OCTOBER 4, 1971
The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith,
Lambert, Lust, McNeice and Robinson, City Manager McMicken and City Attorney Andrews presen
on roll call.
The Invocation was given by Councilman Brown.
The minutes of the regular meeting of September 27, 1971, having been duly certified accu-
rate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor
Larson declared said minutes approved as recorded. .
This being the time fixed for the Hearing on Petition No. 699, filed by Mr. and Mrs. Horace
Powell, requesting annexation of property situated at 4310 W. Nob Hill Boulevard, Director
of Planning and Community Development, Jay Otto, reviewed this matter. He explained that
this annexation does not require review by the Planning Commission for the following reasons:
(1) it is a single residential lot, (2) conforms with *zoning and existing residential de-
velopment in the surrounding area, (3) eliminates an irregular jog in the City boundary, and
(4) conforms with the General Plan. It having been established that no action is necessary
by the•Yakima County Boundary Review Board nor the Planning Commission, it was MOVED by
Brown, seconded by Robinson that Ordinance No. 1344 annexing said property, be passed as
read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll
call. .
ORDINANCE NO. 1344, AN ORDINANCE annexing property to the City of Yakima and zoning said
property.
Petition No. 716, having been filed with the City Clerk on October 1, 1971, by C.C. Syno-
ground et al, requesting improvement of property by the paving of an alley between South 7th
and South 8th Avenues, Chestnut to Walnut Street, it was MOVED by Robinson, seconded by Lam-
bert that said Petition No. 716, requesting the creation of a Local Improvement District, be
referred to the City Manager and.Staff for study and recommendation: carried, Brown, Keith,
Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote.
A Damage Claim, having been filed with the City Clerk on October 1, 1971, by Virgil. Keller,
702 N. 80th Avenue, for damages in the amount of $892.77 caused by a sewer backup, it was
MOVED by Lambert, seconded by Brown that said Damage Claim be referred to the City Manager
and Staff for study and recommendation: carried, Brown,. Keith, Lambert, Larson, Lust, McNeic-
and Robinson voting aye by'voice vote. .
It was MOVED by Robinson, seconded by McNeice that Ordinance No. 1345 relating to traffic
control and regulating turning movements on public streets, be passed as read: carried,
Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. City
Attorney Andrews explained briefly that this ordinance was made necessary by the fact that
presently in the City Code there is no provision that relates to the left turn movements on
a one -way street, and this ordinance brings the City Code into conformance with the State
laws, by the adoption by reference of certain State statutes. Mr. Andrews stated that there ,
is a committee group that is currently updating traffic statutes. After discussion by Coun-
cil members, Police Chief, Robert Madden informed the Council that our Traffic Engineer, Al
Ray, is coming out with a complete education program in regards to signing and striping, and
there will be diagrams accompanying it.
ORDINANCE NO. 1345, AN ORDINANCE relating to traffic control; authorizing establishment of
markers, buttons and signs for directing traffic and requiring obedience thereto; amending -
Section 9.15.010 and 9.70.130, and repealing Section 9.15.040, all of the City of Yakima
Municipal Code; and declaring an emergency. .
It was MOVED by Keith, seconded by'McNeice that Ordinance No. 1346 fixing and.. levying ad va-
lorem taxes for. the 1972 Budget for the City of Yakima, be passed as read: carried, Brown,
Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. City Manager
McMicken explained that pursuant to a report on the current status of estimated revenue and
estimated expenditures for the 1972 Budget for the City of Yakima, the City Council finds
that the total net . amount of $1,726,511 in revenue must be raised by ad valorem taxes on
real and personal property within the corporate limits of the City, which amount is not in
excess of the amount authorized by law to be raised from that source, and reviewed the mat-
ter briefly. .
ORDINANCE NO. 1346, AN ORDINANCE fixing and levying the amount of ad valorem taxes necessary
to balance estimated revenue with estimated expenditures for the 1972 Budget for the City of
Yakima.
City Manager McMicken reported that the Federal Aviation Pdministration is moving to the
Weather Bureau building and is going to pay at the same rate as the Weather Bureau. He in-
dicated that the Parks and Recreation Department, who needs more room, will be moved into
this space on an interim basis. After due discussion, it was MOVED by Brown, seconded by
Keith that Resolution No. D -1728 authorizing the-execution of said lease agreement with the
United States of America for space in the Weather Building at Yakima Municipal Airport, be
passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting
aye on roll call. Mr. McMicken stated that there is a 30 -day cancellation clause in the new
lease.
RESOLUTION NO. D- 1728, 'A RESOLUTION authorizing and directing the City Manager and City Cler
of the City of Yakima to execute a lease agreement with the United States of America for
space in the Weather Building at Yakima Municipal Airport.
City Manager McMicken explaining that a City police car was damaged in the line of duty and
rendered inoperable so as to require immediate repair, and recommending that authorization
be given to hire work and purchase material for such repair without calling for bids, it was
MOVED by Robinson, seconded by Lambert that Resolution No. D -1729 authorizing said hiring
and purchasing be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and
Robinson voting aye on roll call.
RESOLUTION NO. D -1729, A RESOLUTION authorizing the hiring of work and the purchase of mate-
rials without calling for formal bids.
City Manager McMicken referred the matter of an application for Law and Justice funding for
"Yakima Center for Youth Development & Change, " submitted by the:Southeast Yakima Community
Center, to Henry Beauchamp, Director. Mr. Beauchamp explained that this program was deve-
loped to reduce juvenile delinquency in the southeast area, and would include a tutoring

program for all grades, a program -for high school drop -outs, training for preschoolers, job
training and pre- apprenticeship, and professional counseling for youth and their families.
He stated that the City of Yakima would act as a sponsor, and the total grant sought by thi-
application is $49,000; also, the length of time during which financial support will be re-
quired is three years. Lieutenant Bernard Kline, Police Department, explained that if the
Law and Justice application is approved and money is granted, it is only for one year at a
time, that it is a continuing program rather than a capital improvement. The Council ap-
proving of the program, it was MOVED by Keith, seconded by McNeice that Resolution No. D-
1730 authorizing and directing the application for a grant to finance a "Yakima Center for
Youth Development and Change ",,be passed as read: carried, Brown, Keith, Lambert, Larson,
Lust, McNeice and Robinson voting aye on roll call.
RESOLUTION NO. D -1730, A RESOLUTION authorizing and directing the Mayor of the City of Yaki
ma to apply to the State of Washington_for a grant for a "Yakima Center for Youth Develop-
ment and Change" project.
City Manager McMicken reviewed a report on Park and Recreation Department Finances re reduc
tion in swim pool fees. He summarized the revenues and expenditures of the Parks and Re-
creation Department 'from the year 1968 through 1970 and explained that the figures for 1970
through 1971 give as close an estimate as the Finance Department can provide, giving an in-
dication of how the operation is paying for itself. Mr. McMicken furtheryexplained that
, the figure of $29,000 for income in 1972 is not accurate if the proposal for a 104 swimming
fee goes into effect, and the cost of pool operation would be $51,966, because there would
be a reduction in cost of operation occasioned by having lockers automated and not using
young people to work in the lockers. He stated that on the other hand there would be a
loss in revenue from reduction of rates, the difference then being $6,000 greater deficit
than what we might otherwise anticipate. Mr. McMicken stated that although he is trying to
balance the Budget directed towards efficiency and economy of the City's operation, he is
concerned with the social impact of releasing young people from available employment by the
automation of the lockers. Several Council members concurred with Mr. McMicken's concern.
After due discussion, it was MOVED by Lust, seconded by. Robinson that the Council go on re-
cord as making a policy statement approving the recommendation by the Parks and Recreation
Commission of a reduction in swim pool fees to 104 per person providing the Park -Bond Issue
passes: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by
voice vote.
City Manager McMicken referred to an off - the - Agenda item, that of the Building Inspector's
monthly report, a copy of which was given to each Council member. Newell Pock, Chief In-
spector, reviewed this report for the information of the Council members.
City Manager McMicken' requesting authorization for out -of -State travel for Glen Pleasant,
Traffic Control Maintenance, to travel. to Portland°,. Oregon to attend the Trouble Shooting
Traffic Controller's Seminar, it was MOVED by Keith, seconded by Lust that said travel be
allowed: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by
voice vote. •- .
City Manager McMicken reported on a letter received from Dutch Schulz, Chairman of the Safe
ty Council blinker lights at busy intersections. He indicated that this matter is being
considered by our Traffic Engineer, Al Ray, for next years Budget.
City Manager McMicken, that there was a second funding of the Emergency Employment
Act, which picks up the funding of the position of Clerk - Typist in the Police Department,
previously requested, and invites us to make additional applications for funds if needed.
He stated that as of Friday, October 2, 1971, he had submitted to them' the following posi-
tions: (1) radio technician in Fire Department, (2). laborer position to be the attendant at
the land fill site, and (3) training and safety officer.
Fritz Jaeger, City Engineer, reported that on a number of occasions we have been contacted
by Mr. Arthur E. Newman, 3103 W. Lincoln Avenue, in regards to several accidents that have
occured on his corner. Mr. Jaeger explained that he has talked to Mr. Newman regarding the
situation and that he hasn't found anything faulty in the design of the road. He stated
that when Lincoln Avenue was widened, a retaining wall was put along the curb, and that
there is also a fence located on top of it. Mr'. Newman has stated that all of the accident-
have involved this fence and he is concerned about the possibility of cars overturning if
they hit the fence. After due discussion, it was decided that with the cooperation of Mr.
Newman, the City would consider a backfill and slope for the property in question.
Mayor Larson asking to be 'excused from the next meeting of October 12, 1971, it was MOVED
by Keith, seconded by McNeice that he be excused: carried, Brown, Keith, Lambert, Larson;
Lust, McNeice and Robinson voting aye by voice vote.
There being no further business to come before the Council, it was MOVED by Lust, seconded
by Keith that we do now adjourn at the hour of 4:55 P.M.: carried, Brown, Keith, Lambert,
Larson, Lust, McNeice and Robinson voting aye by voice vote.
