HomeMy WebLinkAbout11/08/1971 Business Meeting r/ 272 • NOVEMBER 8, 1971 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Lambert, Lust, McNeice and Robinson, and City Attorney Andrews present on roll call. City Manager McMicken and Assistant City Manager Friedline absent. The Invocation was given by. Councilman Lust. The minutes of the regular meeting of November 1, 1971, having been duly* certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Lar son declared said minutes approved as recorded. This being the time fixed for the Hearing on Petition No. 715, filed by Dan Davis and John Noel, Jr., requesting Vacation of a portion of South Rainier Avenue, Jay Otto, Director of Planning and Development, reviewed the matter, referring to the Planning Staff Report and the Planning Commission minutes, which explain that the proposed land use is for a truck maneuvering area to be used in conjunction with the operation of Associated Grocers Mr. Otto reported that the Planning Staff and Planning Commission recommend approval of the street vacation contingent upon the following: 1. That existing utility easements be reserved. 2. That the existing parking strip adjacent to Naches Avenue be landscaped and main- tained in a manner compatible with a residential' neighborhood. Mr. Benjamin Chandler, Mrs. Frances L. Arnold, Mrs. Tommy Lee Brown and Mr. Johnnie Rance, property owners in the vicinity of the recommended street Vacation, being present, spoke a- gainst the vacating of the alley adjacent to Rainier Avenue (Petition No. 722, filed by Dan Davis and John Noel, Jr., requesting Vacation of said alley, to be presented later on in this agenda). The property owners complained that the loud noises and disturbances created by the trucks would be increased. Mr. Tom C. Wiitala and Mr. Albert L. Harrison, repre- senting Associated Grocers, spoke in behalf of the petition and indicated that the present noise level will not change, and that their firm would cooperate and follow the recommenda- ' tions of the planning staff. After due discussion, it was MOVED by Keith, seconded by Ro- binson that Ordinance No. 1352 providing for-the vacation of said right of way, be passed as read: carried, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. Brown not voting because of a conflict of interest. ORDINANCE NO. 1352, AN ORDINANCE providing for the vacation of a: portion of street right of way in the City of Yakima, Washington. This being the time fixed for the Hearing on the Planning Commission's recommendation to amend certain provisions of the Zoning Code, Planning Director, Jay Otto, explained that this amendment would permit lower cost of land acquisitions, and that the Planning Commis- sion has recommended to the City Council that an Ordinance amending Title 12, "Zoning" of the Yakima Municipal Code be passed. After due discussion, it was MOVED by Brown, seconded by McNeice that Ordinance No. 1353 relating to Zoning and amending the Yakima Municipal Code, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on .roll call. ORDINANCE NO. 1353, AN ORDINANCE relating to zoning; providing that no property use shall become nonconforming by reason of conveyance or appropriation of a portion of such property for street right of way; repealing a definition of "front yards "; adding a new section 12. 64.100 and repealing. Section 12.60.090, both of the City of Yakima Municipal Code; and de- claring an emergency. Petition No. 722, having been filed with the City Clerk on November 5, 1971, by Dan Davis and John Noel, Jr., requesting Vacation of an alley adjacent to Rainier Avenue, it was MOVED by Robinson, seconded by McNeice that the petition of Dan Davis and John Noel, Jr. for the vacation of the alley, as set forth in Petition No. 722, be referred to the City, Manager and the Planning Commission for study and recommendation: carried, Brown, Keith, Lambert,- Larson, Lust, McNeice and Robinson voting aye by voice vote. It was MOVED by McNeice, seconded by Robinson that Ordinance No. 1353 authorizing and direc ting the foreclosure of delinquent irrigation maintenance assessments, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1354, AN ORDINANCE directing the City Attorney of the City of Yakima to in- stitute foreclosure proceedings on certain property for which irrigation maintenance assess ments are unpaid and delinquent. The Planning Commission recommending approval of Rezone Application filed by Mr. Archie G. Hill, requesting rezone of property located at North 24th and Lincoln Avenues, it was MOVED by Robinson, seconded by Brown that November 22, 1971, be fixed as the time for a Hearing o� this matter: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Planning Director, Jay Otto, explaining that Mr. Stanley R. Medsker, representing Autotronii Systems, Inc., has requested that the action on an application for utility service at 1705 West Lincoln Avenue (outside City), be delayed a week, it was MOVED by McNeice, seconded by Keith that action on this matter be continued until November 15, 1971: carried, Brown, Keit', Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Mayor Larson stated that, this' Resolution was necessary in the absence of City Manager McMicken and.Assistant City Manager Friedline. RESOLUTION NO. D -1749, A RESOLUTION appointing City Attorney Fred H. Andrews as Acting City Manager. . IIII In accordance with the Yakima City Charter and State Statute,' Acting City Manager' Andrews submitted the preliminary budget for the City of Yakima' for the year 1972, and reported' that a copy has been filed with the City Clerk on this date. Mr. Andrews further reported that due notice will be given fixing the time for public hearing on the matter of the'1972 Budget for the hour of 3:00,o'clock P.M.. on Wednesday,' December 1, 1971, as required by ' Statute. After due .discussion, it was MOVED by :Robinson, seconded' by McNeice- that the f i -'.; ling of-the 1972 Preliminary Budget with the City Council for their study and recommenda- tion on this date be acknowledged: carried, Brown,* Keith,' Lambert, Larson', Lust, McNeice • and Robinson voting aye by voice vote. • ' Acting City Manager Andrews referred to City Manager Reports #134 Solid Waste Management: Proposed Rate Changes, #135 Tahoma Cemetery - Proposed Rate Increase and #136 Purchase of New Buses, stating that these have been prepared by City Manager McMicken and are being filed with the City Council for information and study.' . • Mayor Larson reported on a letter received from the Yakima County Board of County Commis- sioners regarding the local.0E0 Action Program. Mr.'Larson stated that one of the require- ments of OEO is that the Administrative Board be composed of 1/3 public officials, and that the'Board of County Commissioners would like the Council to select a representative and an alternate to serve on this-Board. After due discussion, it was MOVED by Robinson, seconded by Lambert that Mayor Larson represent said Administrative Board and that Councilman Lust be an alternate: carried, Brown, Keith, Lambert, McNeice and Robinson voting aye by voice vote.
