HomeMy WebLinkAbout11/30/1970 Business Meeting r 132 NOVEMBER 30, 1970 The City Council met in .regular session, Mayor Larson presiding, Councilmen Brown, Keith, Lambert, Lust, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present onroll call. The Invocation was given by Councilman Lambert. The minutes of the regular meeting of November 23, 1970, having been certified accurate by two Councilmen, and_no one present wishing to have said minutes read 'publicly, Mayor Larso declared said minutes approved as recorded. This being the time fixed for further Hearing on a Resolution of Intention No. D -1541, to improve property located on the southwest corner of Lincoln and 16th Avenues, by the con- struction of curbs, gutters, sidewalk and surfacing of streets, in accordance with Petitio No..661. Mr. John Mayo, Director of Public Works, referred to a letter received from Buttrey -Osco signed by John J. Quinn, Vice President and General Counsel for said firm. Mr. Mayo explained that there are two requests made in the letter namely to go forward wit the sidewalk and curb entrances, etc, in conformance with city requirements and specifica- tions and in cooperation with appropriate representatives of the City of Yakima and number two Buttrey -Osco will participate in the local' improvement district when formed for purpos: of improving the corner but that assessments would be reduced substantially when said district is formed. Discussion of these facts indicated that if Buttrey -Osco would make these improvements then it would be cheaper for the City of Yakima. It was MOVED by Robin son, seconded by Keith that the Mayor and City Manager be authorized to work out an arrang ment with Buttrey -Osco in conformance with their letter: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. It was then MOVED by Robin- son, seconded by Lust that this Hearing be continued for two weeks or until December 21, 1970: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Petition No. 679, having been filed with the City Clerk on November 23, 1970, by Orbie Mallonee, requesting improvement of property by the construction of curbs, gutters, sur- facing of streets, and sidewalk, located at South 7th Avenue from Mead to Fremont Street, it was MOVED by - Robinson, seconded by Lambert that said Petition No. 679, for the creation of a Local Improvement District be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. A Damage Claim, having been filed with the City Clerk on November 25, 1970, by Caroline Charles, 408 South 7th Avenue, in the amount of $207.63, for damages caused when the wheel chair in which Mrs. Charles was riding struck a raised portion of the sidewalk, it was MOVED by Lambert, seconded Brown that said Damage Claim be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Lambert,Larson, Lust, McNeice and Robinson voting aye by voice vote. An Ordinance appropriating $650.00 to the Dangerous Building Repair and Demolition Fund, having been read in its entirety on November 23, 1970, and being read by Title only at this meeting, it was MOVED by Keith, seconded by Brown that Ordinance No. 1259 providing for said appropriation, be passed. as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on call. ORDINANCE NO. 1259, AN ORDINANCE appropriating $650 from unappropriated money in 670 -Dan- gerous Building Repair and Demolition Fund to Account 890, Miscellaneous, of the Mainten- ance and Operation classification of the 1970 Budget for 670 - Dangerous Building Repair and Demolition Fund. An Ordinance appropriating $12,000 to the Firemen's Relief and Pension Fund, having been read in its entirety on November 23, 1970, and being read by Title only at this meeting, it was MOVED by Brown, seconded by Keith that Ordinance No. 1260 providing.. for said appro- priation be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1260, AN ORDINANCE appropriating $12,000from unappropriated money in 610 - Firemens Relief and Pension Fund to various accounts of the 1970 Budget for that fund. An Ordinance appropriating $6,000 to the Parks and Recreation Fund, having been read in its entirety on November 23, 1970, and being read by Title only at this meeting, it was MOVED by Lust, seconded by McNeice that Ordinance No. 1261 providing for said appropriatio be passed as read: carried, Brown; Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1261, AN ORDINANCE appropriating the amount of $6,000 from unappropriated money in the Current Expense Fund to Account 910, Land; of the Capital Outlay classifica- tion of the 1970 appropriation for 120 -Parks and Recreation. It was MOVED by Robinson, seconded by Keith that Ordinance No. 1262 fixing 12% as rate of Water Sewer Tax against Water Sewer Fund of the City of Yakima, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. City Manager McMicken explained that this is a 22% reduction from last year and thatit will mean a $35,100 reduction in revenue to the General Fund. ORDINANCE NO. 1262, AN ORDINANCE relatingto public services and utilities; fixing and levying a water- sewer tax against the Department of Public Utilities of the City of Yakima; saving certain'taxes; amending Section 7.64.010 of the City of Yakima Municipal Code; and declaring an emergency. It was MOVED by Brown, seconded by Robinson that Ordinance No. 1263 fixing annual license fees for electric, telephone, gas and steam businesses for 1971, be passed as read: car- ried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. City Manager McMicken explained that this would mean a $47,000 reduction to the General Fund. He further explained that these fees were raised last year in order to balance the 1970 budget. ORDINANCE NO. 1263, AN ORDINANCE relating to licenses and business regulations; fixing and imposing annual license fees or taxes on certain utilities and providing for a surcharge; saving certain taxes; amending Subsection 5.50.050 (a) of the City of Yakima Municipal Code; and declaring an emergency. It was MOVED by Keith, seconded by Robinson that Ordinance No. 1264 adopting a classifi- cation and salary range for employees for 1971,.be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. City Manager McMicke explained that the salaries shown reflect the 5 %, 7 or 10% increases. . . AW4 • NOVEMBER.30, 1970 ORDINANCE NO. 1264, AN ORDINANCE adopting a classification plan' and salary ranges for City employees; and amending Section 2.20.100 of the City of"Yakima Municipal Code. It was MOVED by Brown, seconded by McNeice that Ordinance .No. 1265 creating a Cumulative Reserve Fund for capital improvements, be passed as read: carried,. Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. City Manager, McMicken explained that the purpose of this fund is. to pay for capital improvements consisting of acquiring property, constructing, altering or repairing any public'building or work, makinc any public improvement, or purchasing supplies, material or equipment specified as capital improvements. Mr. McMicken stated that one- half'of all revenue derived from general sales tax and use taxes will be deposited in this fund. City Manager McMicken explained that some of this money will be used at the Southeast Community Center Park and also at the Yakima Municipal Airport where some construction has been held up because of the failure of the Federal Government send all funds promised to complete project. . ORDINANCE NO. 1265, AN ORDINANCE relating to municipal finance; creating, and designating purposes of, a Cumulative Reserve Fund for Capital Improvements; specifying.sources of funds for and the manner of. authorizing expenditures from such fund; creating Chapter 3.80, Cumulative Reserve Fund For Capital Improvements, and Sections 3.80.010, 3.80.020 and 3.80.030 as a new chapter and new sections of the City.of, Yakima Municipal Code; and de- claring an emergency. City.Manager McMicken referred the matter of the execution of.contract with Day & Ludwig, CPA for audit of HUD Grant to W. 'Leonard Crose, Finance Director. Mr. Crose explained that HUD requests that a local CPA who does not have. conflicting interests, be pickedto audit this.Grant which amounts to $750,000. There being no further discussion, it was MOVED by Robinson, seconded by Keith that Resolution No. D -1556 authorizing the execution of a contract with Day and Ludwig, CPA, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1556, A RESOLUTION authorizing W. Leonard Crose, Director of Finance of the City of Yakima, to execute a contract with Day &.Ludwig, CPA, to audit records per- il taining to Department of Housing and Urban Development project no. WS -6 -48 -0009. It was MOVED by Brown, seconded by Keith that Resolution - No. D -1557 .providing legal defens for police officers against tort claims, be passed as-read: carried, Brown, Keith, Lambert Larson,,Lust, McNeice and Robinson voting aye on roll call.- City Manager McMicken refer- red this 'matter to City Attorney Andrews who, explained that James S. Scott, of Smith, ' Scott & Hanson, Attorneys at Law, is the legal counsel for the Patrolman's Bargaining Association and this is the reason.for Mr. Scott's representation in this matter. RESOLUTION NO. D -1557, A RESOLUTION providing for the legal defense of.tort claims against Yakima police officers in Cause No. 2673 in,the United States District Court, Eastern • District of Washington, Southern Division, entitled Wolff vs, Campbell, et al. It was MOVED by Robinson, seconded by Brown that Resolution No. D -1558 authorizing a tem- porary loan from Arterial Street Fund to ..Urban Arterial - Fund be passed as read: carried, Brown', Keith,.Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. Mayor Larson explained that some money is tied up-in the Urban Arterial Fund until.the 10th of January, 1971 at time the money will again be available. City Manager McMicken explained that.in any transaction of this type an interest charge is made on loan. RESOLUTION NO. D -1558, A RESOLUTION authorizing a temporary loan of $50,000 from 370- Arterial Street Fund to 380 -Urban Arterial Fund and providing for repayment. City Manager McMicken reported on an article printed by National League of Cities entitled "Major Aid Program for Mass Transit Enacted" which indicated that some funds might be available from the Federal Government to cities for improvements on Transit systems. It was MOVED. by Robinson, seconded by McNeice that legislation be,prepared to reduce the General Business License fees on those licenses having one- two, -five, six -n'ine employees: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Discussion indicated that these three categories had been increased more than double the original license fee in December of 1969 and that the Council now wishes to reduce the basic rate from $25.00 to $20.00 in the first category, $50.00 to $40.00 in the second category and $75.00 to $70.00 in the third category. These new rates would become effective in 1971 and would affect only new businesses at that time. Councilman Brown asking to be excused from the next Council meeting on December 7, 1970, it was MOVED by. McNeice, seconded by Lust that he be excused: carried, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote.
