An Ordinance appropriating money to various accounts within Park and Recreation Capital Fund and appropriating money to various accounts within Fire!CapitalFund having been read in its entirety at this meeting, was laid on the table for one week or until February 14, 1972. City Manager McMicken explained that these appropriations in the amount of $1,900,001 and $1,100,000 respectively, are for the purpose of providing authorization for the expendi ture of the proceeds of the' "Various Purpose General Obligation Bonds, 1972" for the ac- quiring, constructingand installing of capital improvements within the Park and Recreation and Fire Departments. - A letter was received by the Council from Mr.. and Mrs. Leslie-Campbell, 1224•South•24th Avenue, which expressed appreciation for the fine work done by the City on the :South:24th Avenue Improvement project. The Council acknowledged: this letter and stated their•grati fication. • . . .. . .. City Manager McMicken reported that we have received a request from Lincoln Heights Water Company signed by Colonel George W. James, Secretary- Treasurer, asking the City to assume the maintenance and operation of this irrigation district. He explained _that this district, which is ten acres in area, runs from 35th Avenue west to 4Oth.Avenue•and from Lincoln Ave- nue north to Yakima Valley Canal. He further explained that the district has a water right of 14 shares in the Yakima Valley Canal Company, which sould allow for ample supply. Mr. McMicken indicated that Director of Utilities, Frank Stein, has investigated the system, and reported that the system cost would be at the rate of 17 per 100 square feet of area, which would be approximately $25 per year on an average lot. He further indicated that we would serve this district in the manner we do 45 other irrigation districts in the city, and that the Staff recommends accepting the request of the Lincoln Heights Water Company. Mr. James, being present, stated that the billing charge will be considerably more with this change, but the over all service would be more effective. After due discussion, it was MOVED by Robinson, seconded by Schussler that the appropriate legislation be prepared auth- orizing the City to assue maintenance and'operation of the Lincoln Heights irrigation sys- tem.: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. City Manager McMicken referred to his report #141 Yakima Valley Transportation Company Fran- chise Renewal. He gave a brief summary of the extent of the YVT operation, and spoke on the matter of the present 25 -year franchise, which expired November 5, 1971. Mr. McMicken ex- plained that at that time Randall B. Kester, General Solicitor of the Union Pacific Rail - road : Company, owner of YVT, took the opinion that the City could not refer: this franchise to the electorate, rather it had to be acted on by the City Council, and the City Attorney has concurred with this opinion. He further explained that a renewal of the YVT franchise has not been acted upon because there have been several problems relative to the YVT situa- tion (1) the City's legal authority to terminate its franchise with YVT, (2) YVT's impact upon motorists and pedestrians, and (3) the responsibility for payment of the costs of moving•YVT's tracks on West Nob Hill Boulevard when that street is widened - as planned. Mr. McMicken indicated that in resolving these problems, the following alternatives are open: 315 FEBRUARY 7, 1972 ' t (1) renew the existing franchise as the Railroad proposes; (2) renew the franchise for a shorter term and increase the fee, (3) issue a license under the same terms as the franchise for approximately a year to afford time for study and negotiation on the several issues re- lating to the problem,. and' (4) fail to renew the franchise and take legal •steps to have YVT vacate the street right of way. Mr. McMicken stated that -he feels alternative three is the most favorable, and he recommends the execution of a contract with Battelle- Northwest, a research and development organization in Richland, to conduct a proposed research program. ' ' He further stated that the objectives of this study would be to assess alternative rights of way and operating procedures in order to improve traffic control and safety on the affec- ted streets, and to review and analyze the economic contribution-of the rail system for the Yakima area. He reported that this study would take six months at a fee of $9,000 to be paid by the City from • contingency funds. He further reported that the Railroad would be requested to participate and cooperate, the City Attorney 'would work.closely with the. Bat- telle study team, providing. legal opinions-on issues as.• appropr:iate:; and a special: citizens' committee would help establish public opinion regarding the YVT system. A. J. Scott, Mana- ger Sponsor Relations of Battelle, being present, indicated that the best approach to the YVT problem would be to conduct a survey which will consist of two parts: one which assesses a cross- section of city opinion, and one which concentrates on viewpoints of citizens:living close to the right of way.• He further indicated that Battelle would evaluate the economic. impact of the railroad on the local area., He reported that his•firm would dispatch a spe- cial four -man team to Yakima•to study.YVT operations. Mr. Jean. R. Allard, 416 South.15th • Avenue, being present, spoke against Battells's proposal for a solution of the YVT franchise question. He stated that the hiring of Battelle would reinforce the one position the City can take, a renewing of the franchise, and that Battelle.'s proposal contained no alternative methods of transportation. He further spoke against the choice of. the Yakima Chamber of Commerce to organize the citizen's committee, as recommended in.the City Manager's report. Mr. Robert Gore, representing Union Pacific Railroad Company, being present, indicated that his company would have representatives discuss the YVT Council members :indicating that the proposal for a study by Battelle should be studied by YVT and Union Pacific Rail- • road Company before a decision is. made, it was MOVED by Schussler,.seconded by Robinson that this matter be° delayed for one month in order to do this:.carried,.Broad, Brown, Lambert, • Lust, Robinson, Schussler and Whitaker 'Voting 'aye! :by voice vote. • • City Manager. J lie re- ported that the Federal Government has been concernedabout the environment of man and ?his :• - living conditions, and there is a definite trend now to transfer some of the scientific re- search and development to people and cities. He further reported that bringing technology into city' governmentsr.'i•s not new.. Her:indicated'.that if the . City "of .Yakima is to make.. an effort toward transfer of technology to its operations, we need either ascientist on 'the. staff or a consultant who can represent the scientific community. Mr. McMicken further in- dicated: that:•he :.Battelle - Northwest :.omthis matter: and: theyl.have an initial six-{month's trial-.pr.ogram,. which- calls: for a..science /technology broker (Mr. ,A. J. - Scott) to•. spend approximately:.fo.ur.•days:.per :.month :.aimed at uncovering._-areas. to be :pursued for future technology transfer. He stated that the program= c.ostof $6000_would=.be• shared equally between the City and Battelle. 'Mr. McMicken implied that in accepting this idea, • the City Council should be !aware: that results - :should be measured. in -.terms : of long range benefits and, as with all research efforts, :•a high -degree •of` r•i•sk. =:is involved. Scott, being present, indicated that Battelle - Northwest has identified the field of regional and local government as a potentially significant area in :which research and development ,• efforts can_show major benefits. Purvis,- President of Purvis.-Construction. and Millwork, Inc., has submitted an outside utility request for service to property located on the west side of South 12th Avenue approximately 155.feet south of the intersection of Pierc- Street, and that this application is for domestic water and -sewer to serve a 17 -unit apart- ment complex. He further reported that Pay "N Pak Stores, Inc., has submitted an outside utility request for service property located northeast of the intersection -of Lindy Lane and South lst.Street, and that this application is for domestic water to serve a single store, facility.: The Planning Staff recommending approval of said outside utility requests, it was MOVED by Robinson, seconded by .Schussler -that said.outside services. be approved in accor- dance with the recommendation of the Planning. Mayor Broad explained that as a part of the activities on "Jack Larson Appreciation Day ", . the Mayor of.Itayanagi, Aomori -Ken, Japan, Mayor Bert Broad and former Mayor Jack Larson have signed an agreement. for the establishment of a.sister relationship between the City of Itayanagi and the City of Yakima.
