The Invocation was given by Councilman Brown,. • The minutes of the regular meeting of June 21, 1971, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as • recorded. (No meeting was held on July 6, 19.71, due to the lack of a quorum.) . • This.being the year for the.election or re- election of four Councilmen to the Yakima City Council, and in accordance with State Statute, the City Clerk.provided numbers for the drawing for positions on the ballot. Councilmen "Wray Brown, Royal Keith, John Larson and Don McNeice, being encumbants, drew the following position numbers: Position No. 1 -- Wray Brown . Position No. 2 -= John M. (Jack) Larson . Position No. .3 -- Don McNeice • • Position No. 4 -- Royal Keith This being the time fixed for the continuation of the Hearing on Petition No. 678,. filed by St. Elizabeth Hospital, requesting Vacation of a portion of South 9th Avenue. right of way between Walnut and Chestnut Streets, and City Attorney Andrews requesting that this hearing be continued, it was MOVED by Keith, seconded'by McNeice that this Hearing be con- tinued to July 26,.1971: carried, Brown, Keith, Lambert, Larson, McNeice and Robin- son 'voting aye by voice vote. - This being the time fixed for the Hearing on the Nob Hill Boulevard, 24th to 40th Avenue, • Arterial Street Improvement, City Manager McMicken explained that the proposed project will provide for the widening of Nob Hill Boulevard between 24th and 40th Avenues, • expanding from its present 52 foot right of Way to 72 feet. It will include 62 foot side- walks and tree planting on both sides, two 13 -foot outside traffic lanes, two 11 -foot inside traffic lanes and a - 10 -foot left turn lane. He further explained that the project' will be UAB funded and read the schedule which has been 'set up so that the City will begin acquiring right of way in order that construction can begin in July or August of'1972. • Mr. McMicken stated that this Hearing is being held to consider revisions to the proposed projec -t and for approval.- He reported that the Planning Commission considered.this matter at their July 8, 1971, meeting and after extensive discussion unanimously recommended approval of the proposed project with one modification, which was a recommendation against the widening of 24th Avenue north of the north line of Nob Hill Boulevard, lased 'on-the following findings: . 1. The proposed widening of a portion of 24th willhave the. effect of making_24•th•.• between Tieton and Nob Hill Boulevard a more attractive facility and a secondary arterial connection between Tieton and Nob Hill Boulevard. 2. An improvement of 24th will encourage airport- destined traffic north of Hill Boulevard to use 24th rather than 16th, 32nd and 40th Avenues with the. accompanying detrimental effect on abutting res,idential..uses. 3. The use of 24th between Tieton and Nob Hill Boulevard as an arterial does not conform with the 1971 Arterial Plan presently-being' considered by the Planning • Commission. , • Mr. Al Ray, Traffic Engineer, explained in detail the proposed project answered questions. Present and speaking to this matter and objecting to the improvement because they felt that the improvement and widening'would- devalue their property and the result of the project will be more traffic and more congestion due to. the rail lines still in the street, were Hallie Rightmire, 3030 West-Nob Hill Boulevard, E1ry Granstrand,- - S: - 35th Ave—and Sig Carlson, 3104 West Nob Hill Boulevard.7 tIn discussion; Council. members.indi- cated that they are in favor of the project as proposed, and that they will accept the recommendation of the Planning Commission and approve the project as proposed with the exception of the Planning Commission'•s proposed'modification which 'was a recommendation .against the widening of 24th Avenue north of the north line of Nob Hill Boulevard. After due.discussion, it was MOVED by Robinson, seconded by Brown that the Nob Hill Boulevard, 24th to 40th Arterial Street Improvement project as proposed, be approved: carried, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. • Petition No. 706, having been filed with the City Clerk on July 6, 1971, by D.J. Develop- ment Company, requesting improvement of property by the construction of water - mains•for property between Pierce Street and Washington Avenue, East of Third Avenue, It was MOVED by Robinson, seconded by Keith that said Petition No. 706, for the creation of a Local Improvement District, be referred to the .City Manager and Staff for.study and recommenda- tion: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye voice vote. In accordance with action by the Council•on June 28, 1971, and an Ordinance establishing the 20 mile per hour speed limit on bicycle routes, having been prepared, it•was MOVED by Keith, seconded by McNeice that Ordinance 1320 establishing said speed limit on- bicycle routes, be passed as read: carried, Brown, Keith, Lambert, Lust and voting aye on roll call. Larson and Robinson voting nay.on roll • call. City.Manager McMicken reported that the bicycle'signs will be 'here August 10, 1971. Traffic Engineer Al Ray spoke to this matter relating the problems of putting up the required signs for changing the.speed limits, at this.time when -there are striping projects going on and towards the end of August there will be the remarking of the school streets. He stated that there will be 190 signs and 125 posts to install in addition to this regular work being carried on by r 22t JULY 12, 1971 the City personnel. Mr. Ray referred to the fact that several groups have been interested in promoting the bicycle routes and suggested that in order to facilitate getting these signs up quickly, that some volunteer help could be used, with one City person to super- vise. ORDINANCE NO. 1320, AN ORDINANCE relating to traffic control; designating speed limits on certain streets in the City of Yakima; and amending subsection 9.75.010 (a) of the City of Yakima Municipal Code. . Mr. Carl Clark, being present to request funds to establish a Teen Center, as listed on the agenda, stated that perhaps the request is a little premature as there will be a Youth Group Meeting Wednesday night to discuss the matter and they should come up with some plans and a request for funds may be made later. Mr. Frank Pierce, being present, filed a Petition with the Council and the City Clerk on this date signed by approximately 180 persons, requesting that the'road and parking strip in front of the Warehouse Theater, 5000 West Lincoln Avenue, be either blacktopped or oiled, as the dust is an asset to POLLUTION and is filling their homes and lungs. After due discussion, it was MOVED by Keith, seconded by McNeice that said Petition be referred to the CityManager and Staff for study and consideration: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. William Hutsinpiller, Director of Parks and Recreation, reported on the matter of the recommendation of the Planning Commission and the Parks and Recreation Commission for the site location of the Senior Citizens Center. He referred to the report of Doudna - Williams, Architects which he reviewed briefly indicating that they had investigated possible sites for the proposed Senior Citizen Center facility and four possible cites were selected and evaluated, which were 1. Existing Facility Site, 2. Madison School Site, 3. West of Miller Park, and 4. North of Miller Park, and recommended Site #4 as the most desirable site which is the property North of Miller Park and recommended also that the possibilities of the Vacation of "F" Street be investigated, which would make the site a contiguous part of the park. Mr. Hutsinpiller statedthat the Planning Commission and the Parks and Recreation Commission recommended approval of Site #4 for the proposed Senior Citizen Center facility. After due discussion, it was MOVED by McNeice, seconded by Brown that said site #4 be selected for the proposed Senior_ Citizen Center facility, and that further preliminary design and study be made as recommended: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. An Appeal from the Planning Commission's decision having been received by the City Clerk_ on July 8, 1971, re the request for outside water service, by Vernon G. Brookens, in the vicinity of 3909 Kerns Way, it was MOVED by Keith, seconded by McNeice that July 26, 1971, be fixed as the time for a Hearing on said matter: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Mr. Bruce Eyer, a representative of the'Yakima Public Schools, being present expressed the appreciation of the schools, for the cooperation of Jim Williams and City Attorney, Fred Andrews, in working on this matter. He suggested that the funds to be received from the proposed franchise; be diverted to public television for the aid of the schools. Discussion brought out that the determination by - the City Council of where the funds received from said proposed Franchise, would: be an independent action from granting said Franchise. • RESOLUTION NO. D -1692, A RESOLUTION authorizing and directing the Manager of the City of Yakima to invite proposals for " installation; operation and maintenance of a cable . television system (CATV). within the City of Yakima. . City Manager McMicken reviewed the current financial' status re fonaing of year round Re= creation Program, in accordance with Council action on June 14, 1971, when the City ' Manager and :Staff directed to'study this matter and•being'back a report as to the - ' feasibility and financing of the program. Mr McMicken also. reviewed the-1971 Budget as to the expenditures.and income in.the•'General Fund up to..the present time. After exten- sive discussion by Council members on this matter, it was MOVED by Lambert, seconded by Lust that the Staff be directed to create a Division of Recreation and proceed with the . employment Of 'a Recreation Superintendent:'carried, Keith, Lambert, Larson - ; Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken-referred to the matter of the approval. of the Six Year Arterial Street-Construction Program to Al Ray, Traffic Engineer, who explained that.the City annually prepares, reviews and adopts a Six Year Construction program for the construction of streets and arterial streets for the ensuing six year period as required by Chapter 35.77 of the Revised Code of Washington; He reviewed the proposed 'Six Year Construction Program for the period 1972 through 1977'and pointed the changes made from the previous year. Mr. Ed Loidhamer, from the Department of Planning reviewed the Planning Commission's recommendation at their meeting on July 8, 1971, re changes in priority designation of • 226. JULY 12, 1971 • of several of the individual items in the program as follows: Item 19 - Yakima Avenue At- Grade should be moved to Number 3 on the Priority.List; Items 13 and 14 -- Signalization of the intersection of Walnut at South 4th Avenue'and,South'4th Street should be moved to the bottom of the list for future c.onsid,eration, and approval. of said Six Year Construction Program with the changes in priority as noted. City Engineer Al explained that on the Yakima Avenue at Grade item #19, at the time this prepared, we were changing the scope and transferring the funds to the Walnut Street Underpass project, and that at the present time there are no UAB funds to do the Yakima Avenue At -Grade pro - ject. City Manager McMicken explained that in accordance with the requirement of the each year the Six Year.Construction Program is updated, by putting together all proposed projects, which includes those projects to be funded. Discussion brought out that these projects are not always taken care of in the order of proposed priority, but as funds become'available. Council'members indicating they see no need for changing the order of priority in the proposed Six Year Construction Program, it was MOVED by Brown, seconded by Robinson that Resolution No. D -1693 adopting.a Six Year Construction Program for the period 1972 through 1977, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. • , RESOLUTION NO. D -1693, A RESOLUTION adopting'a'Six Year Construction Program for the period of 1972 through 1977 for construction of streets and arterial streets in the City of Yakima. City Manager McMicken referred to his Report #127, Yakima.Valley-.Transporta Company -- Franchise Expiration and Renewal, which reviewed this matter, and explained that''in November of this year,. a 25 -year franchise ordinance expires which has allowed the Valley Transportation Company to operate and maintain railway tracks on certain public streets in Yakima, and the purpose of this rT ort is to review the. and operations of YVT - and explain the renewal procedure. Mr: McMicken recommended in his report that in order to begin negotiations on the drafting of a new franchise ordinance, he will take up the matter.with railroad officials if so directed the Council. Mr. :Gordon New- land, being present, stated -that he would like to see the YVT Franchise done away with. • After some discussion, on this matter it was MOVED by Robinson, seconded by Lambert that inquiry be'made as to whether the railroad wishes the franchise td be•reriewed and•if'so, to proceed recommended by the City Manager Report #127: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken reported that bids were received and considered on June 22, 1971, by a Bid Board, for the construction of the Englewood Avenue Water Pipeline and Overflow Pipeline as follows: A.V. DeBlasio, Inc. $ 99,987.83 . Salem Sand & Gravel Co. 132,733.49 C.J. Rockey Co., Inc. 134,820.35 Cornell, Howland, Hayes & Merryfield, Consulting Engineers and the CityEngineer recommen- ding that the bid be awarded to A.V. DeBlasio, Inc:; who submitted the lowest and best bid, it was MOVED by Keith, seconded by McNeice that the recommendation of the Consulting Engineers and the City. Engineer, be accepted and that the contract be awarded to A.V. DeBlasio, Inc., in the amount of $99,987.83; and at the City' manager be authorized to enter into a contract with -said contractor upon the filing of •the. proper bond and insur- ance: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by, voice vote. City Manager McMicken reported that one bid only'was received and considered by a Bid' : Board on July 9, 1971, on L.I.D."No. 983, K =Mart Water and Sewer District as follows: • Schedule I - -- A.V. DeBlasio • $:37,093.24 Schedule II -- A.V. DeBlasio 5,775.00 The City Engineer recommending that the bid be awarded to A.V. DeBlasio, Inc., who sub - mitted the only bid, which was lower than the City. Engineer's estimate, it was MOVED by Keith, seconded by.McNeice that the.recommendation of the.City Engineer be 'accepted and that the contract be awarded to A.V. DeBlasio, Inc., in the amount of $37,093.24 on Schedule I and $5;.775.00 on Schedule II, and'that the,CityManager . be authorized to enter into a',contract with said contractor upon'the filing of the proper bond and insurance: carried; Brown, Keith, Lambert, Larson, Lust, McNEice and Robinson voting aye by voice vote. City Manager McMicken referring to the City Engineer's Report on the completion of L.I.D. Assessment Roll: carried, Brown,•Keith, Lambert, Larson, Lust, and Robinson voting aye by voice vote. • City Manager McMicken explaining thatthe City and County contemplate conducting auction sale to dispose of surplus City and County property, it was.MOVED by Brown, seconded by Robinson that Resolution No.,D -1694 authorizing., the sale of said surplus personal property, be_passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. City Manager McMicken explaining that Offers to Sell right of way property for Mead Avenue improvements have been.received from Joe A. & Alice E. Moore, Terry and Stephen Glucoft and United Builders of Washington, Inc., it was MOVED by Robinson; seconded by Brown that Resolution No. D -1695 authorizing the purchase of said right of way property, be passed. as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call.
