HomeMy WebLinkAbout11/23/1970 Business Meeting 9 NOVEMBER 23, 1970 The City Council met in regular session, Mayor Larson Brown, Keith, . Lambert, Lust, McNeice and Robinson, City Manager McMicken and City Attorney Andrews -pre- sent on roll call. .• - The Invocation was given by Councilman Keith. The minutes of the regular meeting of November 16, 1970, having been certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. An Ordinance appropriating $650.00 to the Dangerous Building Repair and Demolition Fund, having been read in its entirety at this'meeting, was laid on the table for•orie week or until November 30, 1970. Discussion indicated that the original amount setup in this fund was $1,000. Mr. Crose, Finance Director, stated that when the - funds are used they are ` replaced from monies collected when buildings are destroyed or demolished. An Ordinance appropriating $12,000 to the Firemen's Relief and Pension Fund, having been read in its entirety at this meeting, was laid in the table for one week or until November 30, 1970. City Manager McMicken explained that Pension'costs and medical expenses have increased from the amount budgeted for the new LEFF SYstem. He further stated that we have had to make some large refunds of contributions not,planned for in the;,current, budget. It was MOVED by Brown, seconded by Lambert that Ordinance No..1257 providing for_legal defense for police officers against tort claims, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. Discussion disclosed that this action was brought about as a result of a Civil Suit having been filed against former Police Chief Douglas Campbell and Police officers William Collins, William Nance and Troy Reynolds. The claimant is Verna Wolfe, owner and operator, of Verna's Styling Studio. ORDINANCE NO. 1257, AN ORDINANCE relating to police personnel; authorizing providing for the legal defense of tort claims against police officers and for indemnification against judgments arising therefrom; adopting Chapter 2.44, Police Officers -- Protection Against Tort Claims, consisting of Sections 2.44.010, 2.44.020 and 2.44.030, as a new chapter and new sections of the City of Yakima Municipal Code; and declaring an emergency. It was MOVED by,Robinson, seconded by McNeice that Ordinance No. 1258 fixing the time -of . delinquency and providing for the issuance of bonds for the payment of the unpaid portion of L.I.D. No. 976, 1969 Street and Alley Paving District, be passed as read: carried, Brown, Keith, Lambert, Larsan, Lust, McNeiceand Robinson voting aye on roll call. ORDINANCE NO. 1258, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for the payment of the cost of the improvement in Local Improvement District No. 976, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. An Ordinance appropriating the amount of $6,000 to Parks and Recreation, having been read in its entirety at this meeting, was laid on the table for one week or until November 30, 1970. City Manager McMicken stated that this appropriation is needed to pay part of the purchase price for the acquisition of real property for park purposes and for Southeast Yakima Community Center facilities. Jay Otto, Director of Planning and Community Development stated that the Report from this Department on the Yakima Municipal Airport Plan as filed with the City COuncil, is to be reviewed and revised as needed and he hoped consequently adopted as a part of the General Plan. No formal action was taken at this time. Discussion by Council members indicated that there is interest among this group in lowering the utility tax on privately owned utilities such as gas, telephone and electricity and the first three catagories under the general business licenses or those licenses which were raised 150% in December of 1969. • City Manager McMicken referred the matter of the acquisition of right -of -way property for a domestic water line along Englewood Avenue to City Attorney Andrews. Mr. Andrews explain- ed that the owners of the property have offered to sell the necessary property to the City for the installation of a water line from the 48 inch transmission main to proposed reser- voir site at 40th and Englewood Avenue. It was MOVED by Robinson, seconded by Keith that Resolution No. D -1554 authorizing this acquisition of right-of-way property for a domestic water line be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and _. Robinson voting aye on roll call. RESOLUTION NO. D -1554, A,RESOLUTION authorizing the purchase of right of way property for installing a domestic water line along Englewood Avenue. It was MOVED by Brown, seconded by Robinson that Resolution No. D -1555 authorizing the con- veyance of property owned by the City to Paul R. and Rose M. Andrews, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. City Manager McMicken referred this matter to City Attorney Andrews who explained that this property had previously been owned by Mr. and Mrs. Paul R. Andrews and they claim some irregularities in notice to them and in other respects concerning foreclosure proceedings. The amount of money spent by the City to pay principal amounts for local improvement dis- trict assessments on this piece of property, is $200.81 and the principal and interest for delinquent real estate taxes payable to Yakima County is $342.58 and Mr. and Mrs. Andrews have offered to reimburse the City in full. RESOLUTION NO. D -1555, A RESOLUTION authorizing the conveyance of property owned by the City to Paul R. Andrews and Rose M. Andrews, husband and Wife. Mr. John Mayo, Director of Public Works, explained that he had talked with Mr. Quinn, Legal Counsel, forButtrey Osco this past week. He stated that Buttrey -Osco is now asking to accept all financial responsibility to improve the street in front of their new store in time for their grand opening. The widening would not run the whole length of the street .but would stop at the service station located on 16th Avenue. Mr. Mayo also stated that there is going to be a meeting this week with Mr. Quinn and Mr. Elery VanDiest, who is the Attorney representing the Service Station on 16th and it is hoped that matters will be resolved. It was MOVED by Robinson, seconded by McNeice that an Ordinance be prepared to be consi- dered at the next meeting of the. City Council which would reduce the private utility tax from 31/2% to 3%, carried: Brown, Keith, Lambert, Larson, Lust, McNeice andRobinson voting aye by voice vote. 131 NOVEMBER 23,1970 There being no further business to come before the Council, it was MOVED by Lust, seconded by Keith that we do now adjourn at the hour of 4:20 P.M.: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote.
