D 5727 A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a Memo of Understanding with Larson Park Tennis Club. WHEREAS, the City of Yakima owns and operates a number of tennis courts, and WHEREAS, Larson Park Tennis Club is a private, non-profit organization offering adult and youth tennis programs, and WHEREAS, Larson Park Tennis Club desires the use of City tennis courts, and WHEREAS, the City of Yakima wishes to enhance park use and enjoyment by its citizens through the use of City -owned tennis courts, now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF TBE CITY OF YAKIMA: The City Manager and City Clerk of the City of Yakima are hereby authorized and directed to execute the attached Memo of Understanding with Larson Park Tennis Club, under the terms and conditions set forth in said Memo of Understanding which is attached hereto and by referenced made a part hereof. ATTEST City Clerk (res/lptc) C;)/(Lt \Z5e4,7-2C1-7t Mayor PEND OF UNDERSTANDING BETWEEN THE CITY OF YAKIMA AND LARSON PARK TENNIS CLUB 1990 SEASON BACKGROUND: The Larson: Park Tennis Club (LPTC) is a private non-profit organization offering adult and youth tennis programs. This organization owns no facilities. Each year LPTC applies to use the City's (City of Yakima, Parks and Recreation Division) tennis courts from April through October for their program. LPTC mainly uses the City's tennis courts located at Larson Park. LPTC is very cooperative in working out conflicts with Yakima Valley Community College. TEEMS : I. A S1.00 per hour per City court use fee be charged for all adult activities. No fees charged for City court use for youth activities, including youth tournaments such as the Junior Championship and the Novice Tournament. No "in-kind" work credit. However, any maintenance activities LPTC may :wish to voluntarily donate to the upkeep of the City's tennis courts, grounds or other facilities will be welcomed and appreciated. Parks Maintenance will provide a basic level of maintenance for tennis courts. This will decrease the need for this type of service being prov ded by the user. Park Maintenance outlined their normal maintenance for tennis courts as: A. Mash all courts around end of March or first part of April. B. Sweep all courts in June. C. Inspect lights three times a week and repair as needed. D. Inspect all tennis nets two to three times per week; repair or replace as needed. Store tennis nets from November through February, leaving only one or two nets per facility, that are in the worst condition, out for the winter. E. Litter assigned to daily routine of rovers. F. Garbage cans checked daily and dumped as required. G. Signs will be inspected on a regular basis; repaired and updated as needed. H. Vandalism will be repaired as soon as possible after reported. Any other services requested that do not fall into regular maintenance schedule and tasks will be paid for by the requestor. F/LPTC (4'12'90) - 1 - 3. A handling fee of 2% for blanket scheduling for adult and youth programs wall be charged and is to be paid at the beginning of the season (April). In addition, a cancellation fee of 10 cents per hour per court (adult use) will be charged with the exception of the following conditions: General program cancellations: a designated representative or representatives of LPTC will notify the City's scheduling secretary, in writing, one week prior to the scheduled activity. LPTC agrees to account for cancellations for youth programs as soon as possible, although no fees are charged for these programs. "Rain -outs": The Association shall notify, in writing, the City's scheduling secretary within five days of all cancellations due to weather. The City will not charge the Association these ranrallatannc. 4. Beginning in May, 1990, LPTC will make monthly payments based on the previous month's use as reported to the City's scheduling secretary. In general, should fewer courts be needed for an activity than scheduled, the general public will be allowed use of the extra courts. Should LPTC need more courts due to program growth, LPTC will request these additional courts from the City as soon as possible. If available, additional court use wall be granted. 6. Whenever possible, Larson Park tennis courts 10, 11 and 12 will be free for the use of the general public. LPTC ha] 7 defend,indemnify, harmless the City of Yakima its I .
