DECEMBER.21, 1970
The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith,
Lambert, Lust, McNeice and Robinson, City Manager McMicken and.City Attorney Andrews pre-
sent on roll call. '
The Invocation was given by Councilman Keith..
The minutes of the regular meeting of December 14, 1970, having been certified accurate by
two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson
declared said minutes approved as.recorded.
This being the time fixed for the continuation of the Hearing on Resolution of Intention
No. D -1541, to improve property located on the southwest corner of Lincoln & 16th Avenues,
by the construction of curbs, gutters, sidewalk & surfacing of streets, in accordance with
Petition No. 661, having been continued from time to time since November 16, 1970, and
City Manager McMicken reporting that the persons involved have asked that this matter be
continued for an additional two weeks, it was MOVED by Keith, seconded by McNeice that
this Hearing be continued until January 4, 1971: carried, Brown, Keith, Lambert, Larson,
Lust, McNeice and Robinson voting aye by voice vote.
It was MOVED by Lambert, seconded by Brown that Ordinance No. 1274 establishing an applica-
tion fee for open space taxation, be passed as read: carried, Brown,. Keith, Lambert, Lar
son, Lust, McNeice and Robinson voting aye on roll call. City Manager McMicken reported
that the last time this matter was brought before the City Council, it was decided to
check with the County as to the fee they are charging and establish. the City fee.accord-
ingly. He stated that the County Commissioners have set the - County fee at $50.00. Mr.
McMicken explained that all applicationsare filed with the County Assessor, who then sub-
mits the fee and applications to the City in question.
ORDINANCE NO. 1274, AN ORDINANCE relating to city administration; establishing an applica-
tion fee for current use real estate tax assessment applications; adopting Chapter 1.89,
Current Use Assessments, consisting of Sections 1.89.010 and 1.89.020 as a new chapter and
new sections of the City of Yakima Municipal Code; and declaring an emergency.
It was MOVED by Brown, seconded by Lust that Ordinance No. 1275 relating to traffic control
amending the schedule of parking meter zones and the regulation of speed limits, be passed
as read: carried, Brown, - Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on
roll call. Public Works Director John Mayo explained that the addition of the new parking
meter zones is the result of a request by the Y.W.C.A. staff, and because of a shortage of
parking spaces at the present time, the installing of meters where previously there has
been all day parking. He also explained that in accordance with a request from the
Eisenhower School Safety Committee, the speed limit is being changed on Arlington Street
from S. 40th Avenue to South 45th Avenue.
ORDINANCE NO. 1275, AN ORDINANCE relating to traffic control; amending the schedule of
parking meter zones established by Section 9.75.030 of the City of Yakima Municipal Code
by adding Subsections (b) (16) and (17); amending Section 9.75.010 by adding Subsection
(a) (5); and declaring an emergency.
A Notice of Appeal from the Decision of the Planning Commission, having been filed with
the City Clerk on December 11, 1970, by Howard Hettinger, Attorney representing George and
and Lucille Tucker and Others, requesting rezone of property located on the south side of
Lincoln Avenue, between 16th and 22nd Avenues, it was MOVED by Robinson, seconded by Lust
that January 18, 1971, be fixed as the time for a Hearing on this matter: carried, Brown,
Keith, Lambert, Larson,.Lust, McNeice and Robinson voting aye by voice vote.
City. Manager McMicken referring to an off - the - agenda item, explained that Chief of Police
Madden has advised him of some changes in the gambling laws as affected by the new Federal
Crime Control Act. Police Chief Madden reported that Law 91 Title 8, was enacted by
Congress in October and that today a letter was received from Sheriff John Thompson, who
is informing all Cities' to enforce the State gambling statutes. Chief Madden requested
that the City Council instruct the City Attorney to amend the City Code to conform to the
State Law. After due discussion, it was MOVED by Robinson, seconded by McNeice that such
legislation be prepared that is necessary in order to conform to the State Law: carried,
Brown, Keith, Lambert,. Larson, Lust, McNeice and Robinson voting aye by voice vote. Mr.
McMicken stated that Chief Madden will advise all card - rooms, punch board and other gam-
bling device operators covered by this law, to desist as of January 1, 1971,He explained
that because of a pending law suit this movement now will not affect pinball machines.
City Manager McMicken explaining that in connection with the contemplated improvements to
Nob Hill Boulevard, the City, an Offer to Sell has been received on right of way property
needed for this purpose, it was MOVED by Keith, seconded by Robinson that Resolution No.
D -1567 authorizing the purchase of said property, be passed as read: carried, Brown,. Keith,
Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. (Ackerman and

RESOLUTION NO. D -1567, A RESOLUTION authorizing the purchase of right of way property for
Nob Hill Boulevard improvements.
City Manager McMicken explained that Chapter 70.95 of the Revised Code of Washington
requires that a Solid Waste Management Plan be made for all counties and cities 'in the
State of Washington, and in May the City Council authorized the City Manager to notify the
County that we would enter into an agreement with them. He stated that the agreement has
been prepared by the County. After due discussion, it was MOVED by Brown, seconded by
McNeice that Resolution No. D -1568 authorizing the execution of an agreement with Yakima
County relating to said .id Waste Management Plan, be passed as read: carried, Brown,
Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call.

County relating to a Solid Waste Management' Plan
City Manager McMicken explained that a request by -West Valley Nursing Home, Inc., for
vacation of utility easements was filed in accordance with Petition No. 677, and that the
City Engineers have reviewed the matter and recommend that these easements be vacated to
allow improvements to be made to the property. After due discussion, it was MOVED by
Robinson, seconded by McNeice that Resolution No. D -1569 vacating said utility easements,
be passed as read: carried, Brown, Keith,- Lambert, Larson, Lust, McNeice and Robinson
voting aye on roll call.

City Manager McMicken explained that in connection with an exchange of property between
the City and Freeway Properties, and an agreement for Exchange of Property ", dated January

12, 1968. said exchange of property was to be accomplished no later than December 31, 1970
and - it is now desired that the date for accomplishing this exchange of property be extender
to March 31., 1971. After due discussion in which it was brought out that this property
has been designated as a potential land fill site, it was MOVED by Robinson, seconded by
McNeice that Resolution No..D -1570 amending an agreement with Freeway Properties, to extenc
the date for accomplishing said-exchange of property, be passed as read: carried, Brown',
. Keith, Lambert,.Larson, -Lust, McNeice and Robinson voting -aye on roll call.

venture, of exchanging real property between Freeway Properties and the City.

City Manager McMicken explained that the City of Yakima and The Washington State Council of
County and City.Employees, and Local 1122 of the American Federation of State, County and •
Municipal EMployees, AFL -CIO have had numerous meetings over the past months to negotiate
and work out terms to enter'into a Collective Bargaining Agreement, He stated that there
has been a lot of hard bargaining on both sides and that the Union people have been good
to work with. Mr. McMicken explained that this agreement does not stipulate work hours
and wages, but pertains to. grievance procedures and other negotiable matters. He intro -
duced Mr. Al. Coleman, President, of Local.1122, who also stated that this agreement repre;
sents a lot of time and work and that the City Manager and Staff have been very coopera-
tive. After due discussion, it was MOVED. by Keith, seconded by'Lambert that Resolution
No. D -1571 authorizing,the execution od said Collective BaEgaining Agreement , be passed
as read: carried, Brown,.Keith,.Lambert, Larson,.Lust, McN ice and Robinson voting aye on
roll call.

RESOLUTION NO..D -1571, A RESOLUTION authorizing and directing the City Manager. and City
Clerk of the City of Yakima to execute a Collective Bargaining.Agreement with The Wash-
ington State Council of County :and City and Local 1122 of the American Federa-
. tion of State, County and Municipal Employees, AFL -CIO.
City Manager McMicken explaining that a request for Outside Utility Service to property
located at 1810 N 48th Avenue, has been filed by Fred Montz, that the land use conforms
II r - -- - - -to the General Plan, that the applicant has signed an Outside Hookup Agreement, and
recommending that the City Council authorize the granting of said request, it was MOVED
by Robinson, seconded by Brown that said request for Outside Utility Service, be granted:
carried, Brown, - Keith,- Lambert, Larson, Lust, McNeice and Robinson voting aye by voice
vote. - .
City Manager McMicken reported that bids were received and considered by a bid board on
December 7, 1970, on'L.I.D. No. 980, South 1st Street and -East Washington Avenue Sanitary

Sewer District, as follows:
- DeBlasio Construction Co., Inc., Parker $57,293.78 .
A.V. DeBlasio Construction, Yakima. 60,508.88

The City Engineer recommending that the contract be awarded to DeBlasio Construction Co.,
Inc., Parker, the low bidder, it was MOVED by Keith, seconded by Lust that the recommenda-
tion of the City Engineer be accepted and that the contract be awarded to DeBlasio Con-
struction Co., Inc., Parker, in the amount of $57,293.78, and that the City Manager be
authorized to enter into a contract with.said contractor upon the filing of the proper
bond and insurance: carried, 'Brown,- Keith, Lambert, Larson, Lust, McNeice and Robinson
voting aye by.'.voice vote. .
City Manager McMicken stated that as a.matter of information that he is going to proceed
on a Plan with the - Department of Public Works, Street :Division, Parks and Recreation" .
Department and the Street Tree Committee regarding the requests for removal of trees as
II listed on a report from the Engineering Department. He explained that no trees will be
removed until there has been a chance to review all the requests on this list and that it
is their concern that there should be some planting of new trees, as well as the removal
of undesirable ones.
City Manager McMicken requesting that authorization be given for the City-Engineer and
Director of Public Works to travel to'Portland, Oregon, to negotiate with Burlington -
Northern Railroad regarding construction work on the Mead.Avenue project, it was MOVED by
Lust, seconded by Keith that said travel be authorized with expenses paid: carried,
Brown,•Keith, Lambert,'.Larson,.Lust, McNeice and Robinson voting aye by voice vote.
Councilman Keith referred to the recommendation submitted to the City Council on Decem-
ber 7, 1970, by the Housing and Renewal Committee, that-a Housing.Authority for the City
of Yakima be . appointed, and stated that no action had been taken at that time._, He
suggestedthat_this matter be considered at the next Council meeting and that it,be
publicized . After due discussion, it was MOVED by'Keith, seconded by Lust that the City
Manager be instructed to put on the Agenda of the Council Meeting of December 28, 1970,
the matter pf�.;appointing a Housing Authority for the City of Yakima, and that said m eet-
ing,be held at the Yakima Municipal Library: carried, Brown,, Keith, Lambert, Larson, Lust,
McNeice and Robinson voting aye by voice vote. (See Minutes of 6/22/70 & 8/31/70.)
There being no further business to come before the Council,_it was MOVED by Lust, seconded
by Keith that we do now adjourn at -the hour of 9:20 P.M.: carried,. Brown, Keith, Lambert,
Larson, Lust, McNeice and Robinson voting aye by voice vote.
