HomeMy WebLinkAbout10/05/1970 Business Meeting .12 OCTOBER 5, 1970 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Lambert, McNeice and Robinson, City Manager McMicken and City. Attorney Andrews present on roll call. Councilman Lust absent on roll call. It was MOVED by Robinson, seconded by McNeice that Councilman Lust be excused from this meeting: carried, Brown,.Keith, "Lambert, Larson, McNeice and Robinson voting aye by voice vote. The Invocation was given by Councilman Brown. The minutes of the regular meeting of. September 28, 1970, having been duly certified accurate by two Councilmen, and no one present.wishing to have said minutes read publicly, Mayor declared said minutes approved`as recorded. It was MOVED by Brown, seconded by Lambert that Ordinance No. 1252 fixing and levying ad valorem taxes for the 1971. Budget, be passed as read: carried, Brown, Keith, Lambert, Lar- son, McNeice and Robinson voting aye on roll call. Lust absent. City Manager McMicken explained that pursuant to a report on the current status of estimated revenue and esti- mated expenditures for the 1971 Budget for the City of Yakima, the Council finds that the total net amount of $1,674,949 in revenue must be raised by ad valorem taxes on real and personal property within the corporate limits of the City, which amount is not in excess of the amount authorized,by law to be raised from that source, and reviewed the matter briefly. He further explained that this preliminary action regarding the 1971 Budget has to be acted upon on this date, in accordance 'with the laws of the State of Washington. ORDINANCE NO. 1252, AN ORDINANCE fixing and levying the amount of ad valorem taxes neces- sary to balance estimated revenue with estimated expenditures for the 1971 Budget for the City of Yakima. A report having been submitted by the Yakima. Ambulance Service of revised rates, City Manager McMicken explained that there is no Council action necessary, but it is required that the Ambulance Services post any changes in rates with the City Council. He referred to a second report of ambulance rate changes that has been filed on this date by the Sun Valley Ambulance Service, and presented for the information of the City Council also. Dis- cussion brought out that these two Companies reported changes in a different manner and Council members feel that these reports should quote prices on the same basis and give a better indication of what it would cost a person to use their services. City Manager McMicken stated that he will write to both Companies asking them to report rates and rate changes on a more clear and uniform outline. City Manager McMicken exp,la.ined that Bay Construction - Everett, has•.filed a claim with the City and commenced a lawsuit claiming the principal amount of $10,850, and has now offered to accept $5,000 in full settlement of such litigation. Public Works Director John Mayo, having negotiated with Bay Construction - Everett and CH2M, Consultants, regarding the con - struction work on the 48" Water Main, Schedule C, explained that the problem was a matter of interpretation of the specifications, which chould have meant one of two things -- either the specifications were adequate, in which case we are paying for something we didn't get, or if they were vague, we got something we didn't pay for and Bay Construction - 'Everett says we. pay for it. He further explained that in negotiating to settle with the contractor," the agreement was reached to accept $5,000 in full settlement of the claim and the lawsuit against the City will then be dropped, which seems to be in the best interest of the City. After due discussion, it was MOVED by. RESOLUTION NO..D -1545, A RESOLUTION authorizing settlement of pending,litigation entitled Bay Construction-Everett, -a joint venture, Plaintiff, v. the City of Yakima, Defendant, Cause No. 53475 in the Superior Court of the State of Washington in and for Yakima County. City Manager McMicken explaining that the City contemplates the improvement of Avenue so as to require the reconstruction of the grade crossing of that street with Union Pacific Railroad Company tracks and the changing of signals at that crossing, and to do this, authorization of the Washington Utilities and Transportation Commission is required, and a petition having been prepared to request said authorization, it was MOVED by McNeice, seconded by Brown that Resolution No. D -1546 authorizing the City Manager to petition the Washington Utilities and Transportation Commission for authorization to improve the Mead 'Avenue railroad crossing, be passed as read: carried, Brown,.Keith, Lambert,.Larson, McNeice and Robinson voting aye on roll call. "RESOLUTION NO.•D- 1546, -A RESOLUTION authorizing the City Manager of the City of Yakima to petition the Washington Utilities and Transportation Commission'for authorization to im- prove the Mead '.Avenue railroad crossing. City Manager McMicken stated that there would be no action taken on the next item on the Agenda at this time and that it would be brought on later for action by the City Council. (Item #9, Authorization to purchase real property from Alex M. Keith, . Lambert, Larson, McNeice and Robinson voting aye by voice vote. Lust absent. City Manager McMicken commended Public Works Director John Mayo and his Staff for the work accomplished and the manner in which the one-way traffic pattern changes have been carried out. City Council members concurred in this commendation. City Manager McMicken referred the matter of the Plans of Yakima County re solid waste disposal during 1971, to Public Works Director John Mayo, who explained that a letter has been received from Yakima County regarding this situation, for our information only, as it does not pertain to the City. He read this letter which explained that the Clean Air Authority has made it mandatory that there be no more burning dumps by 1972 and the County will be in the land fill business similar to what the City is now. City Council members discussed the matter of the solid waste disposal program in general. No action was taken or was necessary on this matter. City Attorney Andrews reported that we now have the consent of the property owners on the final piece of right-of-way to be obtained on 24th.Avenue, to be able to proceed with the construction work, which consists of removing the old bridge and building a new one, and which enables this project to be completed within several weeks. He further reported that this consent allows the work to be accomplished in advance of the settlement of a price to be .paid the property owners for this right-of-way. City Manager McMicken reported that Mayor Larson has received a letter from the Government regarding Revenue Sharing legislation, and after due discussion, it was MOVED by Robinson, seconded by Keith that Mayor Larson be authorized to speak for the City Council regarding this matter: carried, Brown,,Keith, Lambert,.Larson, McNeice and Robinson voting aye by voice vote. City Manager McMicken expressed appreciation and commended City Clerk Donelson and her .Staff for the extra work being done in connection with the registration of voters for the next General Election, November 3, 1970. City Clerk Donelson reported that besides the special registrars in the schools and the mobile unit, she had deputized members of the League of Women Voters to register people in two branches of the Bank of Yakima. She indicated that a report will be given after a full analysis can be made of the program.
