JANUARY 31,. 1972
Pursuant to a ,call by. the Mayor, a special 'meeting . of' the Yakima .City.: Council was .held 'at
1:30 P.M. in the. Conference Room °•at Yakima City Hall. ..
Councilmen present at the meeting were: Mayor Bert Broad, Wray Brown, Lenore Lambert., James II
Lust, Walter Robinson, Don Schussler and Bill Whitaker. Also in atterndance.wasiCity Manager
McMicken.
The Council discussed appointments to• various .City.Boards and Commissions.; :Final appoint-
ments were to be made at the regular Council meeting.:
The progress of ticket sales for Jack'.Larson Appreciation Day, February'3,.was discussed. .
Mary Hals, Secretary to the City Manager, reported the progress.
A letter from County Commissioner Les :Conrad regarding the extension of sewer service into
outlying areas was circulated and discussed by Council members.

A planned tour of City .Hall was postponed until after the regular Council meeting.
The special meeting adjourned at 3:00 P.M.

The City Council then met in regular session. at the hour of 3:00 P.M., Mayor Broad presiding,
Councilmen Brown, Lambert, Lust, Robinson, Schussler.and Whitaker, City Manager McMicken and
City Attorney Andrews present on roll call.
The Invocation was given by Councilman Lust.
The minutes of the regular meeting of January 24, 1972, having been duly certified accurate
by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor
Broad declared said minutes approved as recorded.
Petition No. 726, filed by Franklin P. Kinder, Jr. and Others, requesting annexation of
property situated at 32nd and Carol Avenues and Petition No. 727, filed by Douglas and Ce-
celia A. Gordner, requesting annexation of property at 1805 Grant Street, said petitions
having been filed with the City Clerk on January 25, 1972, it was MOVED by Lambert, se-
conded by Brown that each Petition be approved as meeting the requirements of law; that said
Petitions be referred to the City Manager and Planning Commission for study and recommen-
dation; and that 14, 1972, be set as the date for a public hearing by the City
Council on these Petitions: carried, Broad, Browri, Lambert, Lust, Robinson, Schussler and
Whitaker voting aye by voice vote. i
Petition No. 729, Notice of Intention to Commence Annexation Proceedings, having been filed
with the City Clerk on January 25, 1972, by Halvor Knudtzon, Jr., Secretary- Treasurer, Pay
'N Pak Stores, Inc., requesting annexation of property situated East of South First Street
and North of Lindy Lane, and Mr. Wally Tesch, Manager of Yakima Store, having been autho -.
rized in writing to represent Pay 'N Pak Stores, Inc., it was MOVED by Robinson, seconded
by Schussler that this date be set as the time for a meeting with the initiating party who
signed the Notice of Intention to Commence Annexation Proceedings dated January 25, 1972:
carried, Broad, Brown, Lambert, Lust, Robinson, _ Schussler and Whitaker voting aye by voice
vote. Mr. Tesch, representing Pay 'N Pak Stores, Inc., being present and indicating that
his company is willing to assume their share of the City's existing indebtedness, it was
duly moved, seconded and passed that the annexation proposed by petition no. 729, (Notice of
Intention to Commence Annexation Proceedings) be accepted by the City of Yakima and that
the area sought to be annexed be required to assume its share of the City's existing in-
debtedness, and that a notice of Intention to Annex be filed with the Yakima County Boundary
Review Board. The above MOTION was made by Robinson, seconded by Whitaker and carried,
Broad, Brown, Lambert, Lust, Robinson, -Schussler and Whitaker voting aye by voice vote.
Petition No. 730, having been filed with the City Clerk on January 27, 1972, by Robert E.
Dolson, requesting improvement of property by the paving of an alley between 2nd and 3rd
Streets, "D" Street to "E" Street and a'Resolution of Intention to create a local improve -
ment district, having been prepared, which includes this Petition and Petition Nos. 679,
685,705, 716, 718, 725, and 728, it was MOVED by Robinson, seconded by Schussler that Re-
solution No. D -1798 being a resolution of intention to create a local improvement district
in said vicinity and fixing the time of hearing for February 28, 1971, be passed as read:
carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll
call.
RESOLUTION NO. D -1798, A RESOLUTION of intention to create a local improvement district.
An Ordinance appropriating money from the unappropriated funds of the General Fufid to the
Police Department, having been read in its entirety at this meeting, was laid on the table
for one week or until February 7, 1972. City Manager McMicken explained that this appro-
priation in the amount of $17,100 is necessary to provide payment to Yakima School District
#7 of the proceeds from Law and Justice Grant #536 Youth Guidance Program. He further ex-
plained that this appropriation is to be funded by new revenues to be received from the Law
and Justice Grant #536.
City Manager McMicken reported on authorization to execute an Agreement with Richard Caro -
ther:sAssociates, for landscape architectural services for partial development of Randall
Park. He explained that we are ready to go ahead with Phase One, Schematic Design Phase,
of Randall Park; in which the architect would (1) accomplish necessary and reasonable site
inspections, interviews, research, analysis and master plan (if any) reviews, (2) prepare
and present large scale studies and sketches of the location, size and proposed grades of
improvements, and. (3) prepare estimates of cost of construction and installation based on

current area volume or other appropriate unit costs,:. He further explained that the total
estimated construction *cost is $174,972 and the architectural fees will be a percentage
based on the construction cost of all work on which drawings are prepared; also, the fee
and payment for any additional work shall be $25 per hour for the principal landscape ar-
chitect and $18 per hour for the associate landscape architect. Mr. McMicken discussed
the possibility ,of state. matching funds on this project and stated that the state has com-
mented favorably on Randall Park. He recommended that we 4o ahead with the agreement with
Richard Carothers Associates, understanding that the development of the park may be two or
three years in the future. Councilman Robinson requesting that the "Schedule of Fees for
Professional Services" FEE SCHEDULE be included in or attached to the agreement, it was
MOVED by Robinson, seconded by Whitaker that this matter be continued for one week or unti"
February 7, 1972 in order that this may be done: carried, Broad, Brown, Lambert, Lust, Ro-
binson, Schussler and Whitaker voting aye by voice vote.
City Manager McMicken referred to the matter of authorization to execute an Agreement with
Olson - Richert - Bignold, Architects, for design of an indoor - outdoor swimming pool at Lions.
Park and an outdoor pool at the Eisenhower - Wilson- Whitney school complex. He explained tha'.
if the pools were awarded under separate contracts, the total design and construction super•
vision cost would be $63,004; but since the City has asked the architects to include both
pools under one contract, this fee would be $58,821, which represents a saving of $4,183,
or nearly 7 %, to the City of Yakima. Mr. McMicken further explained that before construc-
tion begins, the City will negotiate an operating agreement with Yakima School District
#7 on sharing operating and maintenance costs of the Lions Park pool, which will be avail-
able to the school /district during the school year. Also, a joint committee for advisory
purposes consisting of the Director of Athletics, Swede Lindquist, Director of Education,
Dutch Schultz, and City Parks and Recreation Director, William Hutsinpiller, will meet and
confer on the scheduling and planning for the'Eisenhower- Wilson - Whitney outdoor pool, and
in turn work out any policy issues with Dr. Frisk, the School Board and the City Manager.
City Manager McMicken and Parks and Recreation.D.irector William Hutsinpiller recommended
an agreement be executed with Olson- Richert - Bignold, Architects for landscape architectural
services for partial development of Randall Park. After due discussion, it was MOVED by
Lust, seconded by Whitaker that Resolution No. D -1797 authorizing the execution of said
agreement, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler
and Whitaker voting aye on roll call.
RESOLUTION NO. D -1797, A RESOLUTION authorizing and directing the City Manager and City
Clerk of the City of Yakima to execute an agreement with ORB Architects- Planners - Engineers
for architectural services to construct swimming pools.
City Manager McMicken reported that an Offer -to -Sell right of way property for Mead Avenue
Improvements has been received from Wilbert F. and Frances G. McWain and recommended the
purchase of said property. It was MOVED by Robinson, seconded by Brown that Resolution No.
D -1799 authorizing the purchase of said right of way, be passed as read: carried, Broad,
Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call
RESOLUTION NO. D -1799, A RESOLUTION authorizing the purchase of right of way property for
Mead Avenue improvements.
City Manager McMicken reported on the matter of remodeling of the Council chambers and
lobby. He explained that he has contacted Marble - Dawley and Associates, Yakima architects,
and they have agreed to undertake these services and to give us some design sketches and
ideas concerning the remodeling. Mr. McMicken also explained that a cost estimate will be
prepared, and if the work is done, it will be funded from the 1972. Budget's Contingency
Fund. After due discussion, it was MOVED by Whitaker, seconded by Robinson that the City
Manager be authorized to engage Marble- Dawley and Associates for the remodeling and or re-
decorating of the Council chambers and lobby of Yakima City Hall: carried, Broad, Brown,
Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote
City Manager McMicken reported that we have received a letter from Mr. James Liebold of
Kennewick, labor mediator, who explains that his investigation of the Yakima Police Pa-
trolmen's Association complaint, that the City refused to bargain concerning police paydays
revealed nothing to support the charge and it has been dismissed by• :the State Department of
Labor and Industries. Mr. Liebold indicated that his investigation revealed that no signed •
labor agreement has ever been reached between the City and the YPPA, the date and number of
paydays per month were never negotiated, there has been no protest on the change of paydays
from other city employee organizations and the City has not refused to discuss the payday
change with the YPPA. City Manager McMicken reported that he is continuing to negotiate
with YPPA representatives in an attempt to reach common agreement on a.recognition document.
Mayor Broad reported that the City Council has been considering appointments to Boards and
Commissions, and that the following appointments have been recommended:
Fair Housing Review Board - Clement A. Enright and Gary Swenson reappointed to three
year terms. Councilman Bill Whitaker representing City Council, term would run con -
current with his term of office.
Housing and Renewal Committee -- Warren L. Dewar, Patrick C. Nagle and John H. Strosahl
appointed for two -year terms that expire December 31, 1973. Richard Lee appointed for
a one -year term that expires December 31, 1972. Mrs. James H. (Freda) Robinson ap-
pointed for a one -year term on the Northeast Area Council and Benjamin H. Chandler ap-
pointed for a one -year term on the Southeast Community Center.

Park and Recreation Commission - Mrs. Lauren W. (Ruby) Dobbs reappointed. Robert L.
De Pietro, Richard H. Parker and'Mrs. Donald K. (Mary) Williams newly appointed. Terms
of all members of the seven - member park commission will be recommended by the Park
Commission members and confirmed by the City Council members in accordance with Ordi-
nance No. 1368 creating a Park and Recreation Commission and specifying terms of of-
fice, as passed on January 3, 1972. The commission membership recently was expanded
by two members.
Planning Commission - Robert W. Leichnitz appointed to fill remaining seven months -of
Councilman Don Schussler's term which expires Augu'st::31, 1972.
Yakima County Health Board - Don Schussler appointed to represent City Council.

There being further business to come before the Council, it was MOVED by Lust, seconded
