Lambert, Lust, McNeice and Robinson, City Manager McMicken and•City Attorney Andrews presenu' on roll•call. • . • The Invocation was given by Councilman Brown. The minutes of the regular meeting of August 2, 1971, having been duly•certified accurate by two Councilmen, and no one present wishingYto have said minutes read publicly, Mayor Lar son declared said minutes approved.as. recorded. . This being the time fixed for the Hearing on Assessment Roll for L.I.D. No. 980, South Firs, Street and East Washington Avenue Sewer District, City Clerk, Marie Donelson, reported that written protests have been filed by Alfred H. Pitt and J. K. Manning. Public Works Directo,, John Mayo, reviewed the matter of forming this District and explained how assessments are computed.' After due discussion, it was MOVED by Brown, seconded by Lambert that Ordinance No. 1327 confirming said assessment roll be passed as 'read: carried, Brown, Keith, Lambert, • • • Larson, Lust, McNeice and Robinson voting aye on roll call. • ORDINANCE NO. 1327; AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 980 as'.created and established by Ordinance No. 1228 of the Ordinances of the City of Yakima. • A Damage•Claim having been filed with the City Clerk on August 6, 1971, by Robert P. Allen of 7245 Martin Way, Olympia, Washington, for damages to his automobile'in the amount of $393.02, caused by an accident with a City policeman, it was MOVED by Robinson, seconded by Lust that said Damage Claim :be referred to the City Manager and Staff for study, and recom- mendation: carried, Brown, Keith, Lambert,' Larson, Lust, McNecie and Robinson voting.aye by voice vote. the In accordance with action at July 26, 1971 meeting, where /matter was referred to City Manag:•r and Staff for study and recommendation, and an ordinance having been prepared prohibiting parking on the East side of North 7th Street from G Street to H.Street, it was MOVED by Keith, seconded by McNeice that Ordinance No. 1328 prohibiting said parking be passed as read: carried, Brown, Keith, Lambert, Larson,.Lust, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1328,_AN ORDINANCE relating to traffic, control; establishing no parking zones on certain streets prohibiting parking at all times; amending Section 9.75.040 of the City of Yakima Municipal Code by adding thereto Subsection 9.75.040 (x); and declaring an emer- gency. . Mr. Alex Deccio, pro tem Yakima Valley Visitors and Convention Bureau executive board chair man giving a- presentation on a request for $10,000 annually to•promote the local tourist in dustry, stated that among expenditures the. money would be used for are a tourist informatio center, a color slide presentation covering the major visitor attractions in the Yakima arei and increased travel of V & C personnel to make personal presentations to convention'site selection committees. Among those Convention Bureau members present speaking for the request were Al Bell, Jack Goetz, Ken Thompson, Ray Munly, Milton Tanasse, John Steiner, Chalmer Nance, Mike Mercy, Mike Benjamin, and Hugh.Davis. C. F. Findley, .only opposing audience • member, stated that the "plan of action" was good, but "appropriations always climb, they never go down." Ray Pittman, V & C executive secretary, gave statistics showing the size and effect of the tourist industry locally. After due discussion by Council members, it • was MOVED by Lambert, seconded by Lust that this matter be referred to the City Manager and Staff for study and recommendation: carried, Keith,'Lambert, Larson, Lust, McNeice and Ro- binson voting aye by voice vote. Brown not voting. After further discussion, a request fo $5,000 to cover the balance of 1971 was withdrawn. . . Reports having been received from Planning Commission on Rezone Applications filed by Mr. and Mrs: A. W. Stevenson, requesting rezone of property located at 9 South 10th Avenue, and by Glascam Builders, Inc., requesting rezone of property located at 40th and Nob Hill Bou- levard (N.E. corner), it was MOVED by Robinson, seconded by McNeice that August 1971, b= set as the time of Hearing:.on said Rezone Applications: carried, Brown, Keith, Lambert, Lar • son, Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken referred the matter of an Application for Outside Utility Service to Planning Director, Jay Otto, who explained that this is a request made by H. T. Buckman, the manager of Pyramid Orchards, 5105 W. Nob Hill Boulevard. He reported that Public Uti- lities Director, Frank Stein, investigated the operation and found that the office building of the company had sewer service although it has never been billed for such service. It wa determined that an unauthorized sewer connection had been Made :.in March, 1967. Mr. McMicket reporting that an Outside Utility Agreement has been signed by Pyramide Orchards, Inc. and that Planning Commission recommends approval of the request, provided Pyramid Orchards re- imburse the City of Yakima in the amount of $3 a month for the period that the unauthorized connection has been in existence, it was MOVED by McNeice, seconded by Robinson that said Outside Utility request be granted: carried, Brown, Keith, Lambert, Larson, Lust, and Mc- Neice voting aye by voice vote. Robinson not voting because of a conflict of interest. City Manager McMicken referred the matter of certification by Secretary of State annexing the City of Yakima to the Hi -Land Soil Conservation District, to City Clerk, Marie Donelson,• who stated that a copy of the "Certificate for the Addition of the City of Yakima to the Hi Land Soil and Water Conservation District" is -now on file in the City Clerk's office. City Manager McMicken referred the matter of the filing of the Regional Comprehensive Law and Justice Plan by the Yakima County Law and Justice Committee, to Councilman Lambert who discussed the Plan and explained that it is a guide for further applications for "action monies" for Yakima County. . City Manager McMicken explaining that there is only one source available to purchase air compressors for City buses, and recommending that authorization be given to purchase said equipment without calling for bids, it was MOVED by Brown, seconded by Robinson that Reso- lution No. D -1705 authorizing the purchase of said equipment without calling for bids, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1705, A RESOLUTION authorizing the purchase of repair parts for City buses without calling for bids. City Manager McMicken referring to the matter of a Canal Crossing Agreement, explained that the City of Yakima contemplates the construction of a public improvement project which will require the installation of a City water main and a drain line across right of way and uncle, a canal owned and operated by the.Naches- Cowiche Canal Company. After due discussion, it was MOVED by Brown, seconded by McNeice that Resolution No. D -1706 authorizing execution of said agreement, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1706, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a Canal Crossing Agreement with the Naches - Cowiche Canal Company. City Manager McMicken referring to an off - the - Agenda item, explained that the State Highway Department has advised Mayor Larson that there will be a transfer of a portion of old SR 12 Highway from State to City, effective January 1, 1972, which is to coincide with the openin• of the North Freeway By -pass. Mr. McMicken referred the matter to John Mayo, Public Works Director, who stated that prior to the actual return of the old highway, a joint maintenanc:. inspection by the State and the city will be made to ensure that the routine maintenance is • up to date. City Manager McMicken announced that Public Works Director, John Mayo, has resigned as of September 1, 1971, to take a position in Nigeria. Councilman Robinson asking to be excused from the next two meetings of August 16 and 23, 1911, it was MOVED by Lust, seconded by Lambert that he be excused: carried, Brown, Keith, Lambert'', Larson, Lust and McNeice voting aye by voice vote. City Manager McMicken requested authorization for out -of -State travel for Newell Pock, Chie' Inspector, to travel to Honolulu, Hawaii, to attend the International Conference of Buildi Officials. Mr. McMicken indicated that I.C.B.O. would pay the cost for attendance at the Board meeting to be held from October 1 through 5, and that the cost of attending the an- nual convention from October 6 through 13 would be $372. Council members indicating that they wished to have more information regarding the expenses, it was MOVED by Lust, seconded by Lambert that this matter be referred to the City Manager and Staff for further study and recommendation: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote.
