Pursuant to a call by the Mayor, special.- meeting:of :'the Yakima City Council was held at 1:30 P.M. in the Conference Room at Yakima City Hall. -:. . • . Councilmen present at the meeting were: Mayor Broad, Wray Brown,- - Lenore Lambert ;.James Lust, . Walter Robinson and Bill Whitaker. Also-in attendance were City - Manager McMicken, CityAt- torney Andrews, Administrative Assistant Jim.Williams and Jim _Bowers, Yakima Herald'Republic. City Manager McMicken proposed he attend -a program for Urban Executives and circulated a brochure concerning same. The program is an intensive.thirtyday training-session at the Massachusetts Institute of Technology. No decisions•were made. The matter be a.future topic for discussion. ..: . - The Council discussed appointments to City- .Boa:rds.and Commissions: .Tentative selections were made for some of the appointments pending of the persons involved.. The minutes of the regular meeting of January 17, 1972, having been.dulycertified accurate by two Councilmen, and no one present wishing to have said minutes.read publicly, Mayor Broad declared said minutes approved as recorded. Petition No. 728, having been filed with.,the City.Clerk on January 20, 1972, by Donald Pat- node, requesting improvement of property by the construction of curbs, gutters and surfacing of the street at'_.4809 - 4813 Tieton Drive, it was MOVED by.Robinson, seconded by Lambert that Petition No. 728, for the creation of a Local Improvement District, be referred to the City Manager and Staff for study and recommendation: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye by voice vote. ORDINANCE NO. 1378, AN ORDINANCE of the City Council of the City' of Yakima, Washington, pro- viding for the issuance and sale of various purpose .unlimited tax -levy general obligation bonds of the city in the total principal:amo.unt of $3;000,000 for the purpose of providing part of the funds to pay the cost of acquiring, constructing, equipping and making certain • capital improvements to the park and recreation facilities and to the fire department fa- cilities of the city as provided in Ordinances Nos. 1333 and 1334 of this Council, adopted September 13, 1971, as authorized by the•qualified electors of the city at a special election held therein on November 2, 1971; combining the bonds so authorized in one issue and fixing the date, form, terms, maturities and covenants of said bonds; :providing for the payment of part of the proceeds of sale of said bonds into a Park and Recreation Capital . Fund to be created and into the Fire Capital Fund of the city heretofore created; creating a Bond Redemption Fund; providing for the annual levies of taxes without limitation as to rate or amount to pay the principal of and interest on said bonds; and declaring an emer- gency. It was MOVED by Robinson, seconded by Lambert.that.Ordinance No. 1379 authorizing condem- nation proceedings for the widening and improving of a portion of Mead Avenue between 3rd Avenue and 10th Avenue, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye on roll call. Schussler absent. ORDINANCE NO. 1379, AN ORDINANCE authorizing and directing the City'Attorney of the City of Yakima to institute and prosecute legal proceedings for the condemnation and acquisition of real property for the widening and improving of a portion of Mead Avenue and for the in- stallation of curbs, gutters, sidewalks, drainage facilities and public utility facilities related thereto; providing for the condemnation and taking of such real property and de- claring the condemnation and taking thereof to be•necessary for a public use required by ' the public interests; and directing that compensation for such taking be paid from the Urban Arterial Fund of the City of Yakima; and declaring an emergency. • It was MOVED by Brown, seconded by. Whitaker that Ordinance No. 1380 authorizing condemnation proceedings for the widening and improving of portions of West Nob Hill Boulevard and South 32nd Avenue, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye on roll call. Schussler absent. ORDINANCE NO. 1380, AN ORDINANCE authorizing and directing the City Attorney of the City of Yakima to institute: and prosecute legal proceedings for the condemnation and acquisition 307. JANUARY 24, 1972 of real property for the widening and improving of a portion of West Nob Hill Boulevard and a portion of South 32nd Avenue and for the installation of curbs, gutters, sidewalks, drain age facilities and public utility facilities related thereto; providing for the condemnation and taking of such real property and declaring the condemnation and taking there of to be necessary-for a public'use required by-public interests; and directing that compensation for such taking be paid from the Arterial Street Fund of the City of Yakima, and declaring an emergency. Public Works Director, David Vargas, reviewed and discussed the plans for widening and the improvement of a portion of Mead Avenue and portions of West Nob Hill Boulevard. It was•MOVED by Robinson, seconded by Brown that Ordinance No. 1381 relating to City person nel•with regard to temporary assignments and funeral leave; and amending the City of Yakima Municipal Code,•be passed as read: carried, Broad, Brown,-Lambert, Lust, Robinson and • Whitaker voting aye on toll call. Schussler absent. City Manager McMicken explained that this ordinance amends the Code to permit use of sick leave by an employee for death of a member of the immediate family and of an employee's spouse's family; and, also changes the remuneration for special assignment for members of the fire suppression force. ORDINANCE NO. 1381, AN ORDINANCE relating to city personnel; authorizing assignment pay for temporary assignments in the fire and police departments; specifying permissible use of sick leave for death of a member of the family of a city employee; amending Subsection 2.40.030 B (4) and Subsection 2.20.088 (e), and adding Subsection 2.20.088 (f) of the City of Yakima Municipal Code; and declaring an emergency. Mary Carroll, Vice - chairman, Yakima Youth Advisory Commission, gave a report on the Com- mision's current and proposed activities. Miss Carroll reported that in June of 1971 they held an inaugural banquet with Ludlow Cramer as speaker; that they have been working with the community relations department of the Police Department; have worked on getting the Police Rider Program reinstated; have been working on voter registration of 18 -20 year olds and have recommended some names to Governor Evans for the State Youth Commission. She fur- ther reported that in the future they are planning an Environment Day; they are planning to have a student poll on student activities; and are planning to get some prisoners•from Walla Walla to come and speak at the schools. Council members commended the Youth Commis- sion on their interest in youth activity. .. City ManagerfMcMicken gave recognition to Kenneth :C. Hutchins.as.a Water :-Works Specialist - Cross Connection Division. The Council expressed their congratulations. City Manager McMicken reported that in accordance with Council action of January'17, 1972, the City Attorney has prepared a Resolution authorizing an election on the matter of the annexation of unincorporated area, referred - to as the West Chestnut Annexation City of Yakima. He further .reported that the election would determine whether the property in this area should assume its share of the City'-ss existing indebtedness, and whether a com- munity municipal corporation, to be known as West Valley Community Municipal Corporation;• should be.created to serve.the area if annexed to the'City.'= James Clifford, 5901 W. Walnut spoke in opposition to the proposed Resolution and asked the Council what would happen if the annexation were approved, but the proposition that would assess their prbperty'at the - same rate as the City was rejected. City Attorney Andrews explained that the City Council would have the option whether .or •.not ' to . 'tax - the annexed population : at•a rate than the City. Schussler absent. RESOLUTION NO. D- 1795,' A RESOLUTION authorizing and initiating an orn.the matter of the annexation of,unincorporated area to the City of Yakima; providing for the submittal to the electorate of a proposition that property in the area to be annexed assume'its share of the City's existing indebtedness; and providing for the creation of a West Valley Com- munity Municipal Corporation. . City Manager McMicken referred to his report ##140 Proposed Building Security Ordinance and asked Police Chief Jack LaRue and Sergeant James Beaushaw to on the .importance of thi-:• matter. Chief LaRue informed those present that the - proposed buildingc'security ordinance is a highly, important,. long. range ordinance. He stated that this offers hopefully preven- tion and deterrence in nonresidential burglaries for many years to come. Sergeant Beaushaw reported that he had attended a three week .seminar in Kentucky which'had . .crime prevention and this type of ordinance as its major topic.: .He further reported that'•t1 experience in other. cities with building, security codes is limited, and that Oakland, California has model City Ordinance. City Manager McMicken explained that the "Burglary Prevention" Or- dinance is a building security provision. of the :Municipal.Code that-requires that the owner or manager of existing. and future buildins used for business purposes shall; when'unattendes, • be secured so as to,prevent unauthorized entry at all exterior, accessible openings. Re- sidences, schools, hospitals and government buildings are exempt. The Police may. also require burglary alarms, under certain circumstances.:'... McMicken further explained that this Ordinance, which has been a subject of study over the last year, has been cleared through and with the Building Inspection services and the Fire Marshall's office. City Manager McMicken referredLthe matter of a report of the City Engineer regarding nego- tiations with Burlington- Northern for design and construction of the new Walnut Underpass to Public Works Director, David Vargas, as City Engineer Frances Jaeger was absent because of ill health. Mr. Vargas reported that Mr. Jaeger along with`Doin Casad of A.B.A.M.,•En- gineers, learned that Burlington- Northern wanted to design the Walnut Undercrossing with • their own engineering staff, but since they are so heavily loaded with design work, ithey conceded that we would have our own design engineer if.we wanted it completed in•the near • future. He further reported that Burlington - Northern has•set down the ground rules on the design itself: a center pillar in the undercrossing as,there is now, with a limited amount of span, the height of the structure, and the depth of the beams that will cover the tracks Mr. Vargas implied that other details that have to be worked out. are how many tracks we can remove at any given time and how many we have to keep in service, and what type of temporar; shoring will be used for tracks remaining in service. Mr. Vargas explained that we have • enough information that we can: proceed with preliminary designs:, .mostly. of the structures, and that we will be working with Burlington- Northern to keep it on schedule. 308 JANUARY 24, 1972 City Manager McMicken explaining that immediate repairs are necessary for the Rudkin Road Lift Station Sewage Pump and that repair parts are available from one source only, it was MOVED by Robinson, seconded. by Lambert that Resolution No. D -1796 authorizing the hiring of labor and purchase of materials for repairing the Rudkin Road Lift Station Sewage Pump without calling for bids, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye on roll call. Schus- sler absent. 369 JANUARY-24, 1972 • As a matter of new business, it was MOVED by Robinson, seconded by Lambert that Mayor Broad and Councilman Lust be designated to represent the City as representative and alternate on the United Community Action Board. • Councilman Lambert explaining that the Yakima County Health Board is made up of representa- tives of the City,and.County,.that we must appoint a successor to Don McNeice,'and that Don Schussler has consented to fill this position, it was MOVED by Lambert, seconded by Brown that Mr. Don Schussler be appointed to fill Don McNeice's position on the Yakima County 'Health Board: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye by voice vote. Schussler absent. - At approximately the hour of 4:40 P.M., City Attorney Andrews_ accepted service on behalf of the Cityffor the City Manager and the Chief of Police on the matter of Michael Hoff versus the City. This restraining order was served by Donald Shaw, Attorney representing Michael Hoff. Mr. Andrews explained that it is a court action that restrains the City , of Yakima from holding the hearing that was scheduled for January 25, 1972 on the matter of whether.... or not the regular licenses and permits for the Downtown Recreation Center should be re- voked. He further explained that in compliance with the court order there will not be a hearing as previously scheduled. No formal action was taken on this matter at this meeting. There being no further business to come before the Council, it was MOVED by Lust, seconded by Robinson that we do now adjourn at the hour of 4:50 P.M.: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye by voice vote.
