HomeMy WebLinkAbout11/29/1971 Special Meeting / Regular Meeting • . • NOVEMBER 29, 1971 • MINUTES OF SPECIAL MEETING YAKIMA CITY COUNCIL NOVEMBER 29, 1971 . • Pursuant to a call by the Mayor, a special meeting of the Yakima City 'Council was held. at 1:30 P.M. in the Conference Room at Yakima City Hall. Councilmen - present at the meeting were: Mayor Larson, Wray,Brown, Walter Robinson, James Lust and Royal Keith., Also in attendance were Councilmen -elect Don'Schussler and William Whitaker; Others in attendance were City Manager McMicken, Administrative Assistant Jim Williams; Planning Director Jay Otto, and City Attorney Fred Andrews,.with Jim Bowers from The Herald - Republic°. • The Council discussed appointments to the Park and Recreation Commission and further dis- cussed methods•of making appointments to various other boards and commissions. No concrete decisions were made. The City Manager discussed with the Council the organization and possible reorganization of City departments, and divisions.. The City Manager is to prepare a proposal for the Council for further consideration. No decisions were made. The Council discussed County -City relationships and inter - governmental cooperation. A meeting will be held at'a time and place to be determined between the City Council members and Planning Commission members. . • The special meeting adjourned at 3:00 P.M. • • -REGULAR MEETING - MONDAY,. NOVEMBER 29, 1971 - 3:00 O'CLOCK P.M. The City Council .then met in regular session-at the hour of 3:00 P.M., Mayor Larson, Councilmen Brown, Lambert, Lust and Robinson, City Manager McMicken and City At -• torney Andrews were present_on roll call. Councilman McNeice absent on roll call, having been excused at the previous meeting.: The Invocation was given by Councilman Brown. • • The minutes of the regular meeting of November 22, 1971, having been duly certified ac- curate by'two Councilmen, and no one present wishing to' minutes read• Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing on Rezone Application filed by the Washington Company of Jehovah's. Witnesses Inc., requesting rezone of property located at 112 West Nob Hill Boulevard, Jay Otto, Planning Director, reported that the applicant•is.•appearing before the• of •Adjustment on December '214 1971 with an appeal for a•special use • permit, and requests that this Hearing be continued until December 27, 1971. After due discussion, it was MOVED by Keith, seconded by Brown, that this hearing be continued'until January '3, 1972:'carried, Brown, Keith, Lambert, Larson, Lust and Robinson.voting aye by voice vote: McNeice absent. An Ordinance appropriating. various amounts of money to various departments and accounts for the 1971 Budget, having been read in its entirety on November. 22, 1971, and being read by Title only at this meeting, it was by Lambert, seconded by Keith, -that. Ordinance No. 1358 appropriating various amounts of money from unappropriated money in various funds to specified accounts in various departments forexpenditure in the 1971 Budget, be passed- as read: • carried,• Brown;. Keith; Lambert,-Larson; Lust and - Robinson vot- • ing aye on "toll call. , McNeice absent. - ORDINANCE NO. 1358, AN ORDINANCE appropriating various amounts of money from unappr,opri- ated money in 'various;funds to spec ified•accounts in various departments for expenditure in the 1971 Budget. It was MOVED. by Brown, seconded by Robinson, that Ordinance No. 1359 relating to licenses and business regulations; fixing and imposing annual license fees or taxes on certain privately owned utilities and amending the Yakima Municipal Code, be passed as read: carried,•Brown, Keith, Lambert, Larson,7Lustand Robinson voting aye on roll call. McNeice absent. ADiscuSsion that these fees'will be the same as 1971 and that any fur- ther increase would take an additional ordinance.. • ORDINANCE NO. 1359, AN ORDINANCE relating -to licenses and business regulations; fixing and imposing annual license fees •or •taxes on—certain. = utilities and - providing • for a• sur- charge; saving certain taxes; amending Subsection 5.50:050 ((A) of the City of Yakima Municipal Code; and--decl=aring an emergency.' • The matter of increased -- City refuse fees being- a>matter of study by Council- and.- Staff, - an Ordinance =adjusting rates • for• disposing of refuse at •the City Disposal Site was 'read, •and it was MOVED by Lambert,••seconded by Robinson,. - •that• Ordinance'No.•1360 relating €o health and sanitation ; - adopting regulations and specifying fees for operation and use of city • refuse disposal sites, and amending the City . of 'Yakima Municipal Code, be'passed as read. City Attorney Andrews explained, that_ •instead of- an •annual' charge for using the dump, the refuse collector licensed by the City will be charged $4.50 for each truck load of refuse, and-that-fees charged to individuates would be greater. Attorney Richard Wiehl, represent- ing Eichler Disposal, Inc., a private refuse hauling service, raised objections to the $4.50 fee to be charged to refuse collectors. He explained that this :charged based on the City's estimate •of <190 loads - a week is :not accurate and will not will actual-' ly take place. - -He -further explained•that 250 ,'loads is -a more - accurate figure ;• and on that basis the City should charge Eichler only $3.35•a•load. Mr. Wiehl stated that Eichler Disspdsal, Inc. should have been given more advance notice of the change and asked that they be given more time to study the truck count - and the amount to be charged. Dale Samuelson, City Refuse Division Director-, explained that the refuse business is pretty much scheduled and that he felt thatthe City's count was fair and accurate. He stated that the $4.50 a load charge includes a small reserve amount to develop future landfill sites,• - which is'to the private haulef's advantage. :•City Manager-McMicken stated that the operation •-of-the: dump is becoming more.exp'ensive both from labor and equipment cost stand- points, and tha•t•since•the County put clean air bans'i'nto effect, 'both public.use and • Eichler's use of the City landfill site has dramatically increased. He also pointed out - that the private hauler is bringing refuse collected outside the City and dumping it in • 280 NOVEMBER 29, 1971 • the City landfill site. He further stated that the land fill site, which was to last three years, will last only one year. Council members discussed the possibility of try- ing the method of charging for a three month period of time and then reviewing the record for that three months. Mayor Larson then calked for a roll call vote on Ordinance No. 1360 and the motion passed: carried,. Brown, Keith, Lambert, Larson, Lust and Robinson voting aye on roll call. McNeice absent. Mrs. Stewart again reminded the,.Counci'1 that the shrubs on the corner of 24th Avenue and Nob Hill Boulevard overhung the sidewalk and that nothing had been done about them since the previous meeting of November 22, 1971. City Engineer Fritz Jaeger reported that the matter of shrubs over the sidewalk on 24th Avenue and Nob Hill Boulevard had been taken care of on this date, but he had not personally checked it. Mr. Frank Pierce reported that lights were needed on the south and east ends of the Little Theatre building in Gilbert Park, and that perhaps the lighting in the park needs some study. This matter was informally referred to the City Manager. As a matter of information, the Official Statement of Canvass for November 2, 1971 Gene -' ral Election was reviewed. No formal action needed. It was MOVED by Keith, seconded by Lust, that Resolution No. D -1762 authorizing the City Manager of the City of Yakima engage services of R. S. Cameron & Associates, A.I.A., for landscape architectural services, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust and Robinson voting aye on roll call. McNeice absent. City Manager McMicken explained that Mr. Cameron has offered to +perform landscape architectural services at the new Englewood Avenue Equalizing Reservoir; "specifically involving screening on 40th Ave- nue between Mrs. Plath's residence to the west and the reservoir to the east. He fur- . ther explained that Mr. Cameron's fees for doing this work would be $20.00 an hour for architects' time and $12.50 an hour for draftsmen. RESOLUTION NO. D -1762, A RESOLUTION authorizing the City Manager of the City of Yakima to engage services of R. S. Cameron & Associates, A.I.A., for landscape architectural ser- vices. . . City Manager McMicken reported that the City needs assistance in acquiring Street, Park, and Fire properties, and that for this purpose we wish to engage George Lemon. He ex- plained that the fee for these services is based on.$125.00 for an eight hour day, subject to the following: ' 1. It is assumed that the City of Yakima will furnish the following: (a) Title Reports when necessary. (b) Maps of parcels involved showing parts of these areas to be taken and prox- imity to important improvements. (c) Staking of parcels when necessary or requested by the owner. (d) Legal descriptions of the taking and all documents of conveyance. (e) All maps and documents required by mortgagees in cases requiring partial releases of mortgages. 2. The privilege is reserved to perform such services after business hours and on weekends when necessary to make appointments. 3. The privilege is reserved to engage the professional services of others, exper- ienced and qualified, when deemed necessary, to expediate the work; it being un- derstood that Mr. Lemon will be personally responsible for the actions of such persons engaged. It was MOVED by Keith, seconded by Brown, that the City Manager be authorized to engage George Lemon for professional services in acquiring Street, Park and Fire properties: carried, Brown, Keith, Lambert, Larson, Lust and Robinson voting aye by voice vote. McNeice absent. City Manager McMicken reported that Mr. RichardJ.,Sauve has submitted an outside utility request for service to property located at,1117 South 41st Avenue, that this application is for sanitary sewer to serve an existing single- family dwelling, and that the Planning Staff recommends approval. After due discussion, it was MOVED by Robinson, seconded by Keith, that said outside service be approved in, accordance . with the recommendation of the Planning Staff and the usual signing of an outside utility agreement: carried, Brown, • Keith, Lambert, Larson, Lust and Robinson voting aye by voice vote. McNeice absent. City Manager McMicken referred to the matter of the Damage Claim filed by Wauna O. Harman in the amount of $54.85 for reimbursement fcrdamages done to bread rolls due to alum in the water, which was continued for one week for more investigation. City Attorney Andrews reported that said claim has been withdrawn and no further consideration will be neces- sary. Council members wishing to express their thanks to Mr. and Mrs. Harman, it was MOVED by Robinson, seconded by Lambert, that the City Manager be authorized to transmit a letter of thanks to Mr. and Mrs. Harman: carried, Brown, Keith, Lambert, Larson, Lust and Robinson voting aye by \a ice vote. McNeice absent. City Manager McMicken referred to the matter of authorization to pay two Damage Claims and explained that these have been investigated and recommended payment. 1. It was MOVED by Brown, seconded by Keith, that Resolution No. D -1763 authorizing payment of a claim for damages in the amount of $403.27, filed with the City by Virgil Keller, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust and Robinson voting aye on roll call.
