R-2022-101 adopting the proposed 2022 Annual Action Plan for Community Development Block Grant (CDBG) and HOME Fund Programs as mandated by the Department of Housing and Urban Development (HUD). WHEREAS, the City of Yakima completed the Draft Annual Action Plan for 2022 as required annually by HUD as a requirement for receiving federal funds, and WHEREAS, in order to access the federal CDBG and HOME funds for year 2022, the city is required to submit an Annual Action Plan, and WHEREAS, the Office of Neighborhood Development Services fulfilled the requirements for two public input meetings held on July 19, 2022 and August 1, 2022 and provided an open 30 day written comment period from June 27, 2022 through July 26, 2022 WHEREAS, the federal funding amounts for the CDBG is $1,051,586 and HOME has been allocated $611,033 for the year 2022, and therefore, the proposed 2022 Annual Action Plan has been amended by staff to include those amounts as announced by HUD, and WHEREAS, the City Council of the City of Yakima finds it is in the best interest of the City and its residents to adopt the proposed 2022 Annual Action Plan for CDBG and HOME Fund Programs, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Council of the City of Yakima adopts the 2022 Annual Action Plan and the City Manager of the City of Yakima is hereby authorized to direct staff to submit the Annual Action Plan to HUD as required. Special Conditions. (a) The period of performance and single budget period for the funding assistance specified in the Funding Approval ("Funding Assistance") shall each begin on the date specified in item 4 and shall each end on September 1, 2029. The Grantee shall not incur any obligations to be paid with such assistance after September 1, 2029. (d) The grantee shall ensure that no CDBG funds are used to support any Federal, State, or local projects that seek to use the power of eminent domain, unless eminent domain is employed only for a public use. For the purposes of this requirement, public use shall not be construed to include economic development that primarily benefits private entities. Any use of funds for mass transit, railroad, airport, seaport or highway projects as well as utility projects which benefit or serve the general public (including energy -related, communication - related, water- related and wastewater -related infrastructure), other structures (e) designated for use by the general public or which have other common -carrier or public -utility functions that serve the general public and are subject to regulation and oversight by the government, and projects for the removal of an immediate threat to public health and safety or brownfield as defined in the Small Business Liability Relief and Brownfields Revitalization Act (Public Law 107-118) shall be considered a public use for purposes of eminent domain. For Meeting of: August 1, 2022 Final public input meeting and Resolution to consider citizen comments on the proposed 2022 Annual Action Plan (DRAFT) for Community Development Block Grant (CDBG) & HOME I nvestment funds Joan Davenport, Al CP, Community Development Director Archie Matthews, O N D S Manager (509) 576-6761 SUMMARY EXPLANATION: Every year the City of Yakima is required by the Federal Housing and Urban Development Department (HUD) to provide an Annual Action Plan that outlines the City of Yakima's Budget plans for using Community Development Block Grant (CDBG) entitlements funds and HOME Investment funds meet the needs of it's low to moderate income citizens with "eligible activities". The CDBG program has three primary objectives; to benefit low and moderate income persons, to assist with problems relating to slum and blight, and to assist with urgent health and welfare needs. The program can thus provide assistance in a broad range of activities and services, but at least 70% of all funds must be spent on assisting people with issues related to low income. The HOME program can only assist low/moderate income person with issues relating to housing; which can range from new construction of single family to rental housing and down payment assistance for first time homebuyers. The proposed 2022 Annual Action Plan "DRAFT" has been advertised for written public comment from June 27, 2022, through July 26, 2022. Any written comments received during the 30 day written comment period will be included in the final plan as submitted to HUD. The first public meeting was held on July 19, 2022.
