HomeMy WebLinkAboutR-1990-D5686 Wastewater Testing• D5686 • 1 • RESOLUTION NO. A RESOLUTION authorizing an agreement with the Municipality of Metropolitan Seattle (Metro) for wastewater testing. WHEREAS, the City of Yakima requires professional ser- vices for the purpose of conducting complex analytical testing of water, wastewater, sludge, and soil samples for the purpose of meeting all State, Federal, and local regulations which apply to the City's National Pollution Discharge Elimination System (NPDES) wastewater discharge permit; and WHEREAS, the City of Yakima recognizes that such analyti- cal testing services are complex, costly, and time consuming; and WHEREAS, the City of Yakima is not presently equipped nor does it have staff trained to conduct such analytical test- ing; and WHEREAS, Municipality of Metropolitan Seattle (herein- after called Metro), has the necessary staffing, resources, and testing equipment to conduct complex analytical testing which the City of Yakima is required to perform under the terms of its NPDES discharge permit; and WHEREAS, Metro has conducted tests for Yakima in the recent past with an excellent record for quality control and data interpretation; and WHEREAS, the City of Yakima is satisfied with the cost effective and quality services provided by the Metro Labora- tory, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF TBE CITY OF YAKIMA: The City Manager and the City Clerk are hereby authorized and directed to execute the attached and incorporated "City of (res/intergov) 1 Yakima and Municipality of Metropolitan Seattle Intergovern- mental Agreement for Laboratory Services". ATTEST: City C erk 2 (res/intergov) Mayor CITY OF YAKIMA AND MUNICIPALITY OF METROPOLITAN SEATTLE INTERGOVERNMENTAL AGREEMENT FOR LABORATORY SERVICES WHEREAS, the City of Yakima requires professional services for the purpose of conducting complex analytical testing of water, wastewater, sludge, and soil samples for the purpose of meeting all State, Federal, and local regulations which apply to the City's National Pollution Discharge Elimination System (NPDES) wastewater discharge permit; and WHEREAS, the City of Yakima recognizes that such analytical testing services are complex, costly, and time consuming; and WHEREAS, the City of Yakima is not presently equipped nor does it have staff trained to conduct such analytical testing; and WHEREAS, Municipality of Metropolitan Seattle (hereinafter called Metro), has the necessary staffing, resources, and testing equipment to conduct complex analytical testing which the City of Yakima is required to perform under the terms of its NPDES dis- charge permit; and WHEREAS, Seattle Metro has conducted tests for Yakima in the recent past with an excellent record for quality control and da- ta interpretation; and WHEREAS, the City of Yakima is satisfied with the cost effec- tive and quality services provided by the Metro Laboratory, now, therefore, the parties mutually agree as follows: (1) Parties. This Agreement is entered into and between the City of Yakima (City), a first class Washington Municipal Corpora- tion and the Municipality of Metropolitan Seattle (Metro), a Metro- politan Municipal Corporation. (2) Starting Date. This Agreement is entered into in this 6 ' day of NI Rc 4 , 1990. (3) Term. This Agreement shall terminate two years from its effective date written above. The parties may renew this Agreement by mutual consent for one year terms thereafter. 1 (agr/intergov) (4) Consideration. Metro shall provide the laboratory tests listed in Attachment "A", which is attached and incorporated by reference, at the City's request. Test costs and the approved protocol for performing said tests are included in Attachment "B" which attachment is attached hereto and incorporated by reference. The City shall pay Metro within thirty (30) days of receipt of billing from Metro. Metro shall send any bills to the City's Process Control Supervisor. (5) Quality Control. Metro shall conduct all of the tests (unless subcontracted with the City's approval) at the prices and following the accepted protocol listed in Attachment "B". Metro shall provide written documentation to the City on the quality of its analyses. At the City's request, Metro shall send the City all data relevant to sample custody and quality control on any test at no extra charge. Metro shall notify City when an analyses is out of control or when other anomalies in data may affect the outcome of valid test results. (6) Accreditation. Metro has applied for state laboratory accreditation through their application (#1071) in the State of Washington Department of Ecology Laboratory Accreditation program under WAC 173-50. Upon being so accredited, Metro shall send the City written proof of such accreditation. (7) Liability. No liability shall attach to either party under this Agreement except as expressly provided herein. (8) Response Time. Metro shall complete tests and furnish written results to the City within thirty (30) days of its receipt of the City's request and samples to be tested. (9) Sample Preparation and Transport. The City is responsi- ble for all sample gathering, preparation, preservation, and ship- ping according to accepted scientific methods. The City's Process Control Supervisor shall be the responsible receiver of all test results. Either party may terminate this contract by giving the other party sixty (60) days written notice at the addresses written below. (11) Other Providers. The parties understand the City may seek the same or similar test from at its sole discretion. (12) Whole Agreement.
