A RESOLUTION authorizing and directing the City Manager and
City Clerk of the City of Yakima to execute a
Memorandum of Understanding with the Yakima
Softball Association for the 1990 season.
WHEREAS, the City of Yakima owns and operates a number of
softball fields, and
WHEREAS, the Yakima Softball Association is a private,
non-profit corporation that offers a fastpitch softball pro-
gram consisting of men's leagues and tournaments, and
WHEREAS, the City of Yakima wishes to enhance use of its
softball fields and enjoyments by its citizens through soft-
ball participation, now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and the City Clerk are hereby authorized
and directed to execute the Memorandum of Understanding with
the 1akima Softball Association, under the terms and condi-
tions set forth in the attached Memorandum of Understanding
which is attached hereto and by reference me a part hereof.

MEMORANDUM OF UNDFRSTANDING
Between the City of Yakima and. the Yakima Softball Association
1990 Season
BACKGROUND
The Yakima Softball Association is a non-profit organization that offers
fastpitch softball program consisting of men's leagues and tournaments. This
popular program has used Larson softball fields for many years. This program
primarily uses Dunbar Field and Field 3 (northwest field).
Over the years the Yakima Softba.1 1 Associat on has made many contributions to
the ba if le ids and, in general , the facil ity around Dunbar field, Each year
they put in many hours of volunteer time in maintaining the facil it] es for not
only their program, but for other programs that request the use of these
particular fields
It is in the best interest of the City of Yakima for this program to continue
offering the quality fastpitch program it has developed over the years. In the
spirit of cooperation, the City of Yakima Parks and Recreation Division will
act as a co-sponsor for the Yakima Softball Association program.
The intent of this Memorandum of Understanding is to clarify the 1990 ballfield
maintenance program and fee schedule for Larson Park, per "Use of Facilities
Application", between the City of Yakima and Yakima Softball Association.
(NOTE: There is also a Concession Agreement between the Association and the
City.)
A. DEFINITIONS
"The City" will mean the City of Yakima, Public Works Department, Division
of Parks and Recreation.
"The Associalion" will mean Yakima Softball Association.
B. REPRESENTATION
The Association's representative will be Jim Williamson, Associat!_on
President.
The City's representatives will be Debb te Kent, Athletic Coordinator.
C. TERMS
All early spring maintenance activities, including the City's energization
of the irrigation system and opening the restrooms, is dependent on the
weather. At least two weeks in advance, the Association agrees to work
with the Clty in determining the dates for the Association's pre -season
activities. These dates will coincide with the CiLy's pre -season
maintenance schedule. In general, regular park maintenance activities
begin in April.

1. Pre -season
a. The City will turn on the irrigation water at Larson Park to
accommodate the Association's request. (See paragraph C. Tel
regarding weather and pre -season activities
The Association will he responsible for anydamage resulting
from their request for eatly energization of the irrigation
system.
b. The City will turn on the water for the concession stand at
Larson Park to acconnodate the Association's request. (See
paragraph C. Terms regarding weather and pre -season activi-
ties.)
The Association wall be responsible for any damage resulting
from their request for early energization of the concession
stand water system.
Regular Season
a. The City will provide a basic level of maintenance which in-
cludes mowing, irrigating, regular inspections, repair and
maintenance, and litter control and garbage service.
h. The Association agrees to prepare the fields for its own pro-
grams, make repairs, pick up litter and garbage around the
balifields, concession stand, grandstand, bleachers, and dugouts
and empty garbage receptacles in the park's dumpster.
c The City agrees to work with the Association on any other "spe-
cial" maintenance needs requested by the Association with the
understanding that these maintenance requests will be paid for
by the Association.
d. If it is deemed necessary, because of the Association's actions
and programs, the City, with prior notification to the
Association, will perform maintenance tasks, such as litter and
garbage control or repair to the facilities and the City will
charge the Association for labor, equipment, and other costs
incurred at that time.
Bases
a. Dunbar: The Association will use furnish bases for Dunbar
Field, The Association agrees to use the same type of equipment
as the City. This is in -lieu of end -of -year equipnent charges
regarding bases.
b. The City will furnish bases for Ballfield #3.
c. The Association will be responsible for storing all the bases
they use after -their program.

Mowing
The City agrees to mow the ballfields on a regular basis in
conjunction with the regular mowing schedule for the rest of the
park
b. Additional mowings requested by the Association will b consider-
ed a special request and will be paid for by the Association on
a per hour basis.
Facility Use Policies
a. By signing the "Application for Use of Facilities" the
Association agrees to follow the Facil]ties Use Policies
stipulated on the back of the Association's copy.
b. No alcoholic beverages are allowed in City parks.
D. SCHEDULING AND FEES
The Association will complete the Use of Facility Application" form
and submit these forms according to the regular City schedule.
Requests for use of facilities from March through August would be
received no later than February 1; from September through February,
should be received no later than August 1 of each year.
2 Program Cancel l ati ons/Aaustments:
a. General Program Cancellations/Adastments: Association Repre-
sentative Jim Williamson, Association President, will notify the
City's Athletic Coordinator, Debbie Kent, in writing one week
prior to the scheduled activity of that activity's cancellation.
The City will not charge the Association for these cancella-
tions.
b. "Rain -Outs": A designated Association Representative (Jim
Williamson, Association President) will notify the City's
Athletic Coordinator, Debbie Kent, in writing within five days
of any cancellation due to weather. The City will not charge
the Association for these cancellations.
3. Fees:

The City will base its determination of all appropriate fees on
the schedule submitted on the "Use of Facility Application" as
adjusted and finally approved by the City, unless appropriate
program cancellation/adjustment steps are taken by the Associa-
tion.
b. Field Use Rental: In consideration of the work the Association
does on the City ballfields and because of the City's part: in
co -sponsoring the program, the Association will pay $5.00 per
field per day for use of ballfields as outlined on the "Use of
Facilities Application".

Light Use Ren i : In consideration of the work the Association
does on the City baiifields and bec=ause of the City's part in
co --sponsoring the program, the City will charge the current rate
of $5.00 per hour for field lights.
d. Fee Negotiation: The Association is required by the Washington
State Amateur Softball Association to establish fees for its
Invitational Tournaments by January 15. If the parties decide
to extend their agreement into further years, the fee provision
of the agreement for future years will be reset by the City of
Yakima prior to January 10 of the year of the new agreement or,
if not, the previous year's fee schedule will prevail
