The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith,
Lambert, Lust, McNeice and Robinson, and. City Manager McMicken present .on roll call.
City Attorney Andrews absent and excused. .
The Invocation was given by Councilman Lambert,
The minutes of the regular meeting of December 21, havig been certified accurate by two
Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson
declared said minutes approved as recorded. .
Since a large crowd is expected to be heard on the matter of appointing a Housing Authority
it was MOVED by Robinson, seconded by Lust that this meeting be recessed. to reconvene at
the Yakima Valley Regional.Library: carried, Brown, Keith, Lambert, Larson, Lust, McNeice
and. Robinson voting aye by voice vote.

Mayor Larson having reconvened the meeting,. Clerk c the Council again called roll,
Councilmen Brown, Keith, Lambert, Lust, McNeice and Robinson and City Manager McMicken
present on roll call.
Several hundred people being present at this meeting, Mayor Larson explained that all who
wish to speak to the matter of whether .a Housing Authority should be appointed in theCity
of Yakima, will have,a chance to be heard. He instructed them to come to the front of the
room, state their name f'or the record and'make their presentation, trying not to repeat
what has been - previouuly discussed. Before Mayor Larson opened the meeting for discussion
from the. floor; City Manager McMicken and Director .of Planning and Community Development,
Jay Otto:reviewed the Housing Authority matters that have taken place to date. Mr.
McMicken referred to a Memofrom City :At.torney:AAndrews which explained•briefly the laws
applicable to housing authorities and expressed his legal-opinion on two questions con-
cerning the referral to the electorate of the City Council's action in implementing a
local housing authority,• which had been requested of him. The City Attorney'_s Memo . .
stated that he feels that theaction of the City Council in implementing a local housing
authority would not be subject' to a . "forced referendum' ", but that the City Council may .
voluntarily refer to the electorate a proposition as to or not a housing authority
should locally implemented, with the reservation that -the ballot is advisory only. Mr.
Otto briefly reviewed several items relative, to housing authority legislation. In re-
viewing the housing authority situation to date, Mr. McMicken explained that on August 31,
1970, a Petition signed by 99 persons was filed with the City Clerk and CityCouncil asking
the Council 'to appoint a.•housing authority, and attthat time the petition was referred to
the Housing and Renewal Committee. He stated that after study, they voted 11 to 2 to
recommend that the City Council appoint a Housing;Authority and the City Council 'fixed
this date as a time for a public hearing on the matter'. Mr. McMicken reviewed the letters
that have been received for and against the appointing of a• Housing Authority. Those
present and speaking in favor of a housing authority for the City of Yakima were, Mrs.
Phil. Pleasant, Dr. Warren Dean Starr, Mr. Clete Tune, Mrs. Magnolia Rance, Mr. Doug Peters,
Attorney, speaking - -for Mr. Beauchamp and the Southeast Community Center at Work, Mrs.
Rachael Corbin, Rev. Elwood Belfort,.Rev. Adams, Y.V.C.C.A., Mrs. Mary •Wakely, Mr. Charles
Patillo, Jean Bradford', with the Department of Special Assistance, Rev. D.H. Griggs,
Chairman of the Yakima Child Day Care Center, 516 S. 6th Street, Bob.Busenbark, Director of
the Wapato Community Center, Mrs. Lorene Carter, Mrs. Riley Kelly, Mr. Lester Zerr Mr.
Patrick Nagle, and Mr. Tom•Hopson, Those present.and,speaking against the appointing of
a housing authority for the City of Yakima, were Mr. Lorne House, representing the Pro
perty Owners Protective Association, Mr. Orman Wilson, Mr.-Lawrence Richey, Mr. Larry
Robinson, Della Wallbauer, Mr. 'Harold D. Huff; Mr. H.L. •Holmes, Mrs. Alvina Schlotfelt;
Mr. Joe Lee and Mr. Albert Lantrip. Those,speaking to this matter and other related topics
were Mr. Jack Franklin, Mr. Don Hunt and other persons who did not identify them-
selves. Council members indicating that they feel that the.people on both sides have
expressed themselves well, the Staff has submitted reports, and a decision should be made •
by them today, it was MOVED by Lambert,.seconded by'Keith that the City Council direct the
City Manager and Staff to prepare a resolution that will implement the housing authority
in the City of Yakima: carried, Brown, Keith,-Lambert, Larson,•Lust, McNeice and Robinson
voting aye by voice vote.

It was MOVED by Brown, seconded by McNeice that Ordinance No..1276 creating a Parks and
Recreation Fund as a special fund, be•passed as read:..carried, Brown,.Keith, Lambert,
Larson, Lust, McNeice and Robinson voting aye on roll call. City Manager 'McMicken ex-
plained that previously the Parks and Recreation funds have been in the current expense
fund and due to the new Budget accounting system it is necessary to create the Parks and
Recreation Fund.
ORDINANCE.NO. 1276, AN.ORDINANCE relating to .municipal finance; creating.a Parks and
Recreation Fund as a special city fund; specifying sources of revenue for such fund; desig-
nating the purposes of and the'manner of authorizing expenditures from such fund; creating
Chapter Parks and Recreation Fund, and Sections 3.84.010, 3.84.020 and 3.84.030 as
a new chapter and new sections of the City of Yakima municipal Code; and declaring an
emergency.
It was MOVED by McNeice, seconded by Robinson that Ordinance No. 1277 renaming Municipal
Garbage Fund and Municipal Garbage Fund and Municipal Garbage•Collection Service Fund as
Refuse Fund, be.passed.as•read:,carried, Brown, Keith, Lambert, Larson, Lust, McNeice and
Robinson voting aye on roll call. City Manager McMicken explained that this Ordinance
merely changes the name of these funds to Refuse Fund in accordance with the 1971 Budget.
ORDINANCE NO. 1277, AN ORDINANCE relating to funds and accounts of the City of Yakima;
amending the title of Chapter 3.36 of the City of Yakima Municipal Code to. change the name,
of a special fund; creating the "Refuse Fund" as a special fund of the City of Yakima;
amending section 3.36.010 of the City of Yakima Municipal Code; and declaring an emergency,
An Ordinance appropriating $10,000 within the Firemen's Relief and Pension Fund, having
been read in its entirety at this meeting, was laid on the table for one week or until
January 4, 1971. City Manager McMicken explained that this is an earmarked Fund in which
the monies deposited in it can only be used for pensions and that this is a new obligation
of that Fund. He further explained that the laws of the State.of Washington in 1970 re-
quired a new obligation of the cities: for financing retirement benefits which - entitles
certain retired personnel and widows to 2% increase retroactive back to the time of re-
tirement. Mr. McMicken stated that this matter has been approved by the Firemen's Relief
and Pension Board and that this Ordinance appropriates the money within the Fund for that
purpose.

'City Manager McMicken referring to an off - the - agenda item, an Ordinance relating to the
classification plan -and salary ranges for city employees and amending the Yakima Municipal
Code, and explaining that this Ordinance merely adds a section that was typographically
omitted from Ordinance No. 1264, it was MOVED by Brown, seconded by Mcneice that Ordinance
. No. 1278 relating to said classification plan and.salary - ranges, be passed as read: carried
Brown,.Keith, Lambert,- Larson, Lust, McNeice and Robinson voting aye bn roll call.
ORDINANCE NO. 1278, AN ORDINANCE relating to a classification plan and salary ranges for
city employees; amending Subsections (e) and (f) of Section 2.20.100 of the City of Yalima
Municipal Code; and declaring an emergency.
City Manager McMicken explaini-ng.:that in the construction of the Southeast Yakima Community
Center project, it is necessary to acquire property from Mr. & Mrs. Alex Carter, in accor-
dance with an Offer to Sell document, it was MOVED by Keith, seconded by Lust that Resolu-
tion No. D' -1572 authorizing the purchase of said property, be passed read: carried,
Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. Mr.
McMicken explained further that this will be a portion of the local sharetn qualify for a
Federal Grant for this project. -
RESOLUTION NO. D- 1572, A RESOLUTION authorizing the purchase of real property for South-
east Yakima Community Center. .
City Manager McMicken explaining that the proposed Resolution.authorizing the existence of
a City Treasurer's Change*Fund and other petty cash funds, within the General Fund is
merely a housekeeping matter,. it was MOVED by Brown, seconded by McNeice that Resolution
No. D -1573 authorizing the existence of said Fund, be passed as read: carried, Brown,.Keith
Lambert, Larson, Lust, McNeice and voting aye on roll call.
RESOLUTION NO. D -1573, A RESOLUTION authorizing the existence of a City Treasurer's Change
Fund, and other petty cash funds, within the General-Fund of the City of Yakima.
City Manager McMic -ken referring to an off - the - agenda item, a Resolution granting a tem-
porary revocable permit to North Construction Co., and Perry Hayes, Inc., to
excavate and haul fill material from city property, has to do with the construction of
the K -Mart facilities in the vicinity of the sewage treatment plant, and explained that
this supercedes Resolution No. D -1564 adopted by the City Council on December 4, 1970.
Councilmen Lambert and Lust indicated that they are still opposed to the location of the
proposed K -Mart development. After due discussion, it was MOVED by Robinson, seconded by
:Keith that Resolution No. D -1574 granting said temporary revocable permit, be passed as
read: carried, Brown, Keith, Larson, McNeice and Robinson voting aye on roll call. •Lambert
and Lust voting nay on roll call. -
RESOLUTION NO. D- 1574, A RESOLUTION granting a temporary revocable permit to excavate and
haul fill material from city property.
Councilmen Keith, Lambert and. Robinson asking to be excused from the next meeting of
January 4, 1971, it was MOVED by McNeice, seconded by Brown that they be excused; carried,
Brown,- Larson,.Lust,and McNeice voting aye by voice vote.
There being no further business to come before the Council, it was MOVED by Lust, seconded
by Keith that we do now_adjourn at the hour of 6:05 P.M.: carried, Brown,.Keith, Lambert,
