Pursuant to a-call by the Mayor; a special meeting of the YakimaCity Council was held 'at • 6:30 P.M., in the Conference Room at Yakima City Hall. Councilmen present at the meeting were: Mayor Broad, Wray Brown, Lenore Lambert, James - Lust, Don Schussler and Bill Whitaker. Also in attendance were City Manager McMicken, City Attorney Andrews, Administrative Assistant Jim Williams. • : r ' Mr. McMicken discussed with the Council procedures.. normally followed lin the.study sessions • and asked for suggestions for.improvements. Councilman Schussler •suggested that more time be given for important items.and that Councilmen-be asked before the:meeting which•items they wish to devote time to. . • The Council discussed which colors should be chosen for new•City buses. Preferences were voiced; but no decisionstmade: . Transit Manager Bob.Knight:will be left the decision. • City Manager offered suggested topics for future study session discussions and asked for Council opinions. Councilmen agreed that annexation and outside utility in ge- neral deserved discussion time. ' The Council further discussed appointments to Boards.and Commissions, but made no decisions. It was MOVED by Brown, seconded by Lambert that Councilman n be excused from this meeting: • carried, Broad, Brown, Lambert,-Lust, Schussler and Whitaker voting aye by•voice vote.: The Invocation was given • • The minutes of the regular meeting of January 10, 1972, having been duly certified accurate by two'Councilmen, and no one present wishing -.to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. A Damage Claim.having been.filed with the City Clerk.on January 7, 1972 by Mrs.'Harold F. Willard, 1223 N. First Street, in the amount of $105.08 for damages by a fall on the sidewalk in front of City Hall, it was MOVED by Brown, seconded by Lambert that said Damage Claim be referred to the•City Manager and Staff for study and consideration: carried, Broad, Brown, Lambert, Lust, Schussler and Whitaker voting aye by voice vote. An Ordinance loaning $65,000.from the Water -Sewer Fund and appropriating $65,000 to the ' Fire Capital Fund, having. been read in its entirety at the previous meeting on January 10, 1972, and being read by Title only at this meeting, it was MOVED by Brown, seconded by Lust that Ordinance No. 1376 authorizing said temporary loan and appropriat.ion,TThe passed as read: carried, Broad, Brown, Lambert, Lust,'Schussler and Whitaker voting aye on roll call. Robinson absent. .Discussion brought outAhat this ordinance is in keeping with our adopted.city Budget. • ORDINANCE NO. 1377, AN ORDINANCE relating to city personnel; specifying the salary of the Mayor of the City of Yakima; amending Section 2.20.093 of the City of Yakima Municipal Code; and declaring an emergency. • There being a group of approximately 60 persons present representing the urban area of West Valley, with the majority being present to request annexation by election, Mayor Broad . opened the meeting for discussion. Those speaking in favor of the proposed annexation elec tion were Dale Dreeszen, 401 S. 58th Avenue; Mr. and Mrs. Jim Warnick, 412 S. 58th Avenue; Dan Smith, 213 S. 58th Avenue; Tony Alegria, S. 57th Avenue; Roy Bush, 2 S. 58th Ave- - nue; Kelley Billings, 6516 Barge; Knute Lunnum, 706 S..58th Avenue and_Paul_Petersen, 215 S. 58th Avenue. The main points covered by those speaking for the proposed annexation elec tion were the.great need for sewers, the need for more and better police, protection, fire protection, street lighting -. and, the other .advantages, of being a part ._of _the City such _as park programs for the children'and better traffic control. Those annexa- tion as they do not want to be in the City and feel the sewer problems can be solved by the County, were Robert Busk, 1016_S. 50th Avenue; Bill Woelke, 16 No..54th Avenue; and.Mr. and Mrs. James Clifford, W. Walnut. ..Also present and asking. sewers, taxes, school district and other costs involved in an annexation, was Mr. Edward J.,Kateridge, 5202 Cascade Drive. City Manager McMicken, Planning Director Jay Otto and Public Works Di- rector Dave Vargas answered questions and presented information regarding the proposed an- nexation election and the area involved, proposed sewers, taxes and costs involved in.livin• in the City and outside the. City, and explained the formation and function of a Community Municipal Corporation and Community Council which can be elected at the same time an annex- ation election is held. Mr. Otto reviewed briefly the proposed annexation, stating that there are 549 acres - involved in the area from Summitview on the north to approximately 65th on the west, to generally Tieton, lining up with Arlington on the south and that there is a total population in this area of 3,498, with 961 dwelling units, with an average of 3.65 persons per dwelling; (1970 census figures). He stated that this proposed boundary will permit the sewering of the area without a major investment by the City of large intercep- tors or trunk mains. In answer to some of the other questions asked by those present, Mr. Otto reported that the school boundaries will not be affected by annexation;. that the Nob , Hill water district will be unaffected; the refuse situation does not change for five years 305 JANUARY 17, 1972 at which time the City takes over; fire costs should decrease; the tax differen- tial is 1.1 mills, which does'not include. -the recent bond issues passed by the City for Park and Fire levies, but which do not take effect until 1973; and other City costs that a county resident does not have, are transit tax of 65, .per month, the utility tax assessed by the utility companies, and when they are on the sewer system there will be a sewer main- tenance charge each month. Mr. Otto then reviewed in detail the matter of the formation and function of a Community Municipal Corporation and Community Council and the require - ments to be followed in electing five Community Council members at the same time as the an- nexation election. He also reviewed the time scheduleset up for the West Chestnut Annexa- tion election. Council members indicating that they are in favor of this proposed annexa- tion election, it was MOVED by Lambert, seconded by Lust that the City Attorney prepare the appropriate legislation for submittal to the Council that calls for an annexation elec- tion as set out in the West Chestnut Annexation map as presented, that will provide for election of a community council. and that will provide for the assumption of the City's existing.indebtedness by the area to be annexed: carried, Broad, Brown, Lambert, Lust, Schus- sler and Whitaker voting aye by voice vote. Robinson absent. City Manager McMicken referred to the letter received from Robert 0. Yeasting, of Foster & Marshall, Inc., the'City's bond consultants, recommending that theMayor and City Manager present information for improved credit rating to Bond Rating Services in New York. They indicated in this letter that they feel that the City of Yakima has - a very good chance of obtaining an "AA" rating which would mean approximately a $90,000 savings in the interest rate on the forthcoming $3,000,000 G.O. Bonds from the usual '.'A =1" rating that Yakima has had in the past. They further'stated that although there is no assurance that they will be ' successful in upgrading the rating, they feel it is worth the expenditure of City funds and the time and energTrequired to go to New York to give it a try, and that they will assist in preparing whatever information is needed for the presentation. Mr. McMicken - stating that Council authorization is needed for them to make this trip to New York, it was MOVED • by Lust, seconded by Whitaker that this out of state travel be authorized: carried, Broad, Brown, Lambert, Lust, Schussler and Whitaker voting aye by voice vote. Robinson absent. City Manager McMicken reported that an option to purchase property for a fire station site has been prepared and J. H. and Lillian O. Zybura have offered to sell said property for $19,000, which price has been deemed justified by the City's appraiser, George Lemon. Mr. McMicken further reporting that thisris the second piece of property needed for the pro- posed Fire e - Station No. 1, and recommending that the purchase be authorized, it was MOVED by Brown, seconded by Schussler that Resolution No. D -1794, authorizing the - purchase of said property for a fire station site, be passed as read: carried, Broad, Brown, Lambert, , Lust, Schussler and Whitaker voting aye on roll call. Robinson absent. RESOLUTION NO. D -1794, A RESOLUTION authorizing 'the purchase by the City of real property for a fire station site. , ■ • A report having been received from Cornell, Howland Hayes'& Merryfield on the supplemental final estimate covering construction of the Naches Water Treatment Plant and the City En- gineer indicating that the work is completed and recommending that the work be accepted, it was MOVED by Schussler, seconded by Brown that the report of the City Engineer dated January 10, 1972 with respect to the completion of the work on said construction project be approved, the work be accepted and the "release of the retainage fees as there set forth, in the amount of $13,559.48 is hereby authorized: carried,. Broad, Brown, Lambert, Lust-, Schussler and Whitaker voting aye by voice vote. Robinson absent. City Manager McMicken referring to two out -of -State travel.requests and recommending auth- orization for Fritz Jaeger, Engineer, to travel to•St. Paul Minnesota'to; meet with Burling- ton Northern personnel, with Don Casaad of ABAM, and for Fire Chief Matt Young "to attend a Fire Command Course to be held in San Diego from January 23 to 29, 1972, both trips at no expense to the City, y, it was MOVED by Lambert, seconded by Lust that said travel be auth- orized: carried, .Broad, Brown, Lambert, Lust, Schussler and Whitaker voting aye by voice vote.
