HomeMy WebLinkAbout01/25/1971 Business Meeting • 153 JANUARY, 25;: 1971 The City Council met in regular session, Mayor Larson presiding, : Councilmen Brown, Keith, Lambert, Lust,and McNeice, City Manager McMicken_ and City Andrews present on roll call. Councilman Robinson absent'on'roll call, having been excused at a previous meeting. The Invocation was given by Councilman Brown. The minutes of the regular meeting of January 18, 1971;, having.been certified accurate by two Councilmen, and no one present wishing to have. said .minutes read publicly,. Mayor . Larson declared said minutes approved as recorded.._ .. • • This time fixed for the continuation of the Hearing on Resolution of Intention No.' D -1541, to improve property located on the southwest corner of Lincoln and 16th Avenues, by construction of curbs, gutters, sidewalk and surfacing of streets, in acc- ordance with Petition No. 661, Mr. Wally Meyer, Attorney,'being present, stated that along with Mr. Elery VanDiest, he is representing Mr. E.. L. Clark, owner of. the American Oil ' Service Station'on the corner, and would like to have this matter continued another two weeks in order to try to arrive*at_an agreement with the Buttrey -Osco people regarding certain items that they have not able to negotiate satisfactorily on up to this time. PublicWorks` Director John Mayo `indicated that he feels that the people involved in this matter : should . know that it can't be prolonged indefinitely-because - the shopping center construction- might be completed before. this necessary street work is done, which would complicate matters. City Manager McMicken stated that letters have been received that in- dicates - that the parties involved have failed "to at any decision or agreement on • the matter. Mr. Don Bond; Attorney representing the Buttrey -Osco people, indicated that ° • his clients' are willing to go along with the .decision of the City Council on this matter, to either go ahead with the L.I.D. procedures, or have no ob to the request for a continuation for two weeks. He further stated that he does not think it matters whether they come to an agreement before the L.I.D. is created,:or not, that further negotiating can be done in either case. Mr. Meyer indicating that there is a possibility that they can arrive at some kind of an agreement if allowed this continuation, it was MOVED by McNeice, seconded by Keith that this matter be continued for two weeks or until February 8, 1971, with the understanding that .this is the final request for delay Cr 'continuation that will be authorized by the Council:'carried, Brown, Keith, Lambert, Larson, Lust and McNeice voting aye by voice vote. Robinson absent. ' This being the time fixed for .the Hearing on Rezone Application• filed by Michael M. Mercy, ■■•=- requesting rezone of property at.809 -811 South 14th Avenue, it was MOVED by Keith, secon- ded by McNeice that Ordinance No'. 1282 accepting the recommendation of the Planning Com- mission and rezoning said property, be passed as read. Mr. Jay Otto, Director of Planning and Community Development, explained that_the rezone, application is for the development of a six -unit two story apartment on two lots, with three units .on, each .level and ten off - street parking spots. He stated that the surrounding use in this area is primarily single . family, with R- 2.Zoning, but that the Land Use Plan forthe Vicinity.of Yakima Valley Col- lege recently adopted by the Planning.Commission and City Council a supplement to the General Plan recommends that.,to permit limited multi - family redevelopment with the densi- ties in helping with the existing single- family deve lopinent; that multi - family structures containing•six units;or less could be permitted on. a special per mit basis. Mr. Otto reviewed the'history ofthis rezone request over the past two years and reported that the Planning Staff had recommended'denial of thisrequest; that - the Planning Commission . approved the Preliminary Planned Development Plan at its meeting of December 4•, and on January 5, 1971, recommended -that the final development plan•be'approved. Mr:. Max Vincent,'Attorney, and Mr. Michael Mercy, being present, Mr. Vincent spoke.in favor • of this Planned Development rezone request and briefly - explained the program. and site plan as prepared and to be made a part, of the Ordinance authorizing said rezone. Council members indicated their approval of this Plan as presented as, they have discussed'previou`slythat. this'. College and Park area should have, multiple - family housing, and there` are wide streets and should not have any traffic problems. After due Discussion, Mayor Larson called ° for the roll call vote on the.Motion to pass Ordinance No 1282 accepting the recommendation F...-1 of the Planning Commission- and rezoning said property: Wand ''it carried,' Brown, `.Keith,.
