SEPTEMBER 27, 1971 The City Council met in regular session, Mayor Larson presiding, Councilmen Keith, Lambert, Lust and McNeice,•City'Manager McMicken and City Attorney Andrews present on roll call. • Councilmen•Brown and Robinson absent'on'roll call: Councilman Brown having been excused at the previous meeting; it was MOVED by Keith, seconded by -Lust that Councilman Robinson be ' excused from 'th'is mdet carried, Keith, Lambert, Lar'son,' Lust and McNeice voting aye by voice vote: The Invocation was given•by Councilman Keith. The minutes of the regular meeting of September 20., 1971, having been :. duly certified.accur- ate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the continuation of the Hearing on Petition No. 678, filed. by St. Elizabeth Hospital, requesting Vacation of a portion of South .9th Avenue right of way between Walnut and Chestnut, City Attorney Andrews reported that the hospital has not yet reached the point where the Vacation -is required or desirable. Mr. Andrews stated that there is -in rough draft form a. statement that will constitute -a memorandum of an agreement which will state a general understanding between the City and - hospital.and. requested that this Hearing be further continued. It was then MOVED by Lambert, seconded by McNeice that this Hearing be continued•to October 25, 1971:- carried, Keith, Lambert, Larson, Lust and McNeice voting aye by voice vote. Brown and Robinson absent. This being the time fixed for the Hearing on Rezone Application filed by The Church of the Central Assembly of God, requesting a Planned Development Zone located at 1002 -1006 South 3rd Avenue, Jay Otto, Planning Director reported that the plan submitted proposes the de- velopment of a 26 -unit apartment building to be located on a little over an acre site lo- cated southwest of the intersection of Stewart Street and South 3rd •Avenue, and that the project is intended to provide multi- family housing for the elderly in conjunction with the HUD, FHA Low - Income Housing Program. Mr. Otto stated'that the final plan and development program has been completed and the only deviation from the'preliminary plan involves the matter of off - street parking, the plan proposed in the preliminary form having included parking for automobiles, which has been changed the recommendation of the Staff to a little over one -half parking space per dwelling unit. Councilman. Lambert asked about par- king for guests, and Mr. Otto stated that in the event that parking demands exceed those currently envisioned, any, portion of the area to the south can be converted to off - street parking area. Thomas D. Harader, architect for Harader Mebust Schorr Co., reaffirmed that 50 per cent parking ratio is perfectly adequate. Mr. Otto explained that the Staff recom- mends that the property be rezoned to Planned Development in accordance with the final plan and program because the project is in conformance with the general plan, is located in close proximity to* neighborhood shopping facilities, and -is adjacent to public transit routes. It was then MOVED by Lambert, seconded by Keith that Ordinance No. 1339 accepting the re- commendation of the Planning Commission and rezoning said property, be passed as read: car- ried, Keith, Lambert, Larson, Lust and McNeice voting aye by voice vote. Brown and Robin- son absent. ORDINANCE NO. 1339, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 1002 -1006 South 3rd Avenue, in the City of Yakima, Washington, from R -2, Two- Family Zone, to a Planned Development Zone. This being the time fixed for the hearing on Rezone Application filed by Ed Baumgardner, requesting rezone of property located at 105 -115 North 5th Avenue, Jay Otto, Planning Di- rector explained that the property under consideration can be generally characterized as an older residential area that is in a state of transition to commercial use. Mr. Otto stated that the Planning Staff recommends approval of this rezone from R -3, Multi- Family Zone and B -2, Local Business Zone to B -3, General Business Zone, which is in conformance with the General Plan and with the general land use trends in the surrounding area. It was then MOVED by Keith, seconded by Lambert that Ordinance No. 1340 accepting the recommendation of II the Planning Commission and rezoning said property, be passed as read: carried, Keith, Lam- bert, Larson, Lust and McNeice voting aye by voice vote. Brown and Robinson absent. ORDINANCE NO. 1340, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 105 -115 North 5th Avenue and 106 -116 North 6th Avenue, Yakima, Washington,; from R -3, Multiple- Family Zone, and B -2, Local Business Zone, to B -3, General Business Zone. Petition No. 688, having been filed with the City Clerk on May 3, 1971, by Glascam Builders, Inc., requesting annexation of property situated at 58th and Chestnut, it was MOVED by Keith, seconded by Lust that the Petition for Annexation filed by Glascam Builders, Inc., being Petition No. 688, be approved as meeting the requirements of law; that said Petition be referred to, the City Manager and Planning Commission for study and recommendation; and that October 12, 1971, beset as the date for a public hearing by the City Council on this Petition: carried, Keith, Lambert, Larson, Lust and McNeice voting aye by voice vote. Brown and Robinson absent. Petition No. 714, Notice of Intention to Commence Annexation Proceedings, having been filed with the City Clerk on September 23, 1971, by Dan D. Smith et al, requesting annexation of property situated at 57th and 58th Avenues between Chestnut and Walnut Streets, it was MOVED by Keith, seconded by Lust that this date be set as the time for a meeting with ini- tiating parties who signed the Notice of Intention to Commence Annexation Proceedings dated September 23, 1971, those initiating parties being Dan D. and Margaret I. Smith, Paul W. and Joan Peterson and Antonio and Ferntelle Alegri: carried, Keith, Lambert, Larson, Lust and McNeice voting aye by voice vote. Messrs. Smith, Peterson and Alegria, being present and indicating that they are willing to assume their share of the City's existing indebted- ness, it was duly moved, seconded and passed that the annexation proposed by petition no. 714, (Notice of Intention to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's existing in- debtedness, and that a Notice of Intention to Annex be filed with the Yakima County Review, Board. The above MOTION was made by Keith, seconded by Lust and carried, Keith, Lambert, Larson, Lust and McNeice voting aye by voice vote. Brown and Robinson absent. Petition No. 715, having been filed with the City Clerk on September 23, 1971, by Dan Davis and John Noel, Jr., requesting Vacation of a portion of South Rainier Avenue, it was MOVED by Keith, seconded by Lambert that the petition of Dan Davis and John Noel, Jr. for the vacation of the portion of South Rainier - Avenue, as set forth in Petition No. 715, be re- ferred to the City Manager and the Planning Commission for study and recommendation: car - ried, Keith, Lambert, Larson, Lust and McNeice voting aye by voice vote. Brown and Robin- son absent. • • 257 • • SEPTEMBER 27, 1971 An .Ordinance annexing property located East of South 48th Avenue and South of Nob Hill Bou- levard (N.A. :Medley and Randall Park) having been prepared in accordance with Council actio on September 20, 1971, it was MOVED by McNeice, seconded by'Lambert that Ordinance No. 1341 annexing said property be passed as read: carried, Lambert, Larson, and McNeice voting aye on roll call. Keith and Lust voting nay on roll call. Discussion by several Council mem- bers and Jay Otto, Planning Director, brought out that this type of housing would attract young families with preschool' children, and that the overall population density would be at least or more than single family., Mr. Otto explained that the timing of the annexation is controlled by the building permit. It was agreed by the Council members that this annexaticn would straighten out the City boundaries. . ORDINANCE NO. 1341, AN ORDINANCE annexing property to the City of Yakima, and zoning .said property. . An Ordinance transferring and appropriating the amount. $5,385 to the Parks and Recrea- tion Fund to provide funds for the balance of the .current year to create a recreational di- vision of the Department of Parks and Recreation and to implement a recreational program to be administered. by that department, having been read, in its entirety at the previous meetinc on September 20, 1971, and being read by Title only at this meeting, it was MOVED by Keith, seconded.by Lust that Ordinance No. 1342,;providing for said appropriation, be passed as read: carried, Keith, Lambert, Larson, Lust and`McNeice voting aye on roll call. ORDINANCE NO. 1342, AN ORDINANCE transferring the amount of $5,385 from 605- Contingency Func, to 131 -Parks and Recreation Fund; and appropriating that amount to various accounts of the • 1971 budget for 131 - Parks and Recreation Fund. . An Ordinance appropriating and transferring monies to the Southeast Yakima Community Center Fund to pay costs of the Southeast Yakima Community Center project and to accommodate a change in procedure of accounting for expenditures'from the Southeast Yakima Community Cen- ter FUnd.for that project, having been read in its entirety at the previous •meeting Sep - tember 20, 1971, and being read by•Title only at this meeting, it was MOVED by McNeice, se- • conded by Lust that Ordinance No. 1343 providing for said appropriation be passed as read: carried, Keith, Lambert, Larson, Lust and McNeice voting aye.•on roll call. Brown and Ro- binson absent. • • ORDINANCE NO. 1343, AN ORDINANCE appropriating the amount of $'40,000 within 382 - Cumulative Reserve Fund for Capital Improvements, and transferring that amount from that fund to 381 - Southeast Yakima Community Center Fund; and appropriating the amount of $176,506 to Account • 537. 20 .65 - ,•Construction•Projects,.of the capital outlay classification in the 1971 budget f r 381- Southeast Yakima Community Center Fund. , • • City-Manager McMicken referred the matter of a recommendation by the Parks and Recreation . Commission for reduction of swimming pool fees to Bill Hutsinpiller, Director of Parks and Recreation Department, who reported that at the September 14, 1971 Commission meeting he had presented a proposal that the - pool fees be lowered to an admission rate of 10 per per- . son and that a self - checking sys'tem'be installed within the pool facilities to encourage broader' use of the ,City's pools: Mr. Hutsinpiller gave cost 'breakdown for the proposed change in our pool's fee structure and stated that a large number of people are not -using the City's pools due to the existing cost, and that many of the people that are using the pools occasionally would use it more consistently if we had a lower admission rate. He also'stated that a'single rate fee is much easier to administer. Discussion by several Cou - cil members brought out that a. lower rate would be more encouraging for families to use the pools. After due discussion, it was MOVED by Lambert, seconded by Lust that this matter be referred to the City Manager and Staff for study and recommendation: carried, Keith, Lambert, Larson, Lust and McNeice voting aye by voice vote. Brown and Robinson ab- sent.• • City.Manager McMicken reported that a letter has been received from the 'Department of Hou- sing and Urban Development. acknowledging receipt of the grant requisition documents for Pro- ject WS- Wash -09 (River Road Pump House), which are presently under review, and stating that there is a new requirement concerning requisitions which asks .that a certified resolution be submitted which authorizes the City to execute requisitions for payment. After due discussion, it was MOVED by Keith, seconded by McNeice that Resolution.No.- D -1727 au- thorizing execution of said requisition for a grant payment be passed as read: carried, Keith, Lambert, Larson, Lust and McNeice voting aye on roll call. Brown and Robinson ab- sent. RESOLUTION NO. D -1727, A RESOLUTION authorizing the City Manager of the City'of Yakima to execute a requisition for a grant payment to the City from the U.S.. Department of Housing • and Urban Development. City Manager McMicken requesting that authorization be given for the City Engineer, Fritz Jaeger to travel to Portland, Oregon to negotiate with-Union Pacific •and Burlington-Northern Railroads regarding.'proposed crossings,.it was MOVED by Lust, seconded by McNeice that said trave.l.be authorized with'expenses paid: carried, Keith, Lambert, Larson, Lust and McNeice voting aye by voice vote. Brown and Robinson absent.
