A RESOLUTION authorizing the execution of an agreement with the
State of Washington, Planning and Community Affairs
Agency, for fire protection services to State facilities.
WHEREAS, the City of Yakima furnishes fire protection services to
property and facilities owned by the State of Washington, within the City of
Yakima corporate limits, for which services the State will reimburse the
City as provided by the attached agreement document, and
WHEREAS, the City Council of the City of Yakima deems it to be in
the best interests of the City that the attached agreement document be
executed by the City in order that such reimbursement may be made, now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
The City Manager and City Clerk of the City of Yakima are hereby
authorized and directed to execute an agreement with the State of
Washington, Planning and Community Affairs Agency, for the purpose
mentioned above, a copy of which agreement, entitled "Fire Protection
Contract for State-owned Facilities in City Boundaries" (Contract No 1-89-
26393), is attached hereto and by reference made a part hereof.

BASIC FIRE PROTECTION CONTRACT PROGRAM
FISCAL YEAR 1990 ANNUAL AMENDMENT
Fiscal Year 1990 Annual Amendment to Basic Fire Protection
Contract for State -Owned Facilities within City Boundaries.
This Fiscal Year 1990 Annual Amendment to Contract No.1-89-26393
entered into by and between City of Yakima (hereinafter referred
to as the CONTRACTOR) and the Washington State Department of
Community Development (hereinafter referred to as the
DEPARTMENT), WITNESSES THAT:
The Washington State Legislature has appropriated $437,000
to the DEPARTMENT to implement the Basic Fire Protection
Contract Program for Fiscal Year 1990. The DEPARTMENT has
completed an annual survey of state-owned facilities located
in incorporated cities and towns. The Fiscal Year 1990
funding under this CONTRACT has been allocated in accordance
with the requirements of RCW 35.21.775 and 365-80 WAC.
The purpose of this Annual Amendment is to provide the
CONTRACTOR with its proportional share of the appropriated
funds for Fiscal Year 1990.
The following sections are amended to read as follows:
1. The DEPARTMENT agrees to pay the apportioned amount of
$4,244 to the CONTRACTOR within thirty (30) days after
receipt of request for payment for services from July 1,
1989 to June 30, 1990. Thereafter, amounts to be paid shall
be calculated pursuant to this CONTRACT, and RCW 35.21.775
(and regulations adopted pursuant thereto). The CONTRACTOR
agrees to accept this amount, and the amounts so calculated,
as payment for basic fire protection services; provided
supplemental agreements as authorized in RCW 35.21.777 may
be negotiated.
6. The DEPARTMENT has identified the sum of $437,000 as the
total appropriation available to fund basic fire protection
contracts with cities during this CONTRACT period. Pursuant
to WAC 365-80, the DEPARTMENT shall disburse to the
CONTRACTOR a portion of the $437,000 equal to the
CONTRACTOR'S percentage share of all state-owned building
square footage within all cities statewide as identified in
Schedule A - FY 1990 which, by this reference, is made a
part of this CONTRACT and is agreed to accurately state the
square footage figures, including estimated levels of
construction, from which payments are to be calculated.
These figures shall be determined annually by the DEPARTMENT
pursuant to the provisions of WAC 365-80. No corrections
for additional state facilities will be made in the schedule
of payments shown on Schedule A during the current fiscal
year.

15. REDUCTION IN FUNDS
The DEPARTMENT may unilaterally terminate all or part of
this CONTRACT, or may reduce its scope of work and budget,
if there is a reduction in funds by the source of those
funds, and if such funds are the basis for this CONTRACT.
This Fiscal Year 1990 Annual Amendment supersedes the Fiscal Year
1989 Annual Amendment. This amendment shall be read in
conjunction with the text of the original CONTRACT and amendments
thereto. Each and every provision of the original CONTRACT shall
remain in full force and effect except as amended herein, or by
prior amendments hereto.
IN WITNESS WHEREOF, the DEPARTMENT and CONTRACTOR have executed
this Annual Amepdment as of the date and year written below.
