Mayor Larson presiding, Councilmen Brown; Keith, Lambert, Lust, McNeice and Robinson, City Manager McMicken'and City Attorney- Andrews present on roll ;ca]_l. The Invocation was given 'by Councilman Brown. • • The minutes the'regu.lar meeting of November 2, 1970, having been duly certified accu- rate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Petition No. 676, having been filed with the City Clerk on November 5, 1970 by Harvey M. Paulson & Others, requesting annexation •of property contiguous to the Yakima City Limits at North-46th and 48th Avenues,'between Summitview and Tieton Dri_ve,•it was MOVED by Robinson; seconded by. Brown, that the'Petition for Annexation filed by Harvey M. Paulson &Others, being Petition No. 676, be approved -as meeting the • requirements of law; that said Petition be referred to the'City_Manager and Planning Commission for study-and recom- mendation; that the Mayor be authorized to convene a Review Board'as required by law, •for a hearing and review of this proposed annexation; and that December 7, 1970 be set as the date for a public hearing by the City Council on this Petition: carried, -Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote.. ORDINANCE NO. 1254 AN ORDINANCE appropriating the amount of $12,000'from.- unappropriated money in 620 - Police Relief and Pension Fund to various accounts within the 1970 Budget for such fund. " An Ordinance appropriating $5,000 within the Airport Fund having been read in :its en - tirety on November 2, 1970, and being read by Title only at this meeting, it was MOVED by Robinson, seconded by Lambert, that Ordinance No. 1255 providing for said appropriation, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. . II ORDINANCE NO. 1255, AN ORDINANCE appropriating the amount of $5,000 to various accounts in the 1970 Budget for 390 - Airport. Mr. Walter Philipp and Mr. Forrest Brewer, being present to speak to :the matter of request- ing street parking in front of property owned by them at 106 West Mead Avenue, which street is now being reconstructed.to four traveling lanes without parking, Mr. Philipp explained that they had previously owned the whole building and had parking, but had recently sold part of it with the parking. He further explained that they now have parking on Mead' only, but are working on some parking at the back and would like to keep the parking in front for some time until this parking in back is finished. Public Works Director John. Mayo reported on the Mead Avenue Arterial Improvement now being done and explained that when it is finished there will be four traveling lanes and sidewalks on.each side, and. all parking on Mead will be removed. He further explained that the traffic volume is such that the work should go ahead as soon as possible with all four traveling lanes, but • that there might still be some delay in finishing all four lanes . in the vicinity of the railroad tracks because negotiations with the Railroad Company have not been comple- ted. Mr. Philipp and Mr. Brewer indicated that they would like some assurance of length of time, such as up to a year, that could be allowed before the parking is taken off Mead. Council members indicated that they would.like to help Mr. Philipp and Mr. Brewer as much as possible, but that they would have to go along with the Six Year Plan regarding Arter- ial Streets, which Policy is to have "four traveling lanes, and they "feel this should be done as soon as the whole street can be done, at the same time. Mr. Mayo stated that it may take from three to six months to get everything straightened out with the railroad and suggested that only the center line be marked which•would allow.for two lanes of traffic and parking on Mead. Council members indicating that they Mr._Philipp.and Mr. Brewer would get their parking situation finished in back as soon as possible, it was MOVED by Robinson,- seconded by Brown, that this street be marked to retain two -lane travel until the whole street can be marked for four -lane travel when everything is settled with the railroad: carried, Brown, Keith; Lambert, Larson, Lust, - McNeice and Robinson voting aye by voice vote. Mr. Bernie Homes, representing Frank Homes Tire Service, Inc., being present, read a lette prepared by him and filed with the City Council on this•date, which explains that the one- .way-traffic which has recently been provided has drastically restricted the access and egress of their customers due to cars circling block two, and that during these traffic times they cannot,get out onto "B" Street nor can North bound traffic on 3rd,Street enter • their business. He explained•that they requesting that-the angle-parking .on North 3rd Street of block two be changed to parallel parking,•which would allow for two•South • NOVEMBER 9, 1970 • bound lanes instead of one and should help solve their problem. Public Works Director, John Mayo, explained that they have noted this problem and have been making a traffic count and will soon be able to give a report and recommendation on this matter. After due discussion, it was MOVED by Lust, seconded by Keith, that this matter be referred to the Staff for study and recommendation: carried, Brown, Keith,'Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Mr. Jack Sparling, representing the Convention and Cultural Center Committee, being present, requested endorsement by the City Council of plan to develop a Convention Center in accordance with the CBD Plana He referred to a Resolution from this Committee, copies of which have been presented to the Council which expresses the support of the Con- vention and Cultural Center Committee of that 7ortion of the Central Business District Plan which proposes such a Center, and requests the Yakima City Council to appropriate necessary funds (estimated to be $2,500) for an architectural advisor. The Resolution ex- plained that this initial expenditure would provide the basis for an architectural compe- tition on the design of auditorium facilities at an additional cost, and that the prelim- inary architectural services are needed prior to the architectural competition, in order to establish general design specifications, specific limitations on size and use of facili- ties, and a program for conducting the architectural competition. The Resolution further stated that prospective candidates for architectural advisor•would be interviewed by the. Convention and Cultural Center Committee, and one architect would be recommended for em- ployment by the City Council. It also reported that the Committee would oversee:all pre - liminary arechitectural services and would report to the City Council with the complete program and recommendations prior to conducting the architectural competition. Others present and supporting this request were Mr. H. G. Wells of the Chamber of Commerce and Mr. Ken Thompson and Mr. Ray Pittman of the Visitors &Convention Bureau. Council members expressed their approval of the project and'discussed the procedures of getting started on this proposed Center. City Manager McMicken explained that the requested estimated - $2,500 is the first cost and that in preparing the preliminary 1971 Budget, some funds were designated from the 1/2 sales tax which could be used for such purposes. Mr. McMicken explained that Mark Biese, Associate Planner with the Department of Planning and Community Development, has been•assigned to work with Mr. Sparling on this proposed, project and the - downtown renewal; that Mike Mercy is also working with them, still pursuing his idea of a parking lot or structure off of Second Street, and that Bob Williams, Architect, is work- ing with them on this project. After due discussion, it was MOVED by Lambert, seconded by Lust, that the Convention and Cultural Center Committee be authorized to go ahead and interview for an architectural advisor in keeping with the material in'the Resolution pre- sented at this meeting: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken reported on the matter.of the delay of transfer of ownership of Fruitvale Canal by Pacific Power and Light Company to the City, stating that the November. 1 deadline was missed, but the matter is being worked on. He explained that the meeting with the Pacific Power and Light Company was held a.week ago and-it: is intended that the transfer will take place before the opening ofthe Canal next,spring.• Public Works Director, John Mayo, reported that part of what the City is acquiring from the Pacific Power and Light Company will be some water rights, which are of some value. Mr. McMicken reported that the City will get 28 shares of water. City Manager McMicken read the report_of the Yakima Merchants Association and the Police , Department, "Check Alert System ", for the information of the City Council, which explains '.how this system works to alert the merchants of bad checks in the area. . . • City.Manager McMicken referred to the matter of,.the consideration of the City Administra- tion of the "Open Space Taxation Law" and reported that Dempster Brownell, County Assessor, has asked what.kind of application the City will be using. .Mr. McMicken referred to the Property Tax Bulletin #70 -12, from the Property Tax Division, Department of Revenue, re- garding this matter, copies of which have been given to the City Council members, along with instructions for completing application for open space,. agricultural or timber lands'. current use assessment. The Property Tax Bulletin states that each legislative,Body will need to determine if an application fee will be required, and if a fee is required, the rules governing the application fee. Council members indicated that they would like to know what the County Commissioners are going to charge, and feel that there - should be some 'uniformity of the fee or a least that the City not charge more than the County. Dis- cussion- brought out that'J'there would'be other things to consider, such as classification, and it was felt by Council Members that there should be further. .study on this matter. Mr. McMicken stated that, although Mr. Brownell would like to h ave the City respond soon, he feels that there should be uniformity with County and that -there should be further investigation on the matter and he will wait another week before answering Mr. Brownell. No formal action was taken.at this meeting. City Manager McMicken, requesting approval for Jim Williams, Administrative Assistant, to travel to San Francisco to attend a meeting, it was MOVED by Keith, seconded by McNeice, that said travel be authorized with expenses paid: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote.
