Coun- cilman Brown and City Manager - McMicken -having been• excused at a previous meeting it was MOVED by Robinson; seconded by Keith =that Councilman Lust'be excused from this-meeting: carried, Keith; Lambert, - Larson, . and Robinson voting -aye voice vote. The Invocation was given by Councilman Keith. The minutes of the regular meeting of September 21,-1970, having been duly certified accur- ate by two Councilmen, and no one present wishing to have said- minutes read publicly, Mayor Larson declared said minutes approved recorded - - - Petition No. 674, having been filed with the-City Clerk on September 24, 1970, by Arthur J. Thompson ,& Others, requesting improvement of property by the construction of a sewer on the south side of Mead Avenue, between Ledwich and South First Avenues, it was MOVED by Robin- ' son,.seconded by Lambert that said Petition for the creation of a =Local Improve- ment District, be referred the City Manager and Staff for study and recommendation: carried, Keith,• Lambert;. Larson, McNeice and Robinson • voting -aye by voice vote. - Brown and Lust absent. • Damage Claims having been filed with the City•Clerk by .Clay • Carroll, 706 S. 16th Avenue, on September .24, 1970, in the amount of $29.98 damages caused by a sewer r- backup at 317 Holton Avenue, owned by claimant, and by Grace R. Haney, at 317 Holton Avenue, on September 25, 1970, in the amount of•$257.00, for damages caused to personal belongings by the same sewer backup .as the other damage claim, it was -MOVED by Lambert,•. seconded by McNeice that said damage claims be referred to the City Manager-and .Staff for study and. recommendation: carried; Keith,. Lambert, Larson-; McNeice and Robinson voting aye by voice vote. Brown and Lust absent. .. - - - There being a number of persons present regarding the•last item on the Agenda, it was MOVED by Robinson, seconded by Lambert that we deviate from the regular order on the Agenda and consider item 12 next, which is a report by the Chief of Police regarding the Security Seiminar: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Brown and Lust absent. Police Chief•Madden being present, reported that the .Yakima Police Department in conjunc- tion with the Yakima Valley College, The Yakima Chamber of Commerce and the Small-Business Administration, are cooperating in the presenting of the second Annual Security Seminar for Retail Managers and Employees, which will be held at the Yakima Valley College, the 1st Section on October 6, 8, 13 and 15, 1970; the 2nd Section on October 27, 29, November 3 and 5, 1970; and the 3rd Section, if necessary, will be held December 8, 10, 15 and 17, 1970, and will encompass most all of the security problems of the merchant, and will be appli- cable to Employees, Owners and Managers reported that other classes will be held for Owners, Managers and Supervisory personnel on October 20 and 22, 1970. He intro- duced Lt. Bernard Kline of the Police Department, who briefly explained what the classes will cover, and also introduced representatives' of the Chamber of Commerce, the Yakima Valley College Extension Courses and the-Police Course Instructor at the College, who spoke favorably of the Security Seminar. Chief Madden stated that the course :is free, that any interested persons are welcome to attend and should sign up for these courses as soon as possible, as they already have 300 signed up for the courses and will be able-to -- accommodate approximately 160 at each class. It was MOVED by McNeice, seconded by Keith that Ordinance No. 1251 relating to traffic con- trol and authorizing the impounding of vehicles in certain circumstances and amending the Yakima Municipal Code, be passed as read: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown and Lust absent. City Attorney Andrews explained that the amendments that are being made in the present Code, mainly have to do with adding the words "Subject to Impound ", "Tow Away Zone ", or words of similar import on such signs that indicate no parking at certain times, and some other changes in the wording of this section of the Code. Police Chief Madden stated that all desk °cl - of hotels and motels, and restaurants with such signs in front of them, will be contacted and given this informa- tion so that their customers will not be parking all night on these certain streets. ORDINANCE NO. 1251, AN ORDINANCE relating to traffic control; authorizing the impounding of vehicles in certain circumstances; amending subsection 9.80.080 (a) of the City of Yakima Municipal Code; and declaring an emergency. Assistant City Manager Friedline referring to the Resolution of Intention to improve prop- erty by constructing curbs, gutters, surfacing of streets, and sidewalk, for property located on the southwest corner of Lincoln and 16th Avenues, in accordance with Petition No. 661, it was MOVED by Keith, seconded by Lambert that Resolution No. D -1541, a Resolu- tion of Intention to create a local improvement district and fixing October 19, 1970, as the time for a hearing on said matter, be passed as read: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown and Lust absent. RESOLUTION NO. D -1541, A RESOLUTION of intention to create a local improvement district. Assistant City Manager Friedline reporting that in accordance with action taken by the City Council at the previous meeting of September 21, 1970, legislation has been prepared as recommended by City Manager Report #95, to transfer the City bus system to the City, it was MOVED by Robinson, seconded by Keith that Resolution No. D -1542 authorizing the purchase without calling for bids of.buses, service vehicles and equipment, be passed as read: carried, Keith, - Lambert, - Larson, and Robinson voting aye On roll call. Brown and Lust absent. RESOLUTION NO. D -1542, A RESOLUTION authorizing the purchase without calling for bids of buses, service vehicles and equipment from National City Management Company. Assistant City Manager Friedline explaining that the City leases from the Yakima Valley Transportation Company premises used for a bus garage and fueling facilities for the Tran- sit Department in accordance with an agreement which will expire on October 2, 1970, and the City desiring to extend the term of that lease agreement for an additional one year period in accordance with an Extension Rider, it was MOVED by Keith, seconded by Lambert that Resolution No. D -1543 authorizing the execution of said lease renewal agreement, be passed as read: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown and Lust absent. 111 SEPTEMBER 28, 1970 RESOLUTION NO. .D- 1543,.A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute a lease renewal agreement with Yakima Valley Transportation Com- pany for Transit Department facilities. Assistant City Manager Friedline explaining that in accordance with action taken by the City Council on August 17, 1970, regarding some surplus items that the City owns, when it was decided that these items should be disposed of at the next Police Auction Sale, that legislation has been prepared to authorize this action, it was MOVED by Robinson, seconded by McNeice that Resolution No. D-1544 authorizing the sale of said surplus property owned by the City, be passed as read: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown and Lust absent. RESOLUTION NO. D -1544, A RESOLUTION authorizing the sale of surplus personal property owned by the City. ' Public Works Director John Mayo.gave a brief report on the Street repair work being done and a time schedule of when the direction of traffic would.be changed on the various streets within the next week or so. There being no further business to come before the Council, it was MOVED by McNeice, seconded by'Keith that we do now adjourn at the hour of 3:40 P.M.: carried,.Keith, Lambert, Larson,.
