NOVEMBER 22, 1971 • MINUTES OF SPECIAL MEETING • YAKIMA CITY COUNCIL NOVEMBER 22, 1971 Pursuant to a call by the Mayor, a special meeting of the Yakima City Council was held at 1:30 P.M. in the Conference Room at Yakima City Hall. Councilmen present at the meeting were: Mayor Larson, Wray Brown, Walter Robinson, James Lust, Royal Keith,. Lenore -Lambert and Don McNeice. Also attending were'Councilmen- elect Don Schussler and William Whitaker. City Manager McMicken, City Attorney Andrews and Admi- nistrative Assistant James Williams also attended. The City Manager and Council discussed possible members for various City boards and commi- sions. No decisions were reached., . • The special meeting adjourned at 3:00 P.M. REGULAR MEETING - MONDAY, NOVEMBER 22, 1971 - 3:00 O'CLOCK P.M. . The City Council then met in regular session at the hour of 3:00 P.M., Mayor Larson, Coun- cilmen Brown, Keith, Lambert, Lust, McNeice and Robinson, City Manager McMicken and City Attorney Andrews were present on roll call. . The Invocation was given by Councilman Keith. The minutes of the regular meeting of November 15, 1971, having been duly certified accu- rate by two Councilmen, and no one present wishing to have' said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing oh Rezone Application filed by Mr. Archie Hill requesting rezone of property located at North 24th and Lincoln Avenues, Jay Otto, Planning Director reported that the original petition included a request for the rezoning of eight lots located northwest of the intersection of Lincoln Avenueland North 23rd Avenue from R -2 Two- Family Zone to.R -3,. Multi- Family Zone. in order to construct condominiums on the site. • Mr. Otto reviewed the Staff Report of October 29, 1971, and explained -that at that time the Staff felt that this was an excellent area for multi- family development due to the proper- ties relationship to trafficways, neighborhood shopping facilities, schools and public tran sportation; however, because of special problems as to the access and relationship to exis- ting development, the Staff felt that R -3, high- density residential was not appropriate, and it was suggested that this matter be continued and the applicant'be urged to change his request to.Planned Development. He further explained that since Restrictive Covenants and Easement for Restric Lion -of Access has been prepared, by which access to the property and the height• of the buildings constructed are to be controlled, the Planning Department and Planning Commission recommends the approval of this rezone. Attorney Max Vincent, repre- senting the.petitioner, indicated that this rezone would be a good buffer from the traffic and commercial activity associated with Lincoln Avenue. Present and protesting this pro- posed rezone were Mr. George K. Hislop and Mr. William Doorer. Their main objections were directed to the traffic problems that would be•involved and the possibility of devaluation - of property adjacent a multi - family complex. After due discussion, it was MOVED by , . seconded by McNeice that Ordinance No. 1356 accepting the recommendation of the Planning Commission and rezoning certain property situated at North 24th and Lincoln Avenues in the City of Y akima, Washington, from R -2, Two- Family Zone, to R -3, Multiple- Family Zone, be passed as read: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Lust not voting because of a conflict of interes - t.' ORDINANCE NO. 1356, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at North 24th and Lincoln Avenues in the City of Yakima, Washington, from R -2, Two- Family Zone, to R -3, Multiple= Family Zone. Petition No..712, having been filed with the City Clerk on November 18,:1971, by Donald Brule and Others, requesting annexation of property located on the west side of 48th Avenue west of Randall Park, it was MOVED by Lambert, seconded by Brown that the Petition for An- nexation filed by Donald Brule and Others, being Petition No. 712, be approved as meeting the requirements of law; that said Petition be referred to the City Manager and Planning Commission for study and recommendation; and that December 13, 1971 be set as the date for a public hearing by. the City Council on this Petition: carried, Brown, Keith, Lambert, Lar- son, McNeice and Robinson voting'aye by voice vote. Lust not voting because of a conflict of interest. Petition No. 725, having been filed with the City Clerk on November 18, 1971;;'by Donald Brule and Others, requesting improvement of property by the construction of curbs, gutters and surfacing of streets located in proposed plat of Randall Park Addition, it was MOVED by Robinson, seconded by Keith that Petition No. 725, for the creation of ,a Local Improvement District,.be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, lambert, Larson, McNeice 'and voting aye by voice vote. Lust not voting because -of•a conflict of interest. • A Damage Claim having been filed with the City Clerk on November 12, 1971, by Ernest Ray Bell, 2117 South 1st Avenue, for damages in the amount of $35.00 for unnecessary storage fees caused by an'error by the Yakima Police Department, it was MOVED by Brown,- seconded by Keith that Resolution No. D -1753 authorizing payment of said claim for damages filed with the City by Ernest Ray Bell, be passed as read: carried, Brown, Keith, Lambert, Larson, • Lust, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D- 1753, -.A RESOLUTION authorizing payment of a damage claim filed with the City by Ernest Ray Bell. A Damage Claim having. been filed with the City Clerk on November 17, by Mrs. James E. Coughlin, 810 East Chestnut Street, for damages in the amount'of $20.53 caused by a sewer backup, it was MOVED by Keith, seconded by McNeice that said damage claim be,referred to th :. City Manager and Staff for study and recommendation: carried, Brown, Keith, Lambert, Larson Lust, McNeice and Robinson voting aye by voice vote. 277 NOVEMBER 22, 1971 • An Ordinance appropriating $40,000 within the Firemen's Relief and Pension Fund, having been read in its entirety on November 15, 1971, and being read by Title only at this meetin , it was MOVED by Keith, seconded by Robinson'that Ordinance No. 1357 appropriating the a- . mount of $40,000 from unappropriated money in 632- Firemens Relief and Pension Fund to Ac- count 632.522.20.13, Pensions, of the 1971 appropriation for such fund, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll,call. ORDINANCE NO. 1357, AN ORDINANCE appropriating the amount of $40,000' from unappropriated money in 632 - Firemens Relief.and Pension Fund'to Account 632.522.20.13, Pensions, of the 1971 appropriation for such fund. An Ordinance appropriating various amounts of money to various departments and accounts for the 1971 Budget, having been read in its entirety at this meeting, was laid on the table for one week or until November 29, 1971. City Manager McMicken explained that this appro- priation in the amount of $15,810.00, is necessary for the purpose of paying salaries to City employees hired pursuant to the Emergency Employment Act program, to provide addition- - al funds omitted from Final 1971 Budget in error, and to provide additional funds for hiring temporary help during the absence of permanent personnei.T_. • A Mrs. Stewart appearing before the City Council called their attention to a blind corner at 24th Avenue and Nob•Hill Boulevard, and requested that something be done about the shrubs causing the problem. This matter was informally referred to the City Manager for action. City Manager McMicken reported that the firm of Gray and Osborne, Consulting Engineers has informed him that the Town of Union Gap plans, this winter, to construct a water main in South First Street to the North Corporate- Limits to serve both domestic water and fire protection. He explained that officials of Union Gap would like to meet with Yakima of- ficials to discuss the possibility of a physical connection between the two water systems • for the purpose of supplying water from one system to the other during emergency periods such as a large fire in this area. City Engineer, Fritz Jaeger reported that there have been two additional requests for similar service, for a warehouse for the Sears Roebuck and Company Complex which is located south and•westerly of the South Circle Mall Complex across First Street, and also a request for sewer and water for a parcel of ground just north of Case Power and Equipment which is located just south of the Mall. Larson, Lust, McNeice and :Robinson voting aye by' -voice vote.' • City Manager .McMicken presented Ernest Goad, Water Pollution Control Plant Operator, with a Water Pollution •Control Plant Operator Certificate of • Competency. City Manager McMicken reported that Mayor Larson has been informed by the Federal Committee on Standard Metropolitan Statistical Areas that the City of Yakima has been designated as • a Standard Metropolitan Statistical Area on theiBasis:bf•information developed from'the.• 1970 Census of Population. He explained that this area is initially defined as•Yakima County. He further explained'that when further data from the Census becomes available, these definitions will be.reviewed: .:determine whether other counties have a. sufficient degree of social and•economic "integration to justify being -added to them,. and that should additional counties qualify for inclusion in the areas, appropriate action will be taken promptly. City::Manager McMicken?reported that recently the :City of'Yakima embarked'on the study of the TOPICS program within the Urban Area and retained Stevens Thompson and Runyan, Incor- porated to assist. He explained that the towns of Selah and Union Gap wish to participate in this study,. and. that Harold Sweet,' Yakima County Director of: Public Works and Les' Con- rad, Yakima County Commissioner are requesting that the present agreements be'amended with the necessary supplements in order to include•ali of the. streets and highways in the Urban • Area••of iYakima He +further =explained that -this method bf supplemental agreement to Yakima Cities approved TOPICS study will•lead•to federal assistance ih.solving.some of the traffic safety-and capacity problems - in .our area. Mr. , McMicken- stated• that he will pro- ceed to have the consultant draw up an additional contract and bring it back to the Council for more formal action. . City Manager McMicken explaining that in order to accommodate work contemplated by the Washington State Highway Commission along the Naches Highway, it is necessary to remove or relocate and. reconstruct •portions :of 'the' City's water• transmission line along. that:high- way, - and that- •an. :agreement•;w.ith the "•State.'Highway: Department for. the - City• Water••D.ivision to do. this •work : - has.•been- drawn ' • it was•. D -1754, A RESOLUTION authorizing and• directing. - the• City: Manager: and City Clerk of the City of Yakima to execute an agreement with the Washington State Highway Com- mission for the removal of 'relocation •and: reconstruction of a :portion of the City's water transmission line along the: Naches Highway. • : - • .. .. • City Manager McMicken referred to the matter of authorization to execute an Amended Con- tract with HUD for a Grant to finance construction of the Southeast Yakima Community Center and explained that an.additional allocation has been granted for this project,,and it is necessary to execute this Amendatory Grant Application. He stated that this would make the total amount of the Grant $474,249. RESOLUTION NO. D -1755, A RESOLUTION approving and providing for the execution of a proposed Contract for Neighborhood Facilities Project under Section 703 of the Housing and Urban: • Development Act of 1965, numbered Contract No. WASH N -8(G) (First Amendatory), by and be- . tween the City of Yakima and the United States of America. • I NOVEMBER 22, 1971 • • City Manager McMicken referred to the matter of authorization to apply to the Traffic Safety Commission, State of Washington, for a Safety_ Grant, and stated that this funding is for certain kinds of improvements to traffic safety which are to reduce death and accidents. He stated that the City is proposing to'submit the $5,175 application to the Traffic and Safety Comm'i'ssion; which will include•four items (1) a portable video camera, (2),a breath- alyzer, (3)' video tapes, and '(4) permanent and. strategic-placement of a vedeo deck and visual monitor within the district. After due discussion, it was MOVED by Brown, seconded . by Robinson that Resolution No. D -1756 authorizing the City Manager of the City of Yakima to apply to the .Traffic Safety Comm - ission, State of Washington, for a safety' grant, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust•, McNeice-and Robinson voting aye on roll call. . RESOLUTION NO. D -1756, A RESOLUTION authorizing the City Manager of the City of Yakima to apply to the Traffic Safety Commission, State of Washington; for a safety grant. • City Manager'McMicken.referred to the matter of authorization to pay five Damage Claims • and explained that • these have'been investigated and recommended payment: ' 1.
