The City Council met in regular session, Mayor Larson..presiding. Councilmen - Lambert, Lust,
McNeice .and Robinson, City Manager McMicken and City...Attorney Andrews present on roll call.
Councilmen Brown and Keith.absent._.on. roll call.....Councilman Brown having been excused at a
previous meeting,. it. was MOVED.by Robinson, seconded. by McNeice that Councilman Keith be
excused from this..meeting: carried, Lambert, Larson,. Lust, McNeice and Robinson voting aye
by voice vote. •

and_ Keith. absent. _City .Attorney.. Andrews: explained._that. he had been requested .by Stuart
Semon,..Chairman..of...the_ Unfair. Housing ..Practices_Review._.Bo.ard., to draft the proposed amend-
ment to the unfair . housing _.practices...ordinance,...which .will...allow regular. meetings of the
Board to be cancelled by .the ..Chairman.. upon..his ..determinationthat ' no purpose would be
served by holding the..regular..meeting - and upon. a_.declaration 'to this .effect being made by •
the Chairman precedent__to.the.meeting being cancelled. .He • further explained that the ordi-
nance presently..requires.that the Review...Boar.d..meet. at. regular intervals not less frequent-
_ ly than one time. every. three months, that. there-is mo_provision for cancelling the regular
meeting, and many.times..no. business has. been conducted.. at. these meetings..
ORDINANCE. NO.. 1.326, AN ORDINANCE-..relating .to...public.... safety .and morals;' specifying the

. Board to hold meetings:and keep. certain records, and.. authorizing that Board to adopt rules

City Manager McMicken r.eported.that bids were.. received.and:considered by Bid Board on
July 28,_1971, on the.1971_Asphalt Concrete Overlay.project.as follows:

Superior.Asphalt & Concrete Co. 27,536.25
II The City Engineer recommending:. that ..the..contract...be...awarded: to Yakima Asphalt Paving Co.,
who submitted the lowest and.best_bid,_it was.MOVEDby Lust, seconded.by Robinson that the
recommendation _of. the.,Ci.ty Engineer be accepted_ and _ that the contract be awarded to Yakima
• Asphalt Paving Co., in the amount.of $26.,118..75,.and.that the City Manager be authorized
• to enter'into.a.contract- -with said.contractor.'upon the filing of the proper bond and in
surance: carried, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote.

City,.Manager..McMicken.referred to .the matter .of..Petition. No. 707, for the paving of the
Warehouse.Theater parking lot,:.which had been filed_..previously and referred the Staff
for study and.recommendation., and explained that this had been studied by the Engineering
Department. Discussion out that unless the Council has other ideas about how this
might.be funded,.it would.seem.that - it.should be an.expenditure from the Park Department.
Mr. McMicken.reported that the.. Park.Department has no. funds. for doing this type of project
. . at the present. -.time....• It was..suggested that this.is.a type.of.expenditure that should come
out of funds raised by a.Park. Bond issue and.informally agreed by the Council members that
this matter should be referred to the Park Commission for their consideration.

to meet with Don .Casad.,. Consulting .Engineer,.-...and _the_.railroads. regarding .:the. rubber padding
material proposed for the.. at- grade...crossings.. projects..,. _and..asked..Mr.. :, Mayo 'to" report, on this
trip. Mr. Mayo reported .that..the.y_ had.. attendedfour: separate_.meetings - . had - met with the
two railroads who want: to work .with the. City. of.. Yakima: on these. projects ; r and .within the
